| For the purposes of comprehensively implementing the Decision of the CPC Central Committee to Deepen the Institutional Reform of the Party and State deliberated and adopted at the Third Plenary Session of the 19th CPC Central Committee and the State Council Institutional Reform Proposal approved at the First Session of the Thirteenth National People's Congress, and ensuring administrative organs' legal performance of their functions, the State Council has reviewed the administrative regulations involved in institutional reform. Upon review, the State Council hereby decides to amend certain clauses of ten administrative regulations. | | 为全面落实党的十九届三中全会审议通过的《中共中央关于深化党和国家机构改革的决定》和十三届全国人大一次会议批准的《国务院机构改革方案》，确保行政机关依法履行职责，国务院对机构改革涉及的行政法规进行了清理。经过清理，国务院决定：对10部行政法规的部分条款予以修改。 |
| I. Article 3 of the Measures for the Administration of the Reception of Television Programs Transmitted via Foreign Satellites by Ground Satellite Receiving Facilities is amended to read: “The radio and television administrative department of the State Council shall be responsible for the administration of the reception of television programs transmitted via foreign satellites by ground satellite receiving facilities nationwide. | | 一、将《卫星地面接收设施接收外国卫星传送电视节目管理办法》第三条修改为：“国务院广播电视行政管理部门负责全国卫星地面接收设施接收外国卫星传送的电视节目的管理工作。 |
| “The radio and television administrative departments of the people's governments of all provinces, autonomous regions, and municipalities directly under the Central Government shall be responsible for the administration of the reception of television programs transmitted via foreign satellites by ground satellite receiving facilities within their respective administrative regions.” | | “省、自治区、直辖市人民政府广播电视行政管理部门负责本行政区内卫星地面接收设施接收外国卫星传送的电视节目的管理工作。” |

| Article 6 is amended to read: “An entity that is to utilize the existing ground satellite receiving facilities or install special ground satellite receiving facilities to receive television programs transmitted via foreign satellites shall apply in writing to the competent department at or above the provincial level. If consent is granted thereto upon examination, the application entity shall submit the application to the radio and television administrative department of the people's government of the province, autonomous region, or municipality directly under the Central Government where it is located for approval. Where the radio and television administrative department of the people's government of the province, autonomous region, or municipality directly under the Central Government approves the application, a Permit to Receive Television Programs Transmitted via Foreign Satellites by Ground Satellite Receiving Facilities (hereinafter referred to as a “Permit”) shall be issued, and the approval authority shall report the case to the radio and television administrative department of the State Council, the public security department, and the state security department for recordation.” | | 第六条修改为：“利用已有的或者设置专门的卫星地面接收设施接收外国卫星传送的电视节目的单位，应当向省级以上主管部门提出书面申请，经审查同意的，由申请单位报所在省、自治区、直辖市人民政府广播电视行政管理部门审批。省、自治区、直辖市人民政府广播电视行政管理部门批准的，发给《卫星地面接收设施接收外国卫星传送的电视节目许可证》（以下简称《许可证》），并由审批机关报国务院广播电视行政管理部门、公安部门、国家安全部门备案。” |

| Article 11 is amended to read: “Where an entity violates the provisions of Articles 8 and 9 of these Measures, the radio and television administrative department of the people's government of the province, autonomous region, or municipality directly under the Central Government shall, in conjunction with the public security organ and the state security organ, give it a warning, impose a fine of not more than 20,000 yuan on it, or even revoke its Permit in light of the seriousness of the circumstances. Where the Permit is revoked, the ground satellite receiving facilities it uses may also be confiscated. As for the directly responsible person in charge and other directly liable persons of the entity, the radio and television administrative department, the public security organ and the state security organ of the people's government of the province, autonomous region, or municipality directly under the Central Government may suggest the competent department give them disciplinary sanctions; and if circumstances are serious enough to constitute a crime, the violators shall be held criminally liable by the judicial organ according to the law.” | | 第十一条修改为：“违反本办法第八条、第九条规定的单位，由省、自治区、直辖市人民政府广播电视行政管理部门会同公安机关、国家安全机关视情节轻重，给予警告、二万元以下的罚款、直至吊销《许可证》的处罚。吊销《许可证》的，可以同时没收其使用的卫星地面接收设施。对单位的直接负责的主管人员和其他直接责任人员，省、自治区、直辖市人民政府广播电视行政管理部门、公安机关、国家安全机关可以建议其主管部门给予行政处分；情节严重构成犯罪的，由司法机关依法追究刑事责任。” |
| In Article 12, “the radio and television department (bureau) of the province, autonomous region, or municipality directly under the Central Government shall, in conjunction with the public security department (bureau) and the state security department (bureau)” is replaced with “the radio and television administrative department of the people's government of the province, autonomous region, or municipality directly under the Central Government shall, in conjunction with the public security organ and the state security organ”. | | 第十二条中的“省、自治区、直辖市广播电视厅（局）会同公安、国家安全厅（局）”修改为“省、自治区、直辖市人民政府广播电视行政管理部门会同公安机关、国家安全机关”。 |
| Paragraph 1 of Article 14 is amended to read: “Where, as needed for national defense, public security or state security, the armed forces, the public security organ or the state security organ receives television programs transmitted via foreign satellites by utilizing the existing ground satellite receiving facilities or specially-installed ground satellite receiving facilities, the relevant department of the armed forces, the public security department of the State Council, and the state security department of the State Council shall separately develop measures for the administration thereof.” | | 第十四条第一款修改为：“军队以及公安机关、国家安全机关因国防、公安和国家安全工作需要利用已有的或者专门设置的卫星地面接收设施接收外国卫星传送的电视节目，由军队有关部门、国务院公安部门、国务院国家安全部门分别制定措施进行管理。” |

Article 4 of the Regulation on the Protection of Varieties of Traditional Chinese Medicines is amended to read: “The drug supervision and administration department of the State Council shall be responsible for the supervision and administration of the protection of varieties of traditional Chinese medicines (“TCM”) nationwide.” | | 三、将《中药品种保护条例》第四条修改为：“国务院药品监督管理部门负责全国中药品种保护的监督管理工作。” |

| “ (1) A TCM manufacturer may apply for the protection of any TCM variety that meets the provisions of Articles 5, 6, 7 and 8 of this Regulation to the drug supervision and administration department of the people's government of the province, autonomous region, or municipality directly under the Central Government where it is located, and the latter shall, after conducting preliminary examination and provide its opinions, submit the application to the drug supervision and administration department of the State Council. Under any special circumstance, a TCM manufacturer may also directly file an application with the drug supervision and administration department of the State Council. | | “（一）中药生产企业对其生产的符合本条例第五条、第六条、第七条、第八条规定的中药品种，可以向所在地省、自治区、直辖市人民政府药品监督管理部门提出申请，由省、自治区、直辖市人民政府药品监督管理部门初审签署意见后，报国务院药品监督管理部门。特殊情况下，中药生产企业也可以直接向国务院药品监督管理部门提出申请。 |
“(2) The drug supervision and administration department of the State Council shall authorize the National Committee on the Assessment of the Protected Traditional Chinese Medicinal Products to be responsible for the assessment of the TCM variety of which the applicant applies for the protection. The National Committee on the Assessment of the Protected Traditional Chinese Medicinal Products shall make an assessment conclusion within six months of receipt of an application report.
