| The justice departments (bureaus) and quality and technical supervision bureaus (market regulatory departments) of all provinces, autonomous regions, and municipalities directly under the Central Government; and the Justice Bureau and the Quality and Technical Supervision Bureau of Xinjiang Production and Construction Corps: | | 各省、自治区、直辖市司法厅（局）、质量技术监督局（市场监督管理部门），新疆生产建设兵团司法局、质量技术监督局： |
| For the purposes of implementing the requirements of the Implementation Opinions of the CPC Central Committee and the State Council on Improving the Unified Administration System for Forensic Identification and Evaluation, and conduct strict registration administration and quality administration of forensic identification and evaluation, in accordance with the Decision of the Standing Committee of the National People's Congress on Issues Concerning the Administration of Forensic Identification and Evaluation (hereinafter referred to as the “Decision”), and on the basis of summarizing work experience, upon diligent deliberation, you are hereby notified of the regulation and advancement of the certification and accreditation of forensic identification and evaluation as follows: | | 为贯彻落实党中央、国务院关于健全统一司法鉴定管理体制的实施意见要求，严格司法鉴定登记管理、质量管理，依据《全国人民代表大会常务委员会关于司法鉴定管理问题的决定》（以下简称《决定》）的规定，在总结工作经验的基础上，经认真研究，就规范和推进司法鉴定认证认可工作通知如下： |
| I. Scope and Forms | | 一、范围与形式 |
(1) According to item (3) of Article 5 of the Decision | | （一）依据《决定》第五条第三项规定，对于法人或者其他组织申请从事的司法鉴定业务范围需要检测实验室的，申请人应当具备相应的检测实验室，并且该检测实验室应当通过资质认定（包括计量认证）或者实验室认可；对于申请从事的司法鉴定业务范围不是必需具备检测实验室的，可不必须通过资质认定或者实验室认可。 |
| (2) Combining with the working practice of the administration as well as certification and accreditation of forensic identification and evaluation, a legal person or any other organization that applies to engage in forensic biology, forensic toxicology, trace evidence or environmental damage identification shall have corresponding testing laboratory that passes qualification authentication or laboratory accreditation. | | （二）结合司法鉴定管理和认证认可工作实践，法人或者其他组织申请从事法医物证、法医毒物、微量物证、环境损害鉴定业务的，应当具备相应的通过资质认定或者实验室认可的检测实验室。 |
| II. Work Requirements | | 二、工作要求 |
(3) Where the business scope of a forensic identification or evaluation institution that has been examined by and registered at the judicial administrative organ includes the identification of forensic biology , forensic toxicology, trace evidence or environmental damage, the corresponding testing laboratory of the entity establishing the forensic identification or evaluation institution shall pass qualification authentication or laboratory accreditation before December 31, 2019. The judicial administrative organ shall strictly implement the requirements of the Opinions of the Ministry of Justice on Strict Access, Strict Regulation and the Enhancement of the Quality and Credibility of Forensic Identification and Evaluation (No. 11 [2017], Ministry of Justice), and require the forensic identification or evaluation institution that fails to meet the requirements before the deadline to make rectification during a specified period, and, if the forensic identification or evaluation institution still fails to meet the requirements after doing so, cancel its corresponding business scope according to the law.
．．．．．． | | （三）已经司法行政机关审核登记的司法鉴定机构，业务范围包括法医物证、法医毒物、微量物证、环境损害鉴定的，其设立单位相应的检测实验室应当于2019年12月31日前通过资质认定或者实验室认可。司法行政机关应当严格落实《司法部关于严格准入 严格监管 提高司法鉴定质量和公信力的意见》（司发[2017]11号）要求，对到期未达到要求的司法鉴定机构限期整改，限期整改后仍不符合要求的，依法注销其相应的业务范围。
