Guiding Opinions of the State Administration for Industry and Commerce on the Effective Administration of Advertisement Release Registration 

工商总局关于做好广告发布登记管理工作的指导意见

The administrative departments for industry and commerce and departments of market supervision and administration of all provinces, autonomous regions, municipalities directly under the Central Government, cities under separate state-planning, and cities at the sub-provincial level: 各省、自治区、直辖市及计划单列市、副省级市工商行政管理局、市场监督管理部门:
The Provisions on the Administration of Advertisement Release Registration (Order No. 89, SAIC) as issued on December 1, 2016 shall come into force on November 1, 2016. For the purpose of regulating advertisement release registration, the following guiding opinions on the work relating to the administration of advertisement release registration are hereby offered. 广告发布登记管理规定》(工商总局第89号令)已经于2016年11月1日公布,并于2016年12月1日起施行。为规范广告发布登记工作,现就广告发布登记管理有关工作提出如下指导意见。
I. Strictly registering advertisement release in strict accordance with statutory procedures   一、严格按照法定程序办理广告发布登记
Advertisement release registration is an administrative licensing item in relation to the qualification for advertisement release as specified by the Advertising Law of the People's Republic of China, and all regions shall, in strict accordance with all the requirements of the Administrative License Law of the People's Republic of China, the Advertising Law of the People's Republic of China, and the Provisions on the Administration of Advertisement Release Registration, according to the general requirements of the reform of simplification of administrative procedures, delegation of powers, combination of delegation and control, and optimization of services, effectively conduct all the work on the advertisement release registration according to the law. 广告发布登记是《中华人民共和国广告法》明确规定的一项关于广告发布资质的行政许可事项,各地要严格按照《中华人民共和国行政许可法》《中华人民共和国广告法》,以及《广告发布登记管理规定》的各项规定,按照简政放权、放管结合、优化服务改革的总体要求,依法做好广告发布登记的各项工作。
1. Specifying the registration authorities for advertisement release registration. (一)明确广告发布登记的登记机关。
Local industry and commerce and market regulatory authorities at and above the county level shall register advertisement release according to the law for radio stations, television stations, and newspapers and publication entities which engage in advertisement release business within their jurisdictions. The advertisement release registration authorities of the county, municipal, and provincial media outlets shall be determined by each province (autonomous region or municipality directly under the Central Government) based on the local actual circumstances. 县级以上地方工商和市场监管部门,对辖区内从事广告发布业务的广播电台、电视台、报刊出版单位,依法办理广告发布登记。省、市、县级媒体的广告发布登记机关,由各省(自治区、直辖市)根据各地实际确定。
2. Registering advertisement release according to the law. (二)依法办理广告发布登记。
For an applicant that meets the conditions for advertisement release registration, each registration authority shall, as required by the Provisions on the Administration of Advertisement Release Registration, within five working days from the date of accepting the application, make a decision to grant registration and disclose the information on the advertisement release registration to the public. 对符合广告发布登记条件的申请人,各登记机关应当按照《广告发布登记管理规定》的要求,自受理申请之日起五个工作日内,作出准予登记的决定,并将广告发布登记信息向社会公布。
All registration authorities shall publish the information on the advertisement release registration of corporate enterprises in the National Enterprise Credit Information Publication System in accordance with the law. 各登记机关对企业法人的广告发布登记信息,应当在国家企业信用信息公示系统中,依法向社会公示。
The information on the advertisement release registration of other applicants may be disclosed to the public through the authorities' websites or government public service platforms (government websites or professional websites), or failing that, through the newspapers or other mass media within their respective jurisdictions. 对其他申请人的广告发布登记信息,可以通过本部门门户网站或者政府公共服务平台(政府门户网站或者专业网站)向社会公布;本部门门户网站或者政府公共服务平台无法公布的,可以通过辖区内报纸等大众传播媒介向社会公布。
For an applicant that does not meet the conditions for advertisement release registration, each registration authority shall, within five working days from the date of accepting the application, make a decision to reject the application and explain the reasons in writing. 对不符合广告发布登记条件的,也应当自受理申请之日起五个工作日内,作出不予登记的决定,并书面说明理由。
3. Handling the modification and cancellation ofadvertisement release registration according to the law. (三)依法办理广告发布登记变更、注销。
The validity period of advertisement release registration shall be the same as that of the relevant media approval document granted to the advertisement release entity, and no overdue registration is allowed. If the name, legal representative, actual business address, or advertisement release media of a registered advertisement release entity undergoes any change, modification registration shall be made; and if advertisement release registration requires renewal at the expiration of its validity period, the modification registration procedure shall apply mutatis mutandis. The modification of registration or cancellation of advertisement release registration in relation to items subject to registration shall be governed by the relevant requirements in the Administrative License Law of the People's Republic of China and the Provisions on the Administration of Advertisement Release Registration. 广告发布登记的有效期限,应当与广告发布单位所取得相关媒体批准文件的有效期限一致,不得超期登记。广告发布登记的单位名称、法定代表人、实际经营地址和从事广告发布的媒介发生变化时,应当办理变更登记;广告发布登记有效期限届满需要延期的,参照变更登记程序办理。涉及登记事项变更登记或者广告发布登记注销的,应当按照《中华人民共和国行政许可法》和《广告发布登记管理规定》的有关规定予以办理。
II. Effectively conducting the subsequent work relating to the advertising business licenses   二、做好《广告经营许可证》相关后续工作
As required by the Provisions on the Administration of Advertisement Release Registration, radio stations, television stations, and newspapers and publication entities which engage in advertisement release business shall all make advertisement release registration. All regions shall conduct the subsequent work relating to the advertising business licenses in a timely and effectively manner and re-confirm the advertisement release registration with respect to radio stations, television stations, and newspapers and publication entities holding advertisement release business licenses. Any radio station, television station, or newspapers or publication entity without an advertisement release business license shall make advertisement release registration in accordance with the law. 按照《广告发布登记管理规定》的要求,从事广告发布业务的广播电台、电视台、报刊出版单位,都要办理广告发布登记。各地要及时做好《广告经营许可证》相关后续工作,对持有《广告经营许可证》的广播电台、电视台、报刊出版单位,重新核准广告发布登记。对没有办理《广告经营许可证》的广播电台、电视台、报刊出版单位,依法办理广告发布登记。
All regions shall complete the advertisement release registration with respect to all the radio stations, television stations, and newspapers and publication entities within their respective jurisdictions prior to March 31, 2017 and report the relevant work and the statistics for local advertisement release entities to the Advertisements Department of the SAIC prior to April 20, 2017.

 各地应当于2017年3月31日前完成对辖区内全部广播电台、电视台、报刊出版单位的广告发布登记办理工作,并将有关工作情况及辖区内广告发布单位的统计结果于2017年4月20日前上报总局广告司。
