| For purposes of strengthening the openness and transparency of legislation and improving the law-making quality, the State Intellectual Property Office (“SIPO”) issues the Provisions on Trademark Electronic Application (Draft for Comment) drafted by SIPO and the drafting instructions in an attempt to solicit the comments from all walks of life in the society. The general public may log on to the official website of the SIPO or follow its WeChat public account to check the Draft for Comment and the drafting instructions. The relevant entities and individuals may, prior to June 28, 2019, offer their specific opinions on how to modify and improve the Draft for Comment in the following three ways: | | 为增强立法公开性和透明度，提高立法质量，国家知识产权局将起草的《关于商标电子申请的规定（征求意见稿）》及其起草说明公布，征求社会各界意见。公众可以登录国家知识产权局官网，关注国家知识产权局微信公众号，查看征求意见稿及其起草说明。有关单位和各界人士可以在2019年6月28日前，通过以下三种方式，围绕征求意见稿的修改完善提出具体意见： |

| Article 1 For purpose of regulating the filing of trademark application electronically, these Provisions are developed in accordance with the Trademark Law of the People's Republic of Law and the Regulation on the Implementation of the Trademark Law of the People's Republic of China. | | 第一条 为规范商标电子申请行为，根据《中华人民共和国商标法》及《中华人民共和国商标法实施条例》，制定本规定。 |

| Article 4 Where a party concerned files a trademark application electronically or accepts the electronic service of trademark documents, it shall sign with the SIPO the Usage Agreement for the Users of Online Trademark Service System (hereinafter referred to as the “User Agreement”), complete the user registration through the online trademark service system, and fill out the authentic and valid user information as required. | | 第四条 当事人提交商标电子申请或者接受商标文件电子送达的，应当依照本规定与国家知识产权局签订《商标网上服务系统用户使用协议》（以下简称用户协议），通过商标网上服务系统进行用户注册，按要求填写的用户信息应当真实有效。 |
Article 5 A party concerned may handle the trademark electronic application on its own, or authorize a legally-established trademark agency to do so.
