The Provisions on the Provisions on the Safety Supervision and Administration of Carriage of Solid Bulk Cargoes by Sea, as adopted at the 2nd executive meeting of the Ministry of Transport on January 16, 2019, are hereby issued and shall come into force on March 1, 2019. 《海运固体散装货物安全监督管理规定》已于2019年1月16日经第2次部务会议通过,现予公布,自2019年3月1日起施行。

Provisions on the Safety Supervision and Administration of Carriage of Solid Bulk Cargoes by Sea 海运固体散装货物安全监督管理规定
Chapter 1 General Provisions 

第一章 总 则

Article 1 For purposes of strengthening the supervision and administration of carriage of solid bulk cargoes by sea and guaranteeing the safety of life and property at sea, these Provisions are developed in accordance with the Maritime Traffic Safety Law of the People's Republic of China and the Law of the People's Republic of China on Ports.   第一条 为了加强海运固体散装货物监督管理,保障海上人命、财产安全,依据《中华人民共和国海上交通安全法》《中华人民共和国港口法》等法律,制定本规定。
Article 2 These Provisions shall apply to the carriage of solid bulk cargoes by vessels within the seas of the People's Republic of China.   第二条 船舶在中华人民共和国管辖海域内从事载运固体散装货物,适用本规定。
Article 3 The Ministry of Transport shall be in charge of the safety management of carriage of solid bulk cargoes by sea across the country.   第三条 交通运输部主管全国海运固体散装货物的安全管理工作。
The maritime safety administration of the state shall be responsible for the safety supervision and administration of carriage of solid bulk cargoes by sea across the country according to its duties. 国家海事管理机构按照职责负责全国海运固体散装货物的安全监督管理工作。
The other maritime safety administrations at all levels shall specifically responsible for the safety supervision and administration of carriage of solid bulk cargoes by sea according their respective duties. 其他各级海事管理机构按照各自职责权限具体负责海运固体散装货物的安全监督管理工作。
Article 4 A vessel carrying Group B solid bulk cargoes shall also comply with the Provisions on the Safety Supervision and Administration of Carriage of Hazardous Goods by Vessels.   第四条 船舶载运B组固体散装货物的,还应当遵守《船舶载运危险货物安全监督管理规定》。
Chapter II General Rules 

第二章 一般规定

Article 5 A vessel owner, operator or manager engaged in the carriage of solid bulk cargoes shall, in accordance with the provisions of the MOT, establish and implement the systems or rules for the safe operation of vessels and the management of pollution prevention, which shall include the procedures, instructions or management rules for the carriage of solid bulk cargoes.   第五条 从事固体散装货物运输的船舶所有人、经营人或者管理人,按照交通运输部有关规定建立和实施的船舶安全营运和防污染管理体系或者制度,应当包括载运固体散装货物的程序、须知或者管理制度。
Article 6 For a vessel carrying solid bulk cargoes, the loading manual or stability calculation book of the vessel shall list the typical working conditions for safety and seaworthiness of the cargoes.   第六条 载运固体散装货物的船舶,其船舶装载手册或者稳性计算书中应当列出所载货物安全适运的典型工况。
Article 7 The carriage of solid bulk cargoes by vessels shall comply with the safety technical specifications for stowage, isolation and transport of such cargoes, and shall satisfy the corresponding requirements for the fitness certificate or certification.   第七条 船舶载运固体散装货物,应当符合有关积载、隔离和运输的安全技术规范,并符合相应适装证书或者证明文书的要求。
Article 8 The owners, operators or managers of vessels shall conduct trainings and assessments of the seafarers' professional knowledge of solid bulk cargoes so as to ensure that the seafarers are familiar with the characteristics, operating procedures and emergency plans for solid bulk cargoes.   第八条 船舶所有人、经营人或者管理人应当对船员进行固体散装货物专业知识培训和考核,保证船员熟悉固体散装货物的特性、操作规程及应急预案。
Article 9 The personnel undergoing the reporting procedures in accordance with these Provisions shall be familiar with relevant regulations, standards, specifications and reporting procedures.   第九条 按照本规定办理报告手续的人员,应当熟悉相关法规、标准规范和报告程序。
Article 10 If the solid bulk cargoes carried by a vessel to be delivered is not listed in the International Maritime Solid Bulk Cargoes Code, the shipper shall submit the identification materials issued by an testing institution with the corresponding qualifications (hereinafter referred to as a “testing institution”) to specify the subgroups, categories, hazards, pollution hazards of cargoes and the technical conditions for the vessel's carriage, which must be completed before delivery of the cargoes for carriage by the vessel.   第十条 拟交付船舶运输的固体散装货物如果未在《国际海运固体散装货物规则》中列出,其托运人应当提交具有相应资质的检测机构(以下简称检测机构)出具的鉴定材料,明确货物的分组、分类、危险性、污染危害性和船舶载运技术条件后,方可交付船舶运输。
Article 11 For the solid bulk cargoes that are harmful to the environment, after unloading of cargoes is completed from the vessel, the residues of the cargoes and tank washing waters shall be collected at port receiving facilities or the vessel pollutant collector, the discharge of which is prohibited, and be recorded truthfully in the garbage record book.   第十一条 对环境有害的固体散装货物,船舶卸货完毕后,货物残余物及其洗舱水应当由港口接收设施或者船舶污染物接收单位接收,禁止排放入水,并按照规定在垃圾记录簿中如实记载。
Chapter III Reporting Management 

