| Chapter I General Provisions | | 第一章 总则 |
| Article 1 To strengthen the construction and administration of nature reserves for aquatic plants and animals, these Measures are formulated in accordance with the provisions of the Law of the People's Republic of China on the Protection of Wildlife, the Fisheries Law of the People's Republic of China and the Regulation of the People's Republic of China on Natural Reserves. | | 第一条 为加强对水生动植物自然保护区的建设和管理，根据《中华人民共和国野生动物保护法》、《中华人民共和国渔业法》和《中华人民共和国自然保护区条例》的规定，制定本办法。 |
| Article 2 For the purpose of these Measures, “nature reserves for aquatic plants and animals” means the lands and waters of certain areas set aside in accordance with the law for the purpose of protecting aquatic plant and animal species, especially the rare and endangered species and important economic species of scientific, economic and cultural values and their natural habitats and breeding habitats. | | 第二条 本办法所称水生动植物自然保护区，是指为保护水生动植物物种，特别是具有科学、经济和文化价值的珍稀濒危物种、重要经济物种及其自然栖息繁衍生境而依法划出一定面积的土地和水域，予以特殊保护和管理的区域。 |
| Article 3 Whoever constructs and administers nature reserves for aquatic plants and animals within the territory of the People's Republic of China or other sea areas under the jurisdiction of the People's Republic of China shall comply with these Measures. | | 第三条 凡在中华人民共和国领域和中华人民共和国管辖的其他海域内建设和管理水生动植物自然保护区，必须遵守本办法。 |
| Article 4 All entities and individuals shall have the obligation to protect nature reserves for aquatic plants and animals, and shall prevent, report and accuse the destruction and encroachment of nature reserves. | | 第四条 任何单位和个人都有保护水生动植物自然保护区的义务，对破坏、侵占自然保护区的行为应该制止、检举和控告。 |
| Article 5 The fishery administrative department of the State Council shall take charge of the administration of national nature reserves for aquatic plants and animals; and the fishery administrative department of a local people's government at or above the county level shall take charge of the administration of nature reserves for aquatic plants and animals within its own administrative region. | | 第五条 国务院渔业行政主管部门主管全国水生动植物自然保护区的管理工作；县级以上地方人民政府渔业行政主管部门主管本行政区域内水生动植物自然保护区的管理工作。 |

| Chapter II Construction of Nature Reserves for Aquatic Plants and Animals | | 第二章 水生动植物自然保护区的建设 |
| Article 6 A nature reserve for aquatic plants and animals shall be established if an area meets any of the following conditions: | | 第六条 凡具有下列条件之一的，应当建立水生动植物自然保护区： |
| (1) Being a concentrated distribution area, a main habitat or a breeding ground of aquatic plants and animals under the state's and local particular protection. | | （1）国家和地方重点保护水生动植物的集中分布区、主要栖息地和繁殖地； |
| (2) Being an area with the typical ecosystem of aquatic plants and animals across different natural zones. | | （2）代表不同自然地带的典型水生动植物生态系统的区域； |
| (3) Being a main place of origin of particularly important aquatic economic plants and animals of the state. | | （3）国家特别重要的水生经济动植物的主要产地； |
| (4) Being an important concentrated distribution area with diversified aquatic plant and animal species. | | （4）重要的水生动植物物种多样性的集中分布区； |
| (5) Being a natural habitat for aquatic species, which has suffered no or little damage caused by human beings, and has its natural state maintained in good condition. | | （5）尚未或极少受到人为破坏，自然状态保持良好的水生物种的自然生境； |
| (6) Being an aquatic organism ecological environment of special conservation value. | | （6）具有特殊保护价值的水生生物生态环境。 |
| Article 7 Nature reserves for aquatic plants and animals shall include national nature reserves for aquatic plants and animals and local nature reserves for aquatic plants and animals. | | 第七条 水生动植物自然保护区分为国家级和地方级。 |
| The nature reserves for aquatic plants and animals of significant scientific, economic and cultural values and of typical significance or with major influence at home and abroad shall be ranked as national nature reserves. Other nature reserves for aquatic plants and animals of typical significance or important scientific, economic and cultural values shall be ranked as local nature reserves. | | 具有重要科学、经济和文化价值，在国内、国际有典型意义或重大影响的水生动植物自然保护区，列为国家级自然保护区。其他具有典型意义或者重要科学、经济和文化价值的水生动植物自然保护区，列为地方级自然保护区。 |
| Article 8 The establishment of a national nature reserve for aquatic plants and animals shall obtain the approval of the provincial people's government in the place where such national nature reserve is located, and be reported by the fishery administrative department of the provincial people's government to the fishery administrative department of the State Council, and shall, after being reviewed by the review committee, be reported by the fishery administrative department of the State Council to the State Council for approval. | | 第八条 国家级水生动植物自然保护区的建立，需经自然保护区所在地的省级人民政府同意，由省级人民政府渔业行政主管部门报国务院渔业行政主管部门，经评审委员会评审后，由国务院渔业行政主管部门按规定报国务院批准。 |
| The establishment of a local nature reserve for aquatic plants and animals shall be reported as prescribed by the fishery administrative department at or above the county level to a provincial people's government, and be reported to the fishery administrative departmentof the State Council for recordation. | | 地方级水生动植物自然保护区的建立，由县级以上渔业行政主管部门按规定报省级人民政府批准，并报国务院渔业行政主管部门备案。 |
| An application for the establishment of a nature reserve for aquatic plants and animals across two or more administrative regions shall be filed by the people's government of the relevant administrative region after consultation, and be approved under the aforesaid procedures. | | 跨两个以上行政区域水生动植物自然保护区的建立，由有关行政区域的人民政府协商后提出申请，按上述程序审批。 |
| Article 9 The cancellation of a nature reserve for aquatic plants and animals and the adjustments and changes of the nature and scope thereof shall be approved by the original approval authority. | | 第九条 水生动植物自然保护区的撤销及其性质、范围的调整和变化，应经原审批机关批准。 |
| Article 10 The review committee on nature reserves for aquatic plants and animals under the fishery administrative department of the State Council shall be responsible for the demonstration and review of the applications for the establishment of national nature reserves for aquatic plants and animals. | | 第十条 国务院渔业行政主管部门水生动植物自然保护区评审委员会，负责国家级水生动植物自然保护区申报论证和评审工作。 |
The review committee on nature reserves for aquatic plants and animals under the fishery administrative department of a provincial people's government shall be responsible for the demonstration and review of the applications for the establishment of local nature reserves for aquatic plants and animals.
