| The natural resources departments of all provinces, autonomous regions, and municipalities directly under the Central Government: | | 各省、自治区、直辖市自然资源主管部门： |
| Rare earth ore and tungsten ore are specific types of ores that shall be subject to protective mining according to the provisions issued by the state Council. For the purposes of protecting and rationally developing and utilizing superior mineral resources, thoroughly implementing the decisions and arrangements of the CPC Central Committee and the State Council, and further regulating and strengthening the administration of approval of exploration and mining of rare earth and tungsten mineral resources, in accordance with the mineral resource laws and regulations and the relevant provisions issued by the State Council, you are hereby notified of the relevant matters as follows: | | 稀土矿、钨矿是国务院规定实行保护性开采的特定矿种。为保护和合理开发利用优势矿产资源，深入贯彻落实党中央、国务院决策部署，进一步规范和加强稀土矿、钨矿勘查开采审批管理，根据矿产资源法律法规及国务院有关规定，现就有关事项通知如下： |
| I. The acceptance of applications for new rare earth mineral exploration and mining registration shall continue to be suspended, except under the following circumstances: | | 一、继续暂停受理新设稀土矿勘查开采登记申请。下列情形除外： |
| (1) It is a rare earth element reconnaissance, prospecting or necessary general exploration project fully supported by the central or provincial fiscal funds, whose applicant files an application with the Ministry of Natural Resources based on the budgetary documents issued, and cancels the prospecting right upon the completion of the project. Where rare earth mineral resources are discovered upon exploration, the applicant shall undergo the formalities for prospecting right cancellation after the registration of total identified mineral resource reserves, and such resources shall be included in the list of state-funded exploration results for administration. | | （一）全额使用中央或者省级财政资金开展的稀土矿预查、普查或者必要的详查项目，凭下达预算文件向自然资源部提出申请，项目结束后注销探矿权。勘查发现稀土矿资源的，应在查明矿产资源储量登记后办理注销手续，纳入国家出资勘查形成的成果清单进行管理。 |
| (2) It is a rare earth exploration project whose applicant is qualified as a large-sized rare earth enterprise group as determined by the state. | | （二）申请人具有国家确定的大型稀土企业集团主体资格的稀土勘查项目。 |
| (3) It is a rare earth mining project which complies with the industrial policies and total mining volume control requirement of the state and whose applicant is qualified as a large-sized rare earth enterprise group as determined by the state. | | （三）符合国家产业政策和开采总量控制要求，且申请人具有国家确定的大型稀土企业集团主体资格的稀土开采项目。 |
| II. An application for a new tungsten mining right shall comply with the industrial policies and total mining volume control requirement of the state. | | 二、申请新设钨矿采矿权，应符合国家产业政策和开采总量控制要求。 |
| III. Poverty-stricken areas determined by the state shall, under the same conditions, be given more support in establishing new rare earth ore and tungsten ore prospecting and mining rights in accordance with the law. | | 三、新设稀土矿、钨矿探矿权、采矿权，同等条件下依法对国家确定的贫困地区给予支持。 |
IV. The establishment of new rare earth ore and tungsten ore mining rights shall be subject to environmental impact assessment in accordance with the law and meet the requirements for ecology and environment protection. No total mining volume control quota may be allocated to the mining rights that seriously damage the environment and fail to fulfill the obligations of mine ecological restoration.
