| Announcement on Implementing the Catalogue of Priority Industries for Foreign Investment in Central and Western China, as Revised 2017 | | 关于执行《中西部地区外商投资优势产业目录（2017年修订）》的公告 |
| The National Development and Reform Commission and the Ministry of Commerce issued by Order No. 46 the Catalogue of Priority Industries for Foreign Investment in Central and Western China, as Revised 2017, which shall come into force on March 20017. The relevant issues in the implementation by the Customs are announced as follows: | | 国家发展改革委、商务部第46号令公布了《中西部地区外商投资优势产业目录（2017年修订）》，并规定自2017年3月20日起施行。现就海关执行中的有关问题公告如下： |
| I. As of March 20, 2017, the equipment imported for the importer's own use within the total amount of investment as well as the technology, components, auxiliary equipment and spare parts imported along with the aforesaid equipment under contracts for foreign-funded projects (including additional investment projects) within the scope of the Catalogue of Priority Industries for Foreign Investment in Central and Western China, as Revised 2017, excluding the goods listed in the Catalogue of Imported Goods Not Exempted from Tax for Foreign-Funded Projects and the Catalogue of Imported Crucial High-Tech Equipment and Products Not Exempted from Tax, shall be exempt from import tariff in accordance with the Notice of the State Council on Adjusting Tax Policies for Imported Equipment (No. 37 [1997], State Council), the Announcement No. 103 [2008] of the General Administration of Customs, and other relevant provisions, but shall be subject to the import value-added tax according to the relevant provisions. | | 一、自2017年3月20日（含当日）起，对属于《中西部地区外商投资优势产业目录（2017年修订）》范围的外商投资项目（包括增资项目），在投资总额内进口的自用设备以及按照合同随上述设备进口的技术和配套件、备件，按照《国务院关于调整进口设备税收政策的通知》（国发〔1997〕37号）和海关总署公告2008年第103号及其他有关规定，除《外商投资项目不予免税的进口商品目录》和《进口不予免税的重大技术装备和产品目录》所列商品外，免征进口关税，进口环节增值税照章征收。 |
II. After the Catalogue of Priority Industries for Foreign Investment in Central and Western China, as Revised 2017, comes into force, the code of the “Project Industrial Policy Items” in the Confirmation Letter on Domestic and Foreign Investment Projects Encouraged by the State, official reply or recordation receipt for the formation (additional investment) of foreign-funded enterprises, and other relevant documents issued by the competent departments of investment according to the Catalogue is “R.” For example, the eighth item of Shanxi Province shall be filled in as: “Comprehensive development and utilization of coal-bed gas and coal associated resources (R1408)”, and the project nature shall still be “I: priority foreign investment industries and items in central and western China;” and relevant project entities shall, upon strength of the aforesaid relevant documents and other relevant materials, apply with the Customs for undergoing the formalities of tax reduction or exemption under the provisions.
．．．．．． | | 二、《中西部地区外商投资优势产业目录（2017年修订）》实施后，投资主管部门按照该目录出具的《国家鼓励发展的内外资项目确认书》、外商投资企业设立（增资）批复或备案回执等相关文件中的“项目产业政策条目”编码为“R”。例如，山西省第8项应填写为：“煤层气和煤炭伴生资源综合开发利用（R1408）”，项目性质仍为“I：外资中西部优势产业、项目”；有关项目单位持上述相关文件及其他有关材料，按规定向海关申请办理减免税相关手续。
