To strengthen and regulate the supervision of filing of criminal cases, and guarantee the accurate exercise of the criminal investigation power, these Provisions are formulated in accordance with the Criminal Procedure Law of the People's Republic of China and the relevant provisions and in light of the actualities of work. | |
为加强和规范刑事立案监督工作，保障刑事侦查权的正确行使，根据《中华人民共和国刑事诉讼法》等有关规定，结合工作实际，制定本规定。 |

| Article 1 The task of supervision of filing of criminal cases is to ensure the filing of cases according to law, prevent and correct failure to file cases and illegal case filing, timely crack down on crimes according to law, protect the legitimate rights and interests of citizens, guarantee the uniform and correct implementation of the law of the state, and maintain social harmony and stability. | | 第一条 刑事立案监督的任务是确保依法立案，防止和纠正有案不立和违法立案，依法、及时打击犯罪，保护公民的合法权利，保障国家法律的统一正确实施，维护社会和谐稳定。 |

| Article 2 The supervision of filing of criminal cases shall adhere to the unity of supervision and coordination, the unity of legal supervision of the people's procuratorates and internal supervision of the public security organs, the unity of the case-handling amount, quality, efficiency and effects, and the principle of correcting any fault. | | 第二条 刑事立案监督应当坚持监督与配合相统一，人民检察院法律监督与公安机关内部监督相结合，办案数量、质量、效率、效果相统一和有错必纠的原则。 |

| Article 3 A public security organ shall timely examine the accepted case or the found clue to a crime, and make a decision on filing the case or not filing the case according to law and the relevant provisions. | | 第三条 公安机关对于接受的案件或者发现的犯罪线索，应当及时进行审查，依照法律和有关规定作出立案或者不予立案的决定。 |
The public security organs and people's procuratorates shall establish the criminal case information release system, periodically exchanging information on the occurrence, reporting, filing and solving of criminal cases, supervision of filing of criminal cases, supervision of investigation activities, approval of arrest, prosecution, etc., and releasing information on major cases at any time. The criminal case information sharing platform shall be established in the places where conditions permit. | |
公安机关与人民检察院应当建立刑事案件信息通报制度，定期相互通报刑事发案、报案、立案、破案和刑事立案监督、侦查活动监督、批捕、起诉等情况，重大案件随时通报。有条件的地方，应当建立刑事案件信息共享平台。 |

| Article 4 Where a victim, his legal agent or close relative or the administrative law enforcement organ deems that the accusation filed by him or a case transferred by it should have been filed by the public security organ for investigation, and has brought the matter to a people's procuratorate, the people's procuratorate shall accept and examine the matter. | | 第四条 被害人及其法定代理人、近亲属或者行政执法机关，认为公安机关对其控告或者移送的案件应当立案侦查而不立案侦查，向人民检察院提出的，人民检察院应当受理并进行审查。 |
