| Work Plan on Several Measures for Supporting the Free Trade Zone in Deepening Reform and Innovation | | 支持自由贸易试验区深化改革创新若干措施工作方案 |
The Work Plan is developed to fulfill the requirements of the Notice by the State Council of Several Measures for Supporting the Deepening of Reform and Innovation in Pilot Free Trade Zones | | 为落实《国务院关于支持自由贸易试验区深化改革创新若干措施的通知》（国发〔2018〕38号）以及《广东省人民政府关于印发支持自由贸易试验区深化改革创新若干措施分工方案的通知》（粤府函〔2019〕36号）要求，推动有关深化改革创新措施在前海蛇口自贸片区落地实施、取得实效，制定本工作方案。 |
| I. Creating a favorable investment environment | | 一、营造优良投资环境 |
| 1. Relaxing the requirements for the proportion of foreign technicians in a foreign-invested construction and engineering design enterprise, and relaxing the restrictions on a talent agency by drawing on the experiences of the comprehensive pilot program of expanding the opening-up of the service industry in Beijing; (The Municipal Department of Human Resources and Social Security, the Municipal Bureau of Housing and Urban-rural Construction, the Municipal Commerce Bureau, and the Management Committee of Shenzhen Qianhai Shekou Area of China (Guangdong) Pilot Free Trade Zone shall be responsible) | | （一）借鉴北京市服务业扩大开放综合试点经验，放宽外商投资建设工程设计企业外籍技术人员的比例要求、放宽人才中介机构限制。（市人力资源保障局、住房建设局、商务局、前海蛇口自贸片区管委会负责） |
| 2. Taking into consideration the actual conditions of the pilot free trade zone (“FTZ”) when preparing and issuing the national land use plan, and reasonably arranging the land use plans for the relevant provinces (municipalities directly under the Central Government); and encouraging the local authorities to give priority to the construction of the pilot FTZ, so as to promote the sound and orderly development; (The Municipal Bureau of Planning and Natural Resources shall be responsible) | | （二）编制下达全国土地利用计划时，考虑自贸试验区的实际情况，合理安排有关省（市）的用地计划；有关地方应优先支持自贸试验区建设，促进其健康有序发展。（市规划和自然资源局负责） |
| 3. Delegating the approval authority for the licenses of construction projects such as construction permits for construction projects and production safety licenses for construction engineering enterprises to the pilot FTZ; (The Municipal Bureau of Housing and Urban-rural Construction and the Management Committee of Shenzhen Qianhai Shekou Area of China (Guangdong) Pilot Free Trade Zone shall be responsible) | | （三）将建筑工程施工许可、建筑施工企业安全生产许可等工程审批类权限下放至自贸试验区。（市住房建设局、前海蛇口自贸片区管委会负责） |
| 4. Authorizing the pilot FTZ to carry out pilot work, and changing the licensing system implemented by the competent authorities at or below the provincial level to the notification and commitment system in terms of construction enterprises' application for and upgrading of qualification, and adding of new items to such qualification; (The Municipal Bureau of Housing and Urban-rural Construction shall be responsible) | | （四）授权自贸试验区开展试点工作，将省级及以下机关实施的建筑企业资质申请、升级、增项许可改为实行告知承诺制。（市住房建设局） |
| 5. Delegating the approval authority at or below the provincial level for the license application of foreign investors for the qualification of establishing construction enterprises (including the enterprises in all aspects of engineering construction, such as design, construction, supervision, inspection, and cost consulting) to the pilot FTZ; (The Municipal Bureau of Housing and Urban-rural Construction and the Management Committee of Shenzhen Qianhai Shekou Area of China (Guangdong) Pilot Free Trade Zone shall be responsible) | | （五）将外商投资设立建筑业（包括设计、施工、监理、检测、造价咨询等所有工程建设相关主体）资质许可的省级及以下审批权限下放至自贸试验区。（市住房建设局、前海蛇口自贸片区管委会负责） |
| 6. Imposing no restriction on the proportion of Chinese investment to foreign investment in Sino-foreign joint construction projects of this province (city) undertaken by wholly foreign-owned construction enterprises in the pilot FTZ; (The Municipal Bureau of Housing and Urban-rural Construction shall be responsible) | | （六）自贸试验区内的外商独资建筑业企业承揽本省（市）的中外联合建设项目时，不受建设项目的中外方投资比例限制。（市住房建设局负责） |
| 7. Imposing no further restriction on Hong Kong, Macao and Taiwan-invested construction enterprises in the pilot FTZ concerning the scope of contractor's work as prescribed in the Provisions on the Administration of Foreign-invested Construction Enterprises in accordance with the Mainland-Hong Kong Closer Economic Partnership Arrangement, the Mainland and Macao Closer Economic Partnership Arrangement, and the Cross-Straits Economic Cooperation Framework Agreement; (The Municipal Bureau of Housing and Urban-rural Construction shall be responsible) | | （七）在《内地与香港关于建立更紧密经贸关系的安排》《内地与澳门关于建立更紧密经贸关系的安排》《海峡两岸经济合作框架协议》下，对自贸试验区内的港澳台资建筑业企业，不再执行《外商投资建筑业企业管理规定》中关于工程承包范围的限制性规定。（市住房建设局负责） |
| 8. Cancelling the requirements for engineering design performance of foreign investors when they apply for the first time for the qualification of investment in engineering design enterprises (except for engineering survey) in the pilot FTZ that serve this province (city); (The Municipal Bureau of Housing and Urban-rural Construction and the Management Committee of Shenzhen Qianhai Shekou Area of China (Guangdong) Pilot Free Trade Zone shall be responsible) | | （八）对于自贸试验区内为本省（市）服务的外商投资工程设计（工程勘察除外）企业，取消首次申请资质时对投资者的工程设计业绩要求。（市住房建设局、前海蛇口自贸片区管委会负责） |
9. The competent health administrative departments shall implement the notification and commitment system for the allocation of Class-B large medical equipment to privately-invested medical institutions in the pilot FTZ; (The Municipal Health Commission shall be responsible)
