| Announcement on Issues concerning the Implementation of the Measures of the Customs of the People's Republic of China for the Administration of Enterprise Credit and the Relevant Supporting Rules | | 关于《中华人民共和国海关企业信用管理办法》及相关配套制度实施有关事项的公告 |
| The Measures of the Customs of the People's Republic of China for the Administration of Enterprise Credit (Order No. 237 of the GAC, hereinafter referred to as the “Credit Measures”) have been issued on March 3, 2018 and shall come into force on May 1, 2018. The relevant issues are hereby announced as follows: | | 《中华人民共和国海关企业信用管理办法》（海关总署令第237号，以下简称《信用办法》）已于2018年3月3日对外公布，自2018年5月1日起施行，现将有关事项公告如下： |
| I. As of May 1, 2018, the Standards for the Customs' Certification of Enterprises (Announcement No. 82 [2014] of the GAC) shall remain effective as the supporting implementation document of the Credit Measures. The Customs shall implement authentication of enterprises according to the Credit Measures and the Standards for the Customs' Certification of Enterprises. | | 一、自2018年5月1日起，《海关认证企业标准》（海关总署公告2014年第82号）作为《信用办法》配套执行文件继续有效。海关按照《信用办法》和《海关认证企业标准》对企业实施认证。 |
| II. Where unfaithful enterprises recognized according to the Interim Measures of the Customs of the People's Republic of China for the Administration of Enterprise Credit (Order No. 225 of the GAC) before April 30, 2018 are managed as unfaithful enterprises for one year and the circumstances as prescribed in Article 12 of the Credit Measures have not occurred any more, the Customs shall adjust them to general credit enterprises. | | 二、2018年4月30日之前，按照《中华人民共和国海关企业信用管理暂行办法》（海关总署令第225号）规定认定的失信企业，在适用失信企业管理满1年且未再发生《信用办法》第十二条规定情形的，海关将其调整为一般信用企业。 |
| III. An enterprise that violates the regulatory provisions of the Customs due to import of solid wasts prohibited from entering the country and is subject to administrative penalties of the Customs shall not apply for management as enterprises certified by the Customs within one year; for an enterprise that has been managed as an certified enterprise, the Customs shall lower the enterprise's credit rating. | | 三、企业因进口禁止进境的固体废物违反海关监管规定，被海关行政处罚的，1年内不得申请适用海关认证企业管理；已经适用认证企业管理的，海关应当向下调整企业信用等级。 |
| IV. A branch of a customs declaration enterprise having undergone the recordation formalities with the Customs shall have a credit rating of that of the customs declaration enterprise to which it is subordinate, and the customs declaration enterprise shall assume corresponding liability of credit management for its branches. | | 四、 |
| V. Where non-customs declaration enterprises and customs declaration enterprises that have not undergone the registration or recordation formalities in the current year are not engaged in import or export business in the previous year and are subject to administrative penalties totalling over 1 million yuan and 300,000 yuan within one year, respectively, the Customs shall, according to the provisions of paragraph 2, Article 12 of the Credit Measures, determine these enterprises as unfaithful enterprises. | | 五、非当年注册登记或者备案的非报关企业、报关企业，上一年度无进出口业务，1年内因违反海关监管规定被海关行政处罚金额分别累计超过100万元、30万元的，海关比照《信用办法》第十二条第二款规定，将企业认定为失信企业。 |
VI. The Customs finding that a senior certified enterprise is suspected of violating the law or has management risks that may affect the enterprise's credit management may re-certify the senior certified enterprise, mutatis mutandis to, the provisions of paragraph 2, Article 18 of the Credit Measures.
