(Adopted at the 12th session of the Standing Committee of the Seventh National People's Congress on February 23, 1990; amended for the first time according to the Decision on Amending Some Laws adopted at the 10th session of the Standing Committee of the Eleventh National People's Congress on August 27, 2009; and amended for the second time according to the Decision on Amending the Law of the People's Republic of China on the Protection of Military Installations adopted at the 9th session of the Standing Committee of the Twelfth National People's Congress on June 27, 2014, and issued by Order No. 10 of the President) (1990年2月23日第七届全国人民代表大会常务委员会第十二次会议通过 根据2009年8月27日第十一届全国人民代表大会常务委员会第十次会议《关于修改部分法律的决定》第一次修正 根据2014年6月27日第十二届全国人民代表大会常务委员会第九次会议主席令第10号《关于修改〈中华人民共和国军事设施保护法〉的决定》第二次修正)

Chapter I General Provisions 

第一章 总 则

Article 1 To protect the security of military installations, ensure the effective utilization of military installations and the normal operation of military activities, enhance the modernization of national defense, strengthen national defense, and resist aggression, this Law is developed in accordance with the Constitution.   第一条 为了保护军事设施的安全,保障军事设施的使用效能和军事活动的正常进行,加强国防现代化建设,巩固国防,抵御侵略,根据宪法,制定本法。
Article 2 For the purposes of this Law, the term “military installations” means the following buildings, sites, and equipment used by the state directly for military purposes:   第二条 本法所称军事设施,是指国家直接用于军事目的的下列建筑、场地和设备:
(1) Command organs and ground and underground command structures and operations structures. (一)指挥机关,地面和地下的指挥工程、作战工程;
(2) Military airfields, harbors, and docks. (二)军用机场、港口、码头;
(3) Barracks, training grounds, and testing grounds. (三)营区、训练场、试验场;
(4) Military cave storehouses and warehouses. (四)军用洞库、仓库;
(5) Military communication, reconnaissance, navigation, and observation stations and posts and survey, navigation, and navigation aid markers. (五)军用通信、侦察、导航、观测台站,测量、导航、助航标志;
(6) Dedicated military highways and railways, military communication and power transmission lines, and military oil and water pipelines. (六)军用公路、铁路专用线,军用通信、输电线路,军用输油、输水管道;
(7) Frontier and coastal defense control facilities. (七)边防、海防管控设施;
(8) Other military installations as prescribed by the State Council and the Central Military Commission. (八)国务院和中央军事委员会规定的其他军事设施。
The term “military installations” in the preceding paragraph shall include the temporary facilities set up necessary for the armed forces to perform missions. 前款规定的军事设施,包括军队为执行任务必需设置的临时设施。
Article 3 The people's governments and military organs at all levels shall, for the national security interests, jointly protect military installations and safeguard the national defense interests.   第三条 各级人民政府和军事机关应当从国家安全利益出发,共同保护军事设施,维护国防利益。
The Headquarters of the General Staff of the Chinese People's Liberation Army shall, under the leadership of the State Council and the Central Military Commission, be in charge of the protection of military installations throughout the country. The headquarters of military area commands shall be in charge of the protection of military installations within their respective jurisdictions. 中国人民解放军总参谋部在国务院和中央军事委员会的领导下,主管全国的军事设施保护工作。军区司令机关主管辖区内的军事设施保护工作。
In places where there are military installations, the relevant military organs and the people's governments at and above the county level shall establish a military and local coordination mechanism for the protection of military installations, and cooperate with each other in supervising and inspecting the protection of military installations. 设有军事设施的地方,有关军事机关和县级以上地方人民政府应当建立军地军事设施保护协调机制,相互配合,监督、检查军事设施的保护工作。
Article 4 All organizations and citizens of the People's Republic of China shall have the obligation to protect military installations.   第四条 中华人民共和国的所有组织和公民都有保护军事设施的义务。
No organization or individual may damage or endanger military installations. 禁止任何组织或者个人破坏、危害军事设施。
Any organization or individual shall have the right to report, or file an accusation of, any act damaging or endangering military installations. 任何组织或者个人对破坏、危害军事设施的行为,都有权检举、控告。
Article 5 The state shall, by overall planning, take into consideration both economic and social development and the protection of military installations to promote the coordination between economic and social development and the protection of military installations.   第五条 国家统筹兼顾经济建设、社会发展和军事设施保护,促进经济社会发展和军事设施保护相协调。
Article 6 The state shall implement a policy of providing protection for military installations by category and priority protection for critical military installations.   第六条 国家对军事设施实行分类保护、确保重点的方针。
Article 7 The state shall grant commendations or awards to organizations and citizens that have made outstanding contributions to the protection of military installations.   第七条 国家对在军事设施保护工作中做出突出贡献的组织和公民,给予表彰、奖励。
Chapter II Demarcation of Military Redistricted Zones and Military Administrative Zones 