第三章 报告管理

Article 12 A vessel carrying solid bulk cargoes other than Group B shall report to the maritime safety administration 24 hours before entering or leaving a port. Where the voyage is less than 24 hours, it shall submit a report before the departure from the previous port. The report shall include the following information:   第十二条 载运B组以外固体散装货物船舶进出港口,应当在进出港口24小时前向海事管理机构报告。航程不足24小时的,应当在驶离上一港口前报告。报告应当包括以下信息内容:
(1) Information on the vessel, such as the name, voyage, nationality, port of departure, port of discharge, site of operation, estimated port of entry and exit, and time of operation. (一)船名、航次、国籍、始发港、卸货港、作业地点、预计进出港口和作业时间等船舶信息;
(2) Information on the cargoes, such as the name, group, class, UN number, total weight and loading position. (二)货物名称、组别、类别、联合国编号、总重量和装载位置等货物信息。
Article 13 A shipper of solid bulk cargoes carried by a vessel to be delivered shall, before delivering the cargoes for carriage, submit the following cargo information to the carrier, and report to the maritime safety administration:   第十三条 拟交付船舶运输固体散装货物的托运人,应当在交付运输前向承运人提交以下货物信息,并报告海事管理机构:
(1) A declaration for the safety and seaworthiness of solid bulk cargoes. (一)固体散装货物安全适运声明书;
(2) A certificate of the transportable moisture limit of cargoes and moisture content of cargoes issued by a testing institution, which shall be submitted for those solid bulk cargoes that may liquefy. (二)属于易流态化固体散装货物的,应当提交检测机构出具的货物适运水分极限和货物水分含量证明;
(3) The identification materials on the conditions for the carriage of the cargoes issued by the testing institution, which shall be submitted by the shipper for those cargoes not listed in the International Maritime Solid Bulk Cargoes Code. (三)载运未在《国际海运固体散装货物规则》中列出的货物,应当提交检测机构出具的货物运输条件鉴定材料;
(4) Valid approval documents, which shall be submitted for those cargoes that may be carried by vessels on international voyages as required after the approval of the relevant departments of the exporting or importing country. (四)国际航行船舶按照规定需要进出口国家的有关部门批准后方可载运的,应当提交有效的批准文件;
(5) Other certificates or documents required by the maritime safety administration in accordance with the provisions in the International Maritime Solid Bulk Cargoes Code. (五)海事管理机构根据《国际海运固体散装货物规则》规定,要求提供的其他证书或者文书。
The principal of port operations shall provide the cargo information mentioned in subparagraph (1) through (3) to the port operator before the loading of solid bulk cargoes. 港口作业委托人应当在固体散装货物装载前,将前款第(一)项至第(三)项的货物信息提供给港口经营人。
Article 14 Where cargo information needs to be obtained through testing, the shipper and the testing institution shall jointly take samples from the cargoes.   第十四条 需要通过检测获得货物信息的,应当由托运人与检测机构共同对货物进行采样。
Article 15 The carrier shall conduct an examination of the cargo information, and shall not carry the cargoes that fail to meet the requirements for seaworthiness of a vessel. Relevant materials, certificates or documents shall be kept on board during carriage.   第十五条 承运人应当对货物信息进行审核,对不符合船舶适装要求的,不得承运。承运期间相关材料、证书或者文书应当保存在船上。
Chapter IV Administration of Operations 

第四章 作业管理

Article 16 A vessel carrying solid bulk cargoes shall, before the loading of cargoes, inspect the materials regarding the carriage and seaworthiness conditions of the cargoes in accordance with the vessel loading manual and stability data. If it finds that it fails to meet the requirements of these Provisions, no cargo shall be loaded or carried.
