| Your Request for Instructions on Handling A Criminal Suspect's Escape or Serious Illness During the Period of Examination for Prosecution (No. 75 [2013], People's Procuratorate, Beijing) has been received. Upon deliberation, the following official reply is hereby made: | | 你院京检字〔2013〕75号《关于审查起诉期间犯罪嫌疑人潜逃或身患严重疾病应如何处理的请示》收悉。经研究，批复如下： |
| I. In handling the examination for prosecution in a case where the criminal suspect is in custody, the people's procuratorate shall conclude the case strictly in accordance with the time limit prescribed by law. Where a case is not concluded in accordance with law, the suspect shall be released or the compulsory measures shall be modified in accordance with Article 96 of the Criminal Procedure Law. | | 一、人民检察院办理犯罪嫌疑人被羁押的审查起诉案件，应当严格依照法律规定的期限办结。未能依法办结的，应当根据刑事诉讼法第九十六条的规定予以释放或者变更强制措施。 |
| II. For a case transferred by a criminal investigation authority for examination for prosecution, if the criminal suspect escapes, the people's procuratorate shall, in accordance with paragraph 3, Article 154 of the Rules for Criminal Procedure of the People's Procuratorate (for Trial Implementation), request the criminal investigation authority to adopt measures to ensure the criminal suspect's arrest before the case is transferred for examination for prosecution. | | 二、人民检察院对于侦查机关移送审查起诉的案件，如果犯罪嫌疑人脱逃的，应当根据《人民检察院刑事诉讼规则 |
III. Where the people's procuratorate discovers escape of a criminal suspect during examination for prosecution, it shall notify the criminal investigation authority in a timely manner, and request the criminal investigation authority to capture the suspect.