第二章 军事禁区、军事管理区的划定

Article 8 The state shall demarcate military restricted zones and military administrative zones in accordance with the nature, function, security and confidentiality requirements, and requirements for effective utilization of military installations.   第八条 国家根据军事设施的性质、作用、安全保密的需要和使用效能的要求,划定军事禁区、军事管理区。
For the purposes of this Law, the term “military restricted zones” means the military areas demarcated under statutory procedures and standards where there are important military installations or there are military installations with significant risk factors, requiring the state to take special measures to provide priority protection. 本法所称军事禁区,是指设有重要军事设施或者军事设施具有重大危险因素,需要国家采取特殊措施加以重点保护,依照法定程序和标准划定的军事区域。
For the purposes of this Law, the term “military administrative zones” means the military areas demarcated under statutory procedures and standards where there are relatively important military installations or there are military installations with relatively significant risk factors, requiring the state to take special measures to provide protection. 本法所称军事管理区,是指设有较重要军事设施或者军事设施具有较大危险因素,需要国家采取特殊措施加以保护,依照法定程序和标准划定的军事区域。
Article 9 Military restricted zones and military administrative zones shall be determined by the State Council and the Central Military Commission or by military area commands in accordance with the provisions of the State Council and the Central Military Commission.   第九条 军事禁区和军事管理区由国务院和中央军事委员会确定,或者由军区根据国务院和中央军事委员会的规定确定。
Signboards shall be set up for military restricted zones and military administrative zones in accordance with the relevant provisions. The local people's governments at and above the county level shall be responsible for setting up the signboards. 军事禁区、军事管理区应当按照规定设置标志牌。标志牌由县级以上地方人民政府负责设置。
Article 10 The land and water military restricted zones and military administrative zones shall be jointly demarcated by military area commands and the people's governments of provinces, autonomous regions, or municipalities directly under the Central Government or by military area commands, the people's governments of provinces, autonomous regions, or municipalities directly under the Central Government, and the relevant departments of the State Council. The airspace military restricted zones and the especially important land and water military restricted zones shall be demarcated by the State Council and the Central Military Commission.   第十条 陆地和水域的军事禁区、军事管理区的范围,由军区和省、自治区、直辖市人民政府共同划定,或者由军区和省、自治区、直辖市人民政府、国务院有关部门共同划定。空中军事禁区和特别重要的陆地、水域军事禁区的范围,由国务院和中央军事委员会划定。
Article 11 Any abolition or modification of a military restricted zone or a military administrative zone shall be conducted under the procedures prescribed in paragraph 1 of Article 9 of this Law.   第十一条 军事禁区、军事管理区的撤销或者变更,依照本法第九条第一款规定的程序办理。
Any adjustment to the scope of a military restricted zone or a military administrative zone shall be conducted under the procedures prescribed in Article 10 of this Law. 军事禁区、军事管理区的范围调整,依照本法第十条规定的程序办理。
Article 12 The demarcation of or adjustment to the scope of military restricted zones or military administrative zones shall, on the premise of ensuring the security and confidentiality and the effective utilization of military installations, take into consideration the economic development, the protection of natural environment, and the production activities and livelihood of the local people.   第十二条 军事禁区、军事管理区范围的划定或者调整,应当在确保军事设施安全保密和使用效能的前提下,兼顾经济建设、自然环境保护和当地群众的生产、生活。
Article 13 Where it is necessary to expropriate or requisition land, woodland, grassland, water surface, or beaches for the demarcation or expansion of the scope of military restricted zones or military administrative zones, it shall be handled in accordance with the provisions of relevant laws and regulations.   第十三条 军事禁区、军事管理区范围的划定或者扩大,需要征收、征用土地、林地、草原、水面、滩涂的,依照有关法律、法规的规定办理。
Chapter III Protection of Military Restricted Zones 

第三章 军事禁区的保护

Article 14 The unit in charge of a military restricted zone shall, on the basis of the specific conditions and the demarcated scope of the zone, set up enclosing walls, barbed wire fences, and other barriers for the zone if it is a land military restricted zone, or set up barriers or boundary markers for the zone if it is a water military restricted zone.   第十四条 军事禁区管理单位应当根据具体条件,按照划定的范围,为陆地军事禁区修筑围墙、设置铁丝网等障碍物,为水域军事禁区设置障碍物或者界线标志。
Article 15 Any entry into a land or water military restricted zone by persons, vehicles, or vessels other than those of the unit in charge of the military restricted zone shall be prohibited, any photographing, video or sound recording, reconnaissance, survey, or graphic or narrative depiction of military restricted zones shall be prohibited, and any low-altitude flying of aircrafts over military restricted zones shall be prohibited, except with the approval of the military organs at or above the military area command level.   第十五条 禁止陆地、水域军事禁区管理单位以外的人员、车辆、船舶进入军事禁区,禁止对军事禁区进行摄影、摄像、录音、勘察、测量、描绘和记述,禁止航空器在军事禁区上空进行低空飞行。但是,经军区级以上军事机关批准的除外。
Any entry into a military restricted airspace by aircrafts shall be prohibited, except as approved in accordance with the relevant provisions of the state. 禁止航空器进入空中军事禁区,但依照国家有关规定获得批准的除外。
Any use of photographs, video or sound recordings, or reconnaissance, survey, or graphic or narrative depiction materials of military restricted zones shall be subject to the approval of the military organs at or above the military area command level. 使用军事禁区的摄影、摄像、录音、勘察、测量、描绘和记述资料,应当经军区级以上军事机关批准。
Article 16 It shall be prohibited, in water military restricted zones, to construct or set up non-military installations or to engage in aquaculture, fishing, and other activities that impede the operations of military vessels or jeopardize the security and confidentiality and the effective utilization of military installations.
