| Chapter I General Provisions | | 第一章 总则 |
| Article 1 These Measures are formulated according to the Administrative License Law of the People's Republic of China and the Decision of the State Council on Establishing Administrative License for the Administrative Examination and Approval Items that Really Need to Be Preserved for the purpose of strengthening the administration of project cost consultancy enterprises, enhancing the quality of project cost consultancy work and maintaining the order of the construction market and the social and public interests. | | 第一条 为了加强对工程造价咨询企业的管理，提高工程造价咨询工作质量，维护建设市场秩序和社会公共利益，根据《中华人民共和国行政许可法》、《国务院对确需保留的行政审批项目设定行政许可的决定》，制定本办法。 |
| Article 2 The project cost consultancy businesses carried out within the territory of the People's Republic of China as well as the supervision and administration of project cost consultancy enterprises shall be governed by these Measures. | | 第二条 在中华人民共和国境内从事工程造价咨询活动，实施对工程造价咨询企业的监督管理，应当遵守本办法。 |
| Article 3 The “project cost consultancy enterprises” as mentioned in these Measures refers to the enterprises that accept the entrustment for providing professional consultancy services with respect to the determination and control of the investments in construction projects and the project costs. | | 第三条 本办法所称工程造价咨询企业，是指接受委托，对建设项目投资、工程造价的确定与控制提供专业咨询服务的企业。 |
| Article 4 A project cost consultancy enterprise shall obtain the qualification of a project cost consultancy enterprise according to law and engage in the project cost consultancy business within the licensing scope of its qualification grade. | | 第四条 工程造价咨询企业应当依法取得工程造价咨询企业资质，并在其资质等级许可的范围内从事工程造价咨询活动。 |
| Article 5 A project cost consultancy enterprise shall, when engaging in the project cost consultancy business, observe the principles of independence, objectivity, fairness and good faith, and shall not damage the social and public interests or the lawful rights and interests of others. | | 第五条 工程造价咨询企业从事工程造价咨询活动，应当遵循独立、客观、公正、诚实信用的原则，不得损害社会公共利益和他人的合法权益。 |
| No entity or individual may illegally intervene in the project cost consultancy activities that are carried out according to law. | | 任何单位和个人不得非法干预依法进行的工程造价咨询活动。 |
| Article 6 The construction administrative department of the State Council shall be responsible for uniformly supervising and administrating the project cost consultancy enterprises across the country. | | 第六条 国务院建设主管部门负责全国工程造价咨询企业的统一监督管理工作。 |
| The construction administrative department of the people's government of each province, autonomous region or municipality directly under the Central Government shall be responsible for supervising and administrating the project cost consultancy enterprises within its own administrative region. | | 省、自治区、直辖市人民政府建设主管部门负责本行政区域内工程造价咨询企业的监督管理工作。 |
| The relevant special departments shall be responsible for supervising and administrating the project cost consultancy enterprises of their respective specialties. | | 有关专业部门负责对本专业工程造价咨询企业实施监督管理。 |
| Article 7 The industrial organization of project cost consultancy shall strengthen the industrial self-discipline management. | | 第七条 工程造价咨询行业组织应当加强行业自律管理。 |
| The project cost consultancy enterprises are encouraged to join in the industrial organization of project cost consultancy. | | 鼓励工程造价咨询企业加入工程造价咨询行业组织。 |
| Chapter II Qualification Grades and Standards | | 第二章 资质等级与标准 |
| Article 8 The qualification grades of project cost consultancy enterprises shall be divided into Grade A and Grade B. | | 第八条 工程造价咨询企业资质等级分为甲级、乙级。 |
| Article 9 A Grade A project cost consultancy enterprise shall meet the following qualification standards: | | 第九条 甲级工程造价咨询企业资质标准如下： |
| (1)The enterprise has obtained a qualification certificate for a Grade B project cost consultancy enterprise for 3 full years; | | （一）已取得乙级工程造价咨询企业资质证书满3年； |
| (2)Among the contributors of the enterprise, the number of registered cost engineers is not lower than 60% of the number of total contributors, and the amount of contributions thereof is not lower than 60% of the total amount of subscribed capital contribution; | | （二）企业出资人中，注册造价工程师人数不低于出资人总人数的60％，且其出资额不低于企业认缴出资总额的60％； |
| (3)The technical principal of the enterprise has obtained a registered certificate for cost engineers and has a senior professional technical title of the project or project economic category, and has worked in the field of project cost for more than 15 years; | | （三）技术负责人已取得造价工程师注册证书，并具有工程或工程经济类高级专业技术职称，且从事工程造价专业工作15年以上； |
