The Rules for Implementation of the Regulations on Administrative Protection of Agricultural Chemical Products, as formulated by our Ministry in accordance with the Regulations on Administrative Protection of Agricultural Chemical Products approved by the State Council, are hereby issued and shall come into force as of January 1, 1993. | |
根据国务院批准的《农业化学物质产品行政保护条例》，我部制定了《农业化学物质产品行政保护条例实施细则》，现予发布，自1993年1月1日起施行。 |

| CHAPTER I GENERAL PROVISIONS | | 第一章 总则 |

| Article 1 These Rules are formulated in accordance with the provisions of Article 21 of the Regulations on Administrative Protection of Agricultural Chemical Products (hereinafter referred to as the Regulations). | | 第一条 根据《农业化学物质产品行政保护条例》（以下简称条例）第二十一条规定，制定本细则。 |

| Article 2 The competent authorities of chemical industry under the State Council, as mentioned in the Regulations, refers to the Ministry of Chemical Industry of the People's Republic of China (hereinafter referred to as the MCI). | | 第二条 条例所称国务院化学工业行政主管部门是指中华人民共和国化学工业部（以下简称化工部）。 |
The MCI shall establish the examination office for administrative protection, which shall be specifically in charge of the receiving and examination of the applications for administrative protection of agricultural chemical products, the issuance of the certificates, the registration and announcement of relevant matters of administrative protection and the settlement of the infringement disputes. | |
化工部设立行政保护评审办公室，具体负责农业化学物质产品行政保护申请的受理和审查，行政保护证书的颁发，行政保护有关事项的登记、公告和侵权纠纷处理等工作。 |

| Article 3 An owner of the exclusive right of an agricultural chemical product, as mentioned in the Regulations, refers to the person or legal entity that possesses the complete rights of manufacturing and using and selling of the agricultural chemical product applied for administrative protection. | | 第三条 条例所称农业化学物质产品独占权人，是指对申请行政保护的农业化学物质产品的制造、使用和销售享有完全权利的人。 |

| Article 4 "Has not been marketed in China", as mentioned in Article 5 (3) of the Regulations, refers to the agricultural chemical product applied for administrative protection has not been circulated through lawful commercial channels in the pesticides market within China's territory. | | 第四条 条例第五条第（三）项所称尚未在中国销售的，是指申请行政保护的农业化学物质产品尚未通过合法的商业渠道在中国农药市场上流通过。 |

| Article 5 The agency, as mentioned in Article 7 of the Regulations, refers to China Zheng Da Chemical Industry Legal Affairs Center. | | 第五条 条例所称代理机构是指中华正达化工法律事务中心。 |

| Article 6 Any application for administrative protection of agricultural chemical products filed with, and any other relevant proceedings before, shall be prepared in the forms prescribed by the MCI. | | 第六条 向化工部递交行政保护申请书或者办理各种手续，应当使用化工部制定的统一表式。 |
| |
|
| Article 7 Where the documents of the MCI concerning administrative protection need to be sent to an applicant, they shall be transmitted by the agency. | | 第七条 化工部有关行政保护的文件需要送交申请人的，应当通过代理机构转交。 |
| |
|
| Article 8 The first day of any time limit prescribed in the Regulations or these Rules shall not be counted. Where a time limit is counted by year or by month, it shall expire on the corresponding day of the last month; if there is no corresponding day in that month, the time limit shall expire in the last day of that month. If a time limit expires on an official holiday, the time limit shall expire on the first working day after that official holiday. | | 第八条 条例和本细则规定的各种期限的第一日不计算在期限内。期限以年或月计算的，以其最后一月的相应日为期限届满日；该月无相应日的，以该月最后一日为期限届满日。期限届满日是法定假日的，以节假日后的第一个工作日为期限届满日。 |

| CHAPTER II APPLICATION FOR ADMINISTRATIVE PROTECTION | | 第二章 行政保护的申请 |

| Article 9 The original language, as mentioned in Article 8 of the Regulations, refers to the official language of the country to which an applicant belongs. | | 第九条 条例第八条所称的外文，是指申请人所在国的官方语言。 |
| |
|
| Article 10 Where an applicant entrusts the agency to attend to application for administrative protection, both parties shall sign a power of attorney which shall indicate the scope of the power entrusted. | | 第十条 申请人委托代理机构办理申请行政保护事宜时，双方应当签订委托书，写明委托权限。 |
The agency shall submit a power of attorney at the same time of submitting the application documents prescribed in Article 8 of the Regulations and these Rules. | |
代理机构在递交条例第八条和本细则规定的申请文件的同时，应当递交委托书。 |

Article 11 Where an application for administrative protection is filed by any applicant having no habitual residence or business office in China, the MCI may, when considered necessary, require the applicant to submit the following documents:
