| In order to thoroughly implement the spirit of the Fourth Plenary Session of the 18th CPC Central Committee, complete the judicial reform tasks of making explorations to institute public interest litigations by procuratorial organs, and guarantee the proper trial of public interest litigation cases instituted by people's procuratorates, in accordance with the Decision of the Standing Committee of the National People's Congress on Authorizing the Supreme People's Procuratorate to Launch the Pilot Program of Initiating Public Interest Litigations in Certain Areas, the Supreme People's Court has developed the Measures for the Implementation of the Pilot Program of Trial by People's Courts of Public Interest Litigation Instituted by People's Procuratorates by People's Courts. As adopted at the 1,679th meeting of the Judicial Committee of the Supreme People's Court on February 22, 2016, these Implementation Measures are hereby issued and shall come into force on March 1, 2016. All people's courts in regions covered by the pilot program shall conscientiously implement these Implementation Measures. | In order to implement the Decision of the Standing Committee of the National People's Congress on Authorizing the Supreme People's Procuratorate to Launch the Pilot Program of Initiating Public Interest Litigations in Certain Areas and try public interest litigation cases instituted by people's procuratorates according to the law, these Measures are developed in accordance with the Civil Procedure Law of the People's Republic of China, the Administrative Procedure Law of the People's Republic of China, and other relevant legal provisions and in light of the practical trial work. | | 为贯彻实施《全国人民代表大会常务委员会关于授权最高人民检察院在部分地区开展公益诉讼试点工作的决定》，依法审理人民检察院提起的公益诉讼案件，依据《中华人民共和国民事诉讼法》《中华人民共和国行政诉讼法》等法律的规定，结合审判工作实际，制定本办法。 |
| I. Civil Public Interest Litigations | | 一、民事公益诉讼 |
| Article 1 Where the people's procuratorate holds that the defendant commits such acts harming the social and public interests as polluting the environment, damaging the ecology, and infringing upon the lawful rights and interests of numerous consumers in the field of food and drug safety, the people's procuratorate may, in the absence of rightful subject or under the circumstance where the rightful subject does not institute any lawsuit, institute a civil public interest litigation in the people's court. If such litigation conforms to the provisions of items (2), (3), and (4) of Article 119 of the Civil Procedure Law, the people's court shall register and place it on file. | | 第一条 人民检察院认为被告有污染环境、破坏生态、在食品药品安全领域侵害众多消费者合法权益等损害社会公共利益的行为，在没有适格主体提起诉讼或者适格主体不提起诉讼的情况下，向人民法院提起民事公益诉讼，符合民事诉讼法第一百一十九条第二项、第三项、第四项规定的，人民法院应当登记立案。 |
| Article 2 Before instituting a civil public interest litigation, the people's procuratorate shall submit the following materials: | | 第二条 人民检察院提起民事公益诉讼应当提交下列材料： |
| (1) the written complaint conforming to the provisions of Article 121 of the Civil Procedure Law and the copies thereof according to the numbers of defendants; | | （一）符合民事诉讼法第一百二十一条规定的起诉状，并按照被告人数提出副本； |
| (2) the preliminary evidentiary materials proving such acts harming the social and public interests as polluting the environment, damaging the ecology, and infringing upon the lawful rights and interests of numerous consumers in the field of food and drug safety; and | | （二）污染环境、破坏生态、在食品药品安全领域侵害众多消费者合法权益等损害社会公共利益行为的初步证明材料； |
| (3) the evidentiary materials proving that the people's procuratorate has performed the pre-trial procedure for urging or giving support to the organ as prescribed by law or the relevant organization to institute a civil public interest litigation. | | （三）人民检察院已经履行督促或者支持法律规定的机关或有关组织提起民事公益诉讼的诉前程序的证明材料。 |
| Article 3 When instituting a civil public interest litigation, the people's procuratorate may raise such claims as requiring the defendant to cease the infringement, excluding obstructions, eliminating dangers, restoring to the original state, compensating for losses, and extending a formal apology. | | 第三条 人民检察院提起民事公益诉讼，可以提出要求被告停止侵害、排除妨碍、消除危险、恢复原状、赔偿损失、赔礼道歉等诉讼请求。 |
| Article 4 When the people's procuratorate institutes a civil public interest litigation as a public interest litigant, the litigation rights and obligations shall refer to the provisions of the Civil Procedure Law on the litigation rights and obligations of the plaintiff. The defendant in a civil public interest litigation shall be a citizen, legal person, or other organization that commits an act harming the social and public interests. | | 第四条 人民检察院以公益诉讼人身份提起民事公益诉讼，诉讼权利义务参照民事诉讼法关于原告诉讼权利义务的规定。民事公益诉讼的被告是被诉实施损害社会公共利益行为的公民、法人或者其他组织。 |
Article 5 A first instance civil public interest litigation case instituted by the people's procuratorate shall be under the jurisdiction of an intermediate people's court at the place where the infringing act or damage occurs or at the domicile of the defendant, unless otherwise prescribed by laws and judicial interpretations.