| (4)There shall be no less than 20 full-time employees for the professional work of project cost (hereinafter referred to as full-time professionals) are not less than 20, among who no less than 16 have the middle-rank professional technical titles of the engineering or engineering economics category, no less than 10 have obtained the registered certificate for cost engineers, and shall have other employees who have experiences in the professional work of project cost; | | （四）专职从事工程造价专业工作的人员（以下简称专职专业人员）不少于20人，其中，具有工程或者工程经济类中级以上专业技术职称的人员不少于16人；取得造价工程师注册证书的人员不少于10人，其他人员具有从事工程造价专业工作的经历； |
| (5)The enterprise has concluded labor contracts with its full-time professionals, and the full-time professionals are under the professional age as prescribed by the State (excluding the contributors); | | （五）企业与专职专业人员签订劳动合同，且专职专业人员符合国家规定的职业年龄（出资人除外）； |
| (6)The personnel archives of the full-time professionals are managed by a nationally accredited personnel agency on their behalf; | | （六）专职专业人员人事档案关系由国家认可的人事代理机构代为管理； |
| (7)The accumulative turnover from project cost consultancy business of the enterprise for the latest 3 years are not less than 5 million yuan; | | （七）企业近3年工程造价咨询营业收入累计不低于人民币500万元； |
| (8)The enterprise has fixed offices, and the office building area per capita is not less than 10 sq. m.; | | （八）具有固定的办公场所，人均办公建筑面积不少于10平方米； |
| (9)The enterprise has a comprehensive technical archives management system, a quality control system as well as a financial management system; | | （九）技术档案管理制度、质量控制制度、财务管理制度齐全； |
| (10)The formalities for the enterprise to purchase basic endowment insurances for its full-time professionals are complete; and | | （十）企业为本单位专职专业人员办理的社会基本养老保险手续齐全； |
| (11)The enterprise has not committed any act prohibited by Article 27 of these Measures within 3 years before the application for verifying its qualification grade is filed. | | （十一）在申请核定资质等级之日前3年内无本办法第二十七条禁止的行为。 |
| Article 10 A Grade B project cost consultancy enterprise shall meet the following qualification standards: | | 第十条 乙级工程造价咨询企业资质标准如下： |
| (1)Among the contributors of the enterprise, the number of registered cost engineers is not lower than 60% of the number of total contributors, and the amount of contributions thereof is not lower than 60% of the total amount of subscribed capital contribution; | | （一）企业出资人中，注册造价工程师人数不低于出资人总人数的60％，且其出资额不低于认缴出资总额的60％； |
| (2)The technical principal of the enterprise has obtained a registered certificate for cost engineers and has a senior professional technical title of the project or project economic category, and has worked in the field of project cost for more than 10 years; | | （二）技术负责人已取得造价工程师注册证书，并具有工程或工程经济类高级专业技术职称，且从事工程造价专业工作10年以上； |
| (3)There shall be no less than 8 full-time professionals is not less than 12, among whom no less than 8 have the middle-rank professional technical titles of the engineering or engineering economics category, no less than 6 have obtained the registered certificate for cost engineers are not less than 6, and shall have other employees who have experiences in the professional work of project cost; | | （三）专职专业人员不少于12人，其中，具有工程或者工程经济类中级以上专业技术职称的人员不少于8人；取得造价工程师注册证书的人员不少于6人，其他人员具有从事工程造价专业工作的经历； |
| (4)The enterprise has concluded labor contracts with its full-time professionals, and the full-time professionals are under the professional age as prescribed by the State (excluding the contributors); | | （四）企业与专职专业人员签订劳动合同，且专职专业人员符合国家规定的职业年龄（出资人除外）； |
| (5)The personnel archives of full-time professionals are managed by a nationally accredited personnel agency on their behalf; | | （五）专职专业人员人事档案关系由国家认可的人事代理机构代为管理； |
| (6)The enterprise has fixed offices, and the office building area per capita is not less than 10 sq. m.; | | （六）具有固定的办公场所，人均办公建筑面积不少于10平方米； |
| (7)The enterprise has a comprehensive technical archives management system, a quality control system as well as a financial management system; | | （七）技术档案管理制度、质量控制制度、财务管理制度齐全； |
| (8)The formalities for the enterprise to purchase basic endowment insurances for its full-time professionals are complete; | | （八）企业为本单位专职专业人员办理的社会基本养老保险手续齐全； |
| (9)The accumulative turnover from the project cost consultancy business of the enterprise within the temporary period are not less than 500,000 yuan; and | | （九）暂定期内工程造价咨询营业收入累计不低于人民币50万元； |
