| Chapter I: General Provisions | | 第一章 总则 |
| Article 1 These Regulations are formulated to ensure that ships, offshore installations and sea-borne cargo containers shall meet the technical requirements for safe navigation and operation, to safeguard the safety of human life and property and to prevent the pollution of marine environment. | | 第一条 为了保证船舶、海上设施和船运货物集装箱具备安全航行、安全作业的技术条件，保障人民生命财产的安全和防止水域环境污染，制定本条例。 |
| Article 2 These Regulations shall apply to: | | 第二条 本条例适用于： |
| (1) ships registered or to be registered in the People's Republic of China (hereinafter referred to as "Chinese flag ships"); | | （一）在中华人民共和国登记或者将在中华人民共和国登记的船舶（以下简称中国籍船舶）； |
| (2) foreign flag ships applying for survey according to these regulations or other relevant provisions issued by the State; | | （二）根据本条例或者国家有关规定申请检验的外国籍船舶； |
| (3) offshore installations located or to be located in coastal waters of the People's Republic of China (hereinafter referred to as "offshore installations"); and | | （三）在中华人民共和国沿海水域内设置或者将在中华人民共和国沿海水域内设置的海上设施（以下简称海上设施）； |
| (4) sea - borne cargo containers owned by an enterprise as legal person registered in the Peoples Republic of China (hereinafter referred to as "containers"). | | （四）在中华人民共和国登记的企业法人所拥有的船运货物集装箱（以下简称集装箱）。 |
| Article 3 The Register of Shipping of the People's Republic of China (hereinafter referred to as "the Register of Shipping") is the competent authority to carry out surveys of various kinds in accordance with these Regulations. | | 第三条 中华人民共和国船舶检验局（以下简称船检局）是依照本条例规定实施各项检验工作的主管机构。 |
| With the approval of the department in-charge of communications under the State Council, the Register of Shipping may establish ship-survey organizations in major ports and industrial areas. | | 经国务院交通主管部门批准，船检局可以在主要港口和工业区设置船舶检验机构。 |
| With the approval of the department in-charge of communications under the State Council and of the people's governments of provinces, autonomous regions or municipalities directly under the Central Government, the departments in-charge of communications under the people's governments of provinces, autonomous regions and municipalities directly under the Central Government may establish local ship-survey organizations in ports in their respective jurisdictions. | | 经国务院交通主管部门和省、自治区、直辖市人民政府批准，省、自治区、直辖市人民政府交通主管部门可以在所辖港口设置地方船舶检验机构。 |
| Article 4 China Classification Society is a public organization which undertakes classification surveys, certification surveys and surveys related to notary matters of domestic and foreign ships, offshore installations and containers. The Society may conduct statutory surveys on behalf of the Register of Shipping subject to the latter's authorization. | | 第四条 中国船级社是社会团体性质的船舶检验机构，承办国内外船舶、海上设施和集装箱的入级检验、鉴证检验和公证检验业务；经船检局授权，可以代行法定检验。 |
| Article 5 In conducting all surveys set forth in these Regulations the principle of safety first and quality first shall be implemented and the development and application of the latest technology shall be encouraged. | | 第五条 实施本条例规定的各项检验，应当贯彻安全第一、质量第一的原则，鼓励新技术的开发和应用。 |
| Chapter II: Survey of Ships | | 第二章 船舶检验 |
| Article 6 Surveys of ships shall be carried out by the following organizations respectively: | | 第六条 船舶检验分别由下列机构实施： |
| (1) ship - survey organizations established by the Register of Shipping; | | （一）船检局设置的船舶检验机构； |
| (2) local ship- survey organizations established by the departments in charge of communications under the People's governments of provinces, autonomous regions and municipalities directly under the Central Government; | | （二）省、自治区、直辖市人民政府交通主管部门设置的地方船舶检验机构； |
| (3) ship-survey organizations entrusted, designated, or approved by the Register of Shipping. | | （三）船检局委托、指定或者认可的检验机构。 |
| The above - mentioned organizations are hereinafter generally referred to as ship - survey organizations. | | 前款所列机构，以下统称船舶检验机构。 |
| Article 7 Owners or operators of Chinese flag ships must apply to a ship - survey organization for: | | 第七条 中国籍船舶的所有人或者经营人，必须向船舶检验机构申请下列检验： |
| (1) construction survey for their ships that are under construction or conversion; | | （一）建造或者改建船舶时，申请建造检验； |
| (2) periodical survey for their ships that are in service; | | （二）营运中的船舶，申请定期检验； |
| (3) initial survey for their foreign flag ships being transferred into Chinese nationality. | | （三）由外国籍船舶改为中国籍船舶的，申请初次检验。 |
| Article 8 Important equipment, parts and materials used by Chinese flag ships for safety of navigation at sea and for the prevention of pollution of marine environment shall be subject to surveys by the ship - survey organizations in accordance with the relevant provisions. | | 第八条 中国籍船舶所使用的有关海上交通安全的和防止水域环境污染的重要设备、部件和材料，须经船舶检验机构按照有关规定检验。 |
| Article 9 Chinese flag ships shall be subject to tonnage measurement including gross tonnage and net tonnage measurements, as well as verification and approval of loadlines and passenger quotas by the ship - survey organizations. | | 第九条 中国籍船舶须由船舶检验机构测定总吨位和净吨位，核定载重线和乘客定额。 |
| Article 10 Owners or operators of foreign mobile drilling units and mobile offshore platforms engaged in offshore drilling and exploration activities in the coastal waters of China must apply to the ship - survey organizations established or designated by the Register of Shipping for: | | 第十条 在中国沿海水域从事钻探、开发作业的外国籍钻井船、移动式平台的所有人或者经营人，必须向船检局设置或者指定的船舶检验机构申请下列检验： |
| (1) survey prior to operation; | | （一）作业前检验； |
| (2) periodical survey during operation. | | （二）作业期间的定期检验。 |
Article 11 Owners or operators of mobile offshore platforms, floating docks and other giant floating units taken in tow in the coastal waters of China must apply to the ship - survey organizations established or designated by the Register of Shipping for towage survey prior to operation.
