最高人民法院关于开展涉民生案件专项集中执行活动的通知

各省、自治区、直辖市高级人民法院，解放军军事法院，新疆维吾尔自治区高级人民法院生产建设兵团分院：
为切实践行党的群众路线，最高人民法院定于2013年12月下旬至2014年6月，组织开展涉民生案件专项集中执行活动，加大对涉及人民群众生存生活案件的执行力度，有效维护人民群众合法权益。现将有关事项通知如下：
　　一、总体目标
以党的十八大和习近平总书记一系列重要讲话精神为指导，牢牢把握人民法院司法为民公正司法工作主线，以人民群众的司法需求为导向，着力解决执行工作中群众反映强烈的、与百姓利益息息相关的涉民生案件执行难的突出问题，健全完善保障司法为民的长效机制，努力实现让人民群众在每一个司法案件中都感受到公平正义的目标。
　　二、重点范围
本次集中执行活动，以涉及人民群众生存生活的迫索劳动报酬(包括农民工工资)、赡养费、扶养费、抚养费、抚恤金、医疗损害赔偿、交通事故人身损害赔偿、工伤赔偿以及最高人民法院挂牌督办的相关案件为重点，采取更加有效的执行措施，集中打击拒不执行人民法院生效裁判行为，提高案件执行效率。对刑事附带民事赔偿执行案件，各地应结合本次专项执行活动，摸清案件底数，分析案件特点，研究执行办法，为2014年下半年开展相关专项执行活动奠定基础。
　　三、主要方法
要依法综合运用教育、威慑、惩罚等多种手段，完善便利、快捷的工作机制，使涉民生案件得到有效执行。
(一)积极主动采取执行措施。人民法院在民事判决、裁定发生法律效力后，可以直接移送执行；可以依法依职权主动采取措施，及时调查、控制被执行人的财产，防止被执行人转移财产；在分配可供执行的财产时，可以优先考虑将财产分配给追索劳动报酬(包括农民工工资)、赡养费、扶养费、抚养费的申请执行人。对于需要先予执行的案件，可依法积极采取先予执行措施。
