For purposes of strictly regulating the commutation, parole and temporary service outside an incarceration facility, effectively preventing corrupt practices such as practicing favoritism for personal gains and trading political favors for money, resolutely putting an end to the phenomena, which are of great concern to the public, such as accelerated commutation, a high proportion of parole and temporary service outside an incarceration facility, relatively short time of actual sentencing after “the privileged” and “the rich” are sentenced, ensuring judicial justice, and enhancing judicial credibility, in accordance with the provisions of laws and the spirit of criminal policies and in light of actual circumstances, the following opinions are hereby put forward: 为严格规范减刑、假释、暂予监外执行,切实防止衔私舞弊、权钱交易等腐败行为,坚决杜绝社会反映强烈的“有权人”、“有钱人”被判刑后减刑快、假释及暂予监外执行比例高、实际服刑时间偏短等现象,确保司法公正,提高司法公信力,根据法律规定和刑事政策精神,结合实际,现提出如下意见。
I. Strictly applying the substantive conditions for commutation, parole, and temporary service outside an incarceration facility   一、从严把握减刑、假释、暂予监外执行的实体条件
(1) For the commutation or parole of convicts committing duty-related crimes, crimes of undermining the order of financial management and financial fraud, and crimes of organizing (leading, participating in, harboring, or conniving at) an organization of a gangland nature (hereinafter referred to as “three categories of convicts”), the standards for “actually having true remorse,” “meritorious service,” or “major meritorious service” as prescribed by laws must strictly apply. 1.对职务犯罪、破坏金融管理秩序和金融诈骗犯罪、组织(领导、参加、包庇、纵容)黑社会性质组织犯罪等罪犯(以下简称三类罪犯)减刑、假释,必须从严把握法律规定的“确有悔改表现”、“立功表现”、“重大立功表现”的标准。
For the determination of any of the three categories of convicts who “actually have true remorse,” there shall be an examination not only on whether the convict makes a confession and shows remorse, or conscientiously observes laws, regulations and prison rules and is willing to accept reform through education, or actively participates in ideological, cultural, vocational and technical education, or actively participates in labor activities and puts forth efforts to fulfill labor tasks, but also on whether the convict actively eliminates the social impact arising from his or her convicted acts by such means as actively disgorging the illegal gains or actively assisting in the recovery of overseas illegal gains or actively compensating for losses. A convict who attempts to get an opportunity of commutation or parole by use of personal influence, social relations and other improper means during the service of sentence shall not be determined to “actually have true remorse.” 对三类罪犯“确有悔改表现”的认定,不仅应当考察其是否认罪悔罪,认真遵守法律法规及监规、接受教育改造,积极参加思想、文化、职业技术教育,积极参加劳动、努力完成劳动任务,而且应当考察其是否通过主动退赃、积极协助追缴境外赃款赃物、主动赔偿损失等方式,积极消除犯罪行为所产生的社会影响。对服刑期间利用个人影响力和社会关系等不正当手段企图获得减刑、假释机会的,不认定其“确有悔改表现”。
Where any of the three categories of convicts is to be determined to perform “meritorious service” because of “making technical innovations in production and scientific research activities and performing outstandingly” or “making other contributions to the state or society” as prescribed by laws, such technical innovations or other contributions must be finished independently by the convict during the service of sentence upon confirmation of the provincial competent authority. 对三类罪犯拟按法律规定的“在生产、科研中进行技术革新,成绩突出”或者“对国家和社会有其他贡献”认定为“立功表现”的,该技术革新或者其他贡献必须是该罪犯在服刑期间独立完成,并经省级主管部门确认。
Where any of the three categories of convicts is to be determined to perform “major meritorious service” because of “having invention-creation or major technical innovations” as prescribed by laws, such invention-creation or major technical innovations must be patents for invention finished independently by the convicts during the service of sentence upon confirmation by the national competent authority, excluding patents for utility models and designs; where such a convict is to be determined to perform “major meritorious service” because of “making other major contributions to the state or society” as prescribed by laws, such major contributions must be achievements finished independently by the convict during the service of sentence upon confirmation of the national competent authority. 对三类罪犯拟按法律规定的“有发明创造或者重大技术革新”认定为“重大立功表现”的,该发明创造或者重大技术革新必须是该罪犯在服刑期间独立完成并经国家主管部门确认的发明专利,且不包括实用新型专利和外观设计专利;拟按法律规定的“对国家和社会有其他重大贡献”认定为“重大立功表现”的,该重大贡献必须是该罪犯在服刑期间独立完成并经国家主管部门确认的劳动成果。
(2) The scoring assessment of three categories of convicts and other convicts shall be equal and balanced. In the design of scoring assessment items and criteria for three categories of convicts, general requirements for the reform of other convicts through education shall be taken into consideration, while special requirements for the reform of three categories of convicts through education shall be taken into account, so as to prevent three categories of convicts from being easier to gain points than other convicts in the assessment. Extra points for three categories of convicts shall be further restricted and regulated, and the total amount of extra points shall be strictly controlled. For any convict who intends to gain extra points by making use of his or her influence and social connections, providing false certification materials, committing bribery and other improper means, his or her points shall be deducted instead of being added. 2.对三类罪犯与其他罪犯的计分考核应当平等、平衡。在三类罪犯计分考核项目和标准的设计上,不仅应当考虑对其他罪犯教育改造的普遍性要求,而且应当考虑对三类罪犯教育改造的特殊性要求,防止三类罪犯在考核中比其他罪犯容易得分。进一步限制、规范三类罪犯的加分项目,严格控制加分总量。对利用个人影响力和社会关系、提供虚假证明材料、贿赂等不正当手段企图获得加分的,不但不能加分,还要扣分。司法部应当根据上述要求,抓紧修改罪犯的计分考核办法。
According to the aforesaid requirements, the Ministry of Justice shall timely amend the measures for scoring assessment of convicts. 
 3.对依法可以减刑的三类罪犯,必须从严把握减刑的起始时间、间隔时间和幅度。被判处十年以下有期徒刑的,执行二年以上方可减刑,一次减刑不超过一年有期徒刑,两次减刑之间应当间隔一年以上。被判处十年以上有期徒刑的,执行二年以上方可减刑,一次减刑不超过一年有期徒刑,两次减刑之间应当间隔一年六个月以上。被判处无期徒刑的,执行三年以上方可减刑,可以减为二十年以上二十二年以下有期徒刑;减为有期徒刑后,一次减刑不超过一年有期徒刑,两次减刑之间应当间隔二年以上。死刑缓期执行罪犯减为无期徒刑后,执行三年以上方可减刑,可以减为二十五年有期徒刑;减为有期徒刑后,一次减刑不超过一年有期徒刑,两次减刑之间应当间隔二年以上。