| (10)The enterprise has not committed any act prohibited by Article 27 of these Measures within 3 years before the application for verifying its qualification grade is filed. | | （十）申请核定资质等级之日前无本办法第二十七条禁止的行为。 |
| Chapter III Qualification Licensing | | 第三章 资质许可 |
| Article 11 To apply for the qualification of a Grade A project cost consultancy enterprise, an applicant shall file an application with the construction administrative department of the people's government of the province, autonomous region or municipality directly under the Central Government at the locality of its industrial and commercial registration or the relevant special department of the State Council. | | 第十一条 申请甲级工程造价咨询企业资质的，应当向申请人工商注册所在地省、自治区、直辖市人民政府建设主管部门或者国务院有关专业部门提出申请。 |
| The construction administrative department of the people's government of the province, autonomous region or municipality directly under the Central Government or the relevant special department of the State Council shall complete the examination of application materials within 20 days upon receipt thereof, and report its preliminary examination opinions and all the application materials to the construction administrative department of the State Council. And the construction administrative department of the State Council shall make a decision within 20 days as of the day when the aforesaid application is accepted. | | 省、自治区、直辖市人民政府建设主管部门、国务院有关专业部门应当自受理申请材料之日起20日内审查完毕，并将初审意见和全部申请材料报国务院建设主管部门；国务院建设主管部门应当自受理之日起20日内作出决定。 |
| Article 12 An application for the qualification of Grade B project cost consultancy enterprises shall be subject to the examination and decision of the construction administrative department of the people's government of the province, autonomous region or municipality directly under the Central Government, of which, an application for the qualification of a special Grade B project cost consultancy enterprise shall be subject to the examination and decision of the construction administrative department of the people's government of the province, autonomous region or municipality directly under the Central Government together with the relevant special department. | | 第十二条 申请乙级工程造价咨询企业资质的，由省、自治区、直辖市人民政府建设主管部门审查决定。其中，申请有关专业乙级工程造价咨询企业资质的，由省、自治区、直辖市人民政府建设主管部门商同级有关专业部门审查决定。 |
| The procedures for implementing the qualification of Grade B project cost consultancy enterprises shall be determined by the construction administrative department of the people's government of the province, autonomous region or municipality directly under the Central Government. | | 乙级工程造价咨询企业资质许可的实施程序由省、自治区、直辖市人民政府建设主管部门依法确定。 |
| The construction administrative department of the people's government of the province, autonomous region or municipality directly under the Central Government shall, within 30 days after the decision is made, report the decision on approval of the qualification licensing to the construction administrative department of the State Council for archival filing. | | 省、自治区、直辖市人民政府建设主管部门应当自作出决定之日起30日内，将准予资质许可的决定报国务院建设主管部门备案。 |
| Article 13 To apply for the qualification of a project cost consultancy enterprise, an applicant shall submit the following materials and simultaneously make declaration on the internet: | | 第十三条 申请工程造价咨询企业资质，应当提交下列材料并同时在网上申报： |
| (1)an Application for the Qualification of a Project Cost Consultancy Enterprise; | | （一）《工程造价咨询企业资质等级申请书》； |
| (2)the registration certificates for cost engineers, qualification certificates for the cost personnel, certificates for professional technical titles and the identity cards of the full-time professionals (including the technical principal); | | （二）专职专业人员（含技术负责人）的造价工程师注册证书、造价员资格证书、专业技术职称证书和身份证； |
| (3)the personnel entrustment contracts of full-time professionals (including the technical principal), and the vouchers on paying basic endowment insurances for the present year by the enterprise; | | （三）专职专业人员（含技术负责人）的人事代理合同和企业为其交纳的本年度社会基本养老保险费用的凭证； |
| (4)the articles of association of the enterprise, the agreement on the capital contributions of shareholders; | | （四）企业章程、股东出资协议； |
(5)the business tax invoices for the turnover of the enterprise or the business tax paid certificates for the project cost consultancy turnovers of the enterprise; where the turnover of the enterprise include the turnover from any other business, the financial audit reports on the project cost consultancy turnover shall be issued in addition;
