All local offices of the China Banking Regulatory Commission (“CBRC”); the education departments of Party committees, the education departments (commissions), the communications administrations, the public security departments (bureaus), administrations for industry and commerce, cybersecurity affairs commissions, and financial service offices (bureaus) of all provinces, autonomous regions, municipalities directly under the Central Government and the Xinjiang Production and Construction Corps; and the Party committees of the colleges and universities directly affiliated to the Ministry of Education: 各银监局,各省、自治区、直辖市、新疆生产建设兵团党委教育工作部门、教育厅(教委)、通信管理局、公安厅(局)、工商局、网信办、金融办(局),教育部直属高校党委:
Recently, lending services provided by some peer-to-peer (P2P) lending platforms for students (hereinafter referred to as “P2P lending in campus”) have rapidly developed in some regions and led to risk events frequently, resulting in industry chaos that have caused widespread concern in society, having caused adverse social impact, and having brought about serious damage to campus safety and the lawful rights and interests of students. According to the Interim Measures for the Administration of Business Activities of Peer-to-Peer Lending Information Intermediary Institutions (hereinafter referred to as “these Measures”), the Work Plan for the Special Campaign against P2P Lending Risks and other relevant requirements, in consideration of the thorough checkout of local P2P lending in campus, you are hereby notified as follows the work of strengthening the rectification of P2P lending in campus: 近期,部分网络借贷平台针对在校学生开展借贷业务(以下简称校园网贷)在一些地区呈现快速发展态势,风险事件频发,由此产生的行业乱象引起社会广泛关注,造成了不良社会影响,对校园安全和学生合法权益带来严重损害。根据《网络借贷信息中介机构业务活动管理暂行办法》(以下简称《办法》)、《P2P网络借贷风险专项整治工作方案》等有关要求,结合各地校园网贷摸底排查情况,现就加强校园网贷整治工作通知如下:
I. Intensifying the rectification of P2P lending in campus   一、加大校园网贷业务整治力度
A P2P lending information intermediary (hereinafter referred to as “P2P lending institution”) shall carry out P2P lending in campus in strict accordance with the provisions of these Measures, and highlight the following “four nots” according to the characteristics of P2P lending in campus: first, it shall not provide P2P lending services for any college student below the age of 18, and it must, when examining the qualifications of a college student borrower above the age of 18, make sure that there is a secondary source of repayment, obtain the written guarantee materials from the secondary payers (parents, guardians or other custodians) who agree with the borrowing and are willing to make repayments on his or her behalf, and verify the real identity of the secondary payers by telephone and other methods; second, it shall not conduct false publicity or promotion by discriminatory deceptive language or other means, and shall not fabricate or distribute false information or incomplete information, or mislead college student borrowers; third, it shall not publicize or promote any project or product on its own or commission or authorize any third party to publicize or promote any project or product at any physical place other than Internet and other electronic channels; and fourth, it shall not grant usury in any disguised form by collecting various commission fees, late fees, service fees, collection fees and other fees, or take illegal collection and other means to force borrowers to make repayment. 网络借贷信息中介机构(以下简称“网贷机构”)开展校园网贷业务要严格按照《办法》规定,并根据校园网贷业务特点,突出以下“四个不得”:一是不得向来满十八周岁的在校大学生提供网贷服务,在审核年满18周岁在校大学生借款人资格时,必须落实借款人第二还款来源,获得第二还款来源方(父母、监护人、或其他管理人等)表示同意其借款行为并愿意代为还款的书面担保材料,并通过电话等方式确认第二还款来源方身份的真实性;二是不得以歧视性欺骗性语言或其他手段进行虚假欺诈宣传、促销,不得捏造、散布虚假信息或不完整信息,误导大学生借款人;三是不得自行或委托、授权第三方在互联网等电子渠道以外的物理场所进行宣传、推介项目或产品,四是不得通过收取各种名目繁多的手续费、滞纳金、服务费以及催收费等费用变相发放高利贷,或采取非法催收等手段胁迫借款人还款。
Concurrently, a P2P lending institution that provides P2P lending in campus shall establish three mechanisms for the examination of borrowers' qualifications, risk monitoring and protection of clients' information: first, it shall develop the rules on the examination of borrowers' qualifications and classification, and ensure that borrowers have the repayment capacity commensurate with the amount of borrowing and make repayment as agreed in contracts; second, it shall establish a risk monitoring mechanism, further strengthen its information disclosure responsibilities, effectively complete the work of risk warning, and ensure that the borrowing process and key elements are open and transparent; and third, it shall develop the rules on the protection of clients' information, implement the Provisions on Protecting the Personal Information of Telecommunications and Internet Users and related series of standards, carry out information system grading recordation and grade testing, strengthen the management of clients' information, and ensure the legality and security of the collection, processing and use of the information on lenders and borrowers.

 同时,网贷机构开展校园网贷业务应建立借款人资格审核、风险监测及客户信息保护三项机制:一是建立借款人资格审核及分级制度,确保借款人自身具有与借款金额相匹配的还款能力并按照合同约定还款;二是建立风险监测机制,进一步强化其信息披露责任,做好风险提示工作,确保借款流程及关键要素公开透明,三是建立客户信息保护制度,落实《电信和互联网用户个人信息保护规定》及相关系列标准,开展信息系统定级备案和等级测试,加强客户信息管理,确保出借人与借款人信息采集、处理及使用的合法性和安全性。
