The people's procuratorates and the public security departments (bureaus) of all provinces, autonomous regions and municipalities directly under the Central Government; and the People's Procuratorate and the Public Security Bureau of Xinjiang Production and Construction Corps: | |

To further improve the mechanism of the people's procuratorates' supervision over the activities of supervision and administration and law enforcement of detention houses, promote the legal and civilized administration of detention houses, and ensure the smooth progress of the criminal litigation activities, we hereby put forward opinions on issues concerning the legal supervision over detention houses by the people's procuratorates as follows: | |
为进一步完善人民检察院对看守所监管执法活动的监督机制，促进看守所依法、文明管理，保障刑事诉讼活动的顺利进行，现就人民检察院对看守所实施法律监督的有关问题提出以下意见： |

| I. Clarifying the Scope of Supervision | | |
The following law enforcement and administrative activities of detention houses shall be subject to the legal supervision by the people's procuratorates: | |
看守所下列执法和管理活动接受人民检察院的法律监督： |

| (1) Law enforcement activities | | （一）执法活动 |
| |

| 1. custody or custody change; | | 1、收押、换押； |

| 2. custody of criminal suspects or defendants; | | 2、羁押犯罪嫌疑人、被告人； |

| 3. arraignment or escort; | | 3、提讯、提解、押解； |

| 4. arrangements for meeting with attorneys; | | 4、安排律师会见； |
| |

| 5. use of police equipment and weapons; | | 5、使用警械和武器； |

| 6. execution of criminal judgments or rulings; | | 6、执行刑事判决、裁定； |

| II. Regulating the Ways of Supervision | | 二、规范监督方式 |
The people's procuratorates shall supervise the law enforcement and administrative activities of detention houses through the following ways: | |
对看守所的执法和管理活动，人民检察院采取下列方式进行监督： |

| (1) The people's procuratorates shall establish dispatched procuratorial offices in detention houses, which shall carry out legal supervision in the name of the people's procuratorates. For small-sized detention houses in which fewer detainees are detained, the people's procuratorates shall conduct itinerant procuratorial supervision. | | （一）人民检察院在看守所设立派驻检察室，派驻检察室以派出人民检察院的名义开展法律监督工作；对关押量较少的小型看守所，由人民检察院进行巡回检察。 |

(2) For the major events occurred in detention houses such as death of a detainee, and the duty-related criminal cases occurred during the law enforcement and administrative activities of detention houses, the people's procuratorates shall timely make investigation or place the cases on file for investigation.
