| In order to promote the reform of sentencing standardization in an in-depth manner and further extend the scope of sentencing standardization, these Guiding Opinions are developed in accordance with the Criminal Law, the criminal judicial interpretations, and any other relevant provisions and in light of the criminal trial practice. | | 为深入推进量刑规范化改革，进一步扩大量刑规范化范围，根据刑法、刑事司法解释等相关规定，结合刑事审判实践，制定本指导意见。 |
| I. Sentencing for Eight Common Crimes | | 一、 |
| (I) Crime of Dangerous Driving | | （一）危险驾驶罪 |
| 1. Where the offense constitutes a crime of dangerous driving, the starting point for sentencing may be determined within the range of criminal detention of one to two months. | | 1.构成危险驾驶罪的，可以在一个月至二个月拘役幅度内确定量刑起点。 |
| 2. The people's court may, based on the starting point for sentencing, increase penalty and determine the benchmark penalty according to the dangerous driving behavior and other criminal facts affecting the constitution of a crime. | | 2.在量刑起点的基础上，可以根据危险驾驶行为等其他影响犯罪构成的犯罪事实增加刑罚量，确定基准刑。 |
| 3. For a defendant who drives a motor vehicle while intoxicated, the people's court shall accurately convict and punish the defendant by taking into full account of the defendant's degree of intoxication, the type of motor vehicle he or she drives, the road on which he or she drives the motor vehicle, the driving speed, whether any actual damage is caused as well as his or her confession and repentance. Where the circumstances are significantly minor and no serious harm is caused, it is allowed to not convict and punish the defendant; and if the criminal circumstances are minor and it is unnecessary to impose a penalty, the defendant may be exempted from any criminal penalty. | | 3.对于醉酒驾驶机动车的被告人，应当综合考虑被告人的醉酒程度、机动车类型、车辆行驶道路、行车速度、是否造成实际损害以及认罪悔罪等情况，准确定罪量刑。对于情节显著轻微危害不大的，不予定罪处罚；犯罪情节轻微不需要判处刑罚的，可以免予刑事处罚。 |
| (II) Crime of Illegally Absorbing Public Deposits | | （二）非法吸收公众存款罪 |
| 1. Where the offense constitutes a crime of illegally absorbing public deposits, the starting point for sentencing may be determined within the corresponding range under the following circumstances: | | 1.构成非法吸收公众存款罪的，可以根据下列不同情形在相应的幅度内确定量刑起点： |
| (1) Where the criminal circumstances are ordinary, the starting point for sentencing may be determined within the range of fixed-term imprisonment of not more than one year and criminal detention. | | （1）犯罪情节一般的，可以在一年以下有期徒刑、拘役幅度内确定量刑起点。 |
| (2) Where the offense reaches the benchmark of a huge amount or falls under other serious circumstances, the starting point for sentencing may be determined within the range of fixed-term imprisonment of three to four years. | | （2）达到数额巨大起点或者有其他严重情节的，可以在三年至四年有期徒刑幅度内确定量刑起点。 |
| 2. The people's court may, based on the starting point for sentencing, increase penalty and determine the benchmark penalty according to the amount of illegally-absorbed deposits and other criminal facts affecting the constitution of a crime. | | 2.在量刑起点的基础上，可以根据非法吸收存款数额等其他影响犯罪构成的犯罪事实增加刑罚量，确定基准刑。 |
| (III) Crime of Raising Fund by Means of Fraud | | （三）集资诈骗罪 |
| 1. Where the offense constitutes a crime of raising fund by means of fraud, the starting point for sentencing may be determined within the corresponding range under the following circumstances: | | 1.构成集资诈骗罪的，可以根据下列不同情形在相应的幅度内确定量刑起点： |
(1) Where the offense reaches the benchmark of a large amount, the starting point for sentencing may be determined within the range of fixed-term imprisonment of not more than two years and criminal detention.
