Guiding Opinions of the General Office of the State Council on Creating a Favorable Market Environment and Promoting the Non-ferrous Metals Industry to Adjust Structure, Advance Transformation and Increase Efficiency 

国务院办公厅关于营造良好市场环境促进有色金属工业调结构促转型增效益的指导意见

To people's governments of all provinces, autonomous regions and municipalities directly under the Central Government, and all ministries and commissions of, and departments directly under, the State Council, 各省、自治区、直辖市人民政府,国务院各部委、各直属机构:
The non-ferrous metals industry is an important industry of basic raw materials. In recent years, China's non-ferrous metals industry has witnessed constant expansion in its size, optimization of its industrial structure, improvement of its quality levels and enhancement of its capabilities to engage in international business operations, achieving rapid development. At the same time, however, affected by changes in international and domestic economic development trends, market demand for non-ferrous metals is weak, and structural overcapacity, market supply-demand imbalance and other deep-rooted contradictions and problems that have been accumulated in the non-ferrous metals industry over a long period of time have gradually came to the fore. With a view to enforcing the decisions and deployments of the CPC Central Committee and the State Council on promoting supply-side structural reforms and developing China into a manufacturing power, and promoting the sustained and healthy development of the non-ferrous metals industry, these Opinions are hereby put forward as follows upon consent of the State Council: 有色金属工业是重要的基础原材料产业。近年来,我国有色金属工业规模不断扩大,产业结构不断优化,质量水平不断提高,国际化经营能力不断增强,实现了较快发展。但与此同时,受国际国内经济形势变化影响,有色金属市场需求低迷,有色金属工业长期积累的结构性产能过剩、市场供求失衡等深层次矛盾和问题逐步显现。为贯彻落实党中央、国务院关于推进供给侧结构性改革、建设制造强国的决策部署,推动有色金属工业持续健康发展,经国务院同意,现提出以下意见:
1. General requirements   一、总体要求
(1) Guiding thoughts. It is imperative to enforce the requirements laid down at the 18th National Congress of the CPC, the Third, Fourth and Fifth Plenary Sessions of the 18th Central Committee of the CPC and the Central Economic Work Conference in a comprehensive manner, firmly establish and implement the philosophy of innovative, coordinated, green and open development that enables the sharing of benefits according to the "five in one" overall layout (the five aspects of economy, politics, culture, society and ecology) and the "four comprehensive" strategic layout (i.e. developing a moderately well-off society, deepening reform, governing the country by rule of law and tightening Party discipline in a comprehensive manner), advance supply-side structural reforms, optimize existing capacity, guide the addition of new capacity and take the initiative to cut obsolete capacity to resolve the issues of structural overcapacity, promote technological progress of the non-ferrous metals industry, expand the application and the consumer market of non-ferrous metals, enhance international cooperation in terms of production capacity, and create a favorable business environment, so as to promote the non-ferrous metals industry to adjust structure, advance transformation and improve efficiency. (一)指导思想。全面贯彻党的十八大和十八届三中、四中、五中全会以及中央经济工作会议精神,按照“五位一体”总体布局和“四个全面”战略布局,牢固树立和贯彻落实创新、协调、绿色、开放、共享的发展理念,推进供给侧结构性改革,优化存量、引导增量、主动减量,化解结构性过剩产能,促进行业技术进步,扩大应用消费市场,加强国际产能合作,创造良好营商环境,推动有色金属工业调结构、促转型、增效益。
(2) Basic principles. (二)基本原则。
The principle of market-oriented development shall be upheld. It is required to play the decisive role of the market in allocating resources, let enterprises engage in business operations and make decisions on their own, and attract production factors to gravitate towards promising fields; and, reinforce the mechanism of letting the market exert bottom-up pressure, and urge excess capacity and non-competitive capacity to proactively exit the market. 坚持市场主导。发挥市场配置资源的决定性作用,由企业自主经营决策,吸引生产要素向有前景的领域聚集。强化市场倒逼机制,促使过剩产能和不具备竞争力的产能主动退出。
The principle of government guidance shall be upheld. It is required to improve incentive and restraint mechanisms, fine-tune relevant policy measures, rigorously enforce environmental protection, energy consumption, quality, safety and other standards, and promote enterprises to compress or cut excess capacity and engage in international cooperation, so as to achieve the transformation and upgrading of the entire industry. 坚持政府引导。健全激励约束机制,完善相关政策措施,严格实施环保、能耗、质量、安全等标准,推动企业压减过剩产能、开展国际合作,实现转型升级。
The principle of innovation-driven development shall be upheld. It is required to adapt to the trends of technological progresses and industry developments, strengthen innovation of technology, institutions, management and models, push for the commercialization of scientific and technological achievements, actively popularize new products and new business models, and shore up the weak aspects in industrial development. 坚持创新驱动。适应科技进步和产业发展趋势,加强技术创新、制度创新、管理创新和模式创新,推进科技成果产业化,积极推广新型产品和新兴业态,补齐产业发展短板。
The principle of classified guidance shall be upheld. According to the attributes and characteristics of the varieties of non-ferrous metals, it is required to apply different policies in different regions and to different enterprises in light of actual regional resource conditions and industrial development realities, so as to promote the orderly development of the industry as a whole. 坚持分类指导。按照有色金属品种属性和特点,结合地区资源禀赋条件和产业发展实际,因地制宜,因企施策,促进产业有序发展。
(3) Main objectives. Efforts shall be made to optimize the industrial structure of the non-ferrous metals industry, achieve basic supply-demand balance for key varieties, maintain the capacity utilization ratio of electrolytic aluminum at 80% or above, significantly enhance the capacity to ensure the availability of copper, aluminum and other mineral resources, further raise the levels of development and utilization for rare metal resources, steadily increase the percentage of renewable non-ferrous metals used, achieve breakthroughs in key processes, technologies and equipment, further increase the consumption of non-ferrous metals materials in fields such as aerospace, automobiles, construction, electronics, packaging, etc., make substantive progress in major international capacity cooperation project, and significantly improve the development quality and efficiency of the non-ferrous metals industry. (三)主要目标。优化有色金属工业产业结构,重点品种供需实现基本平衡,电解铝产能利用率保持在80%以上,铜、铝等品种矿产资源保障能力明显增强,稀有金属资源开发利用水平进一步提升,再生有色金属使用比重稳步提高,重点工艺技术装备取得突破,航空、汽车、建筑、电子、包装等领域有色金属材料消费量进一步增加,重大国际产能合作项目取得实质性进展,有色金属工业发展质量和效益明显提升。
2. Key tasks   二、重点任务
(4) The addition of new capacity shall be strictly controlled. The Guiding Opinions of the State Council on Addressing the Conflicts Caused by Serious Industry Overcapacity (Guo Fa [2013] No. 41) and other relevant provisions shall be resolutely enforced. As regards projects to add new electrolytic aluminium capacity (or modify or expand existing capacity) that are genuinely necessary, their plans for equal capacity or reduced capacity replacement shall be strictly followed and made public online. Public oversight and other means shall be made use of to step up supervision and inspection, and severely crack down on and punish new electrolytic aluminum projects built in violation of relevant provisions. Relevant parties and personnel involved in the addition of new capacity in violation of relevant provisions shall be held accountable in a stern manner pursuant to pertinent provisions. (All provincial people's governments, the National Development and Reform Commission ("NDRC"), the Ministry of Industry and Information Technology ("MIIT"), the Ministry of Land and Resources ("MLR"), the Ministry of Environmental Protection ("MEP") and the State-owned Assets Supervision and Administration Commission of the State Council shall be responsible for tasks in this regard.) (四)严控新增产能。坚决落实《国务院关于化解产能严重过剩矛盾的指导意见》(国发〔2013〕41号)等有关规定,确有必要的电解铝新(改、扩)建项目,要严格落实产能等量或减量置换方案,并在网上公示。利用社会监督等手段,加大督促检查工作力度,严厉查处违规新建电解铝项目。按有关规定对违规新增产能的有关方面和人员严肃问责。(各省级人民政府、国家发展改革委、工业和信息化部、国土资源部、环境保护部、国务院国资委负责)
(5) The exit of excess capacity shall be accelerated. (五)加快退出过剩产能。
Excess capacity shall be made to exit the market and be disposed of in accordance with laws and regulations. It is important to conduct a comprehensive investigation to understand the environmental protection, energy consumption, quality, safety, technology and other aspects of the key varieties of non-ferrous metals; and, improve the major pollutant online monitoring system, strengthen the fairness and impartiality of law enforcement operations, immediately order enterprises that fail to comply with laws and regulations, industry policies and relevant standards to make rectification, shut down those that still fail to meet relevant requirements after rectification pursuant to the law and order them to exit the market, and announce relevant information at the same time via the websites of provincial people's governments or their relevant departments for public oversight. (All provincial people's governments, the MEP, the NDRC, the MIIT, the General Administration of Quality Supervision, Inspection and Quarantine ("AQSIQ") and the State Administration of Work Safety shall be responsible for tasks in this regard.)

 依法依规退出和处置过剩产能。全面调查掌握有色金属重点品种的环保、能耗、质量、安全、技术等情况。完善主要污染物在线监控体系,加强公平公正执法,对不符合法律法规、产业政策和相关标准的企业,要立即限期整改;未达到整改要求的,要依法依规关停退出,同时在省级人民政府或其部门的网站上公告,接受社会监督。(各省级人民政府、环境保护部、国家发展改革委、工业和信息化部、质检总局、安全监管总局负责)
