To actively promote the people's procuratorates' provision of sentencing recommendations for public prosecution cases and enhance the openness and impartiality of sentencing, these Opinions are formulated in accordance with the Criminal Procedure Law and relevant judicial interpretations and in consideration of prosecutorial practices. | |
为积极推进人民检察院提起公诉案件的量刑建议工作，促进量刑的公开、公正，根据刑事诉讼法和有关司法解释的规定，结合检察工作实际，制定本意见。 |

| Article 1 “Sentencing recommendations” means the recommendations legally provided by the people's procuratorates to the people's courts on the type, range, and execution mode, among others, of criminal penalties applicable to the accused in public prosecutions instituted. Sentencing recommendations are an important part of the procuratorial organs' right of public prosecution. | | 第一条 量刑建议是指人民检察院对提起公诉的被告人，依法就其适用的刑罚种类、幅度及执行方式等向人民法院提出的建议。量刑建议是检察机关公诉权的一项重要内容。 |

| Article 2 The people's procuratorates shall observe the following principles when providing sentencing recommendations: | | 第二条 人民检察院提出量刑建议，应当遵循以下原则： |
| |
|
(1) Provision of recommendations according to law. The people's procuratorates shall, based on the facts, nature, circumstances and degree of harm to society of a crime, provide sentencing recommendations in accordance with the Criminal Law | | （一）依法建议。应当根据犯罪的事实、犯罪的性质，情节和对于社会的危害程度，依照刑法、刑事诉讼法以及相关司法解释的规定提出量刑建议。 |

|
| (2) Objectivity and Impartiality. The people's procuratorates shall objectively and comprehensively examine evidence according to the actual circumstances of a case and provide impartial sentencing recommendations strictly based on the facts. | | （二）客观公正。应当从案件的实际情况出发，客观、全面地审查证据，严格以事实为根据，提出公正的量刑建议。 |

| (3) Tempering strict justice with mercy. The people's procuratorates shall implement the criminal policy of tempering strict justice with mercy and provide sentencing recommendations after a comprehensive consideration of various circumstances of a case for heavier, lighter, mitigated, or exemption from punishment. | | （三）宽严相济。应当贯彻宽严相济刑事政策，在综合考虑案件从重、从轻、减轻或者免除处罚等各种情节的基础上，提出量刑建议。 |

| (4) Focusing on effectiveness. The people's procuratorates shall, when providing sentencing recommendations, not only exercise their power of legal supervision according to law, but also respect the people's courts' independent exercise of judicial power, so as to ensure most effective sentencing recommendations. | | （四）注重效果。提出量刑建议时，既要依法行使检察机关的法律监督职权，也要尊重人民法院独立行使审判权，争取量刑建议的最佳效果。 |

| Article 3 A people's procuratorate may provide sentencing recommendations for public prosecution initiated by it in a people's court. | | 第三条 人民检察院对向人民法院提起公诉的案件，可以提出量刑建议。 |
| |
|
| Article 4 Sentencing recommendations may be provided for a case meeting the following conditions: | | 第四条 提出量刑建议的案件应当具备以下条件： |
| |
|
| (1) Criminal facts are clear and evidence is definite and sufficient; | | （一）犯罪事实清楚，证据确实充分； |
| |
|
| (2) All the statutory sentencing circumstances for heavier, lighter or mitigated punishments, among others, as a basis for the sentencing recommendations, have been ascertained; and | | （二）提出量刑建议所依据的各种法定从重、从轻、减轻等量刑情节已查清； |
| |
|
| (3) The primary discretionary sentencing circumstances for heavier or lighter punishments, among others, as a basis for the sentencing recommendations, have been ascertained. | | （三）提出量刑建议所依据的重要酌定从重，从轻等量刑情节已查清。 |
| |
|
| Article 5 Sentencing recommendations shall be provided within the statutory sentencing range and shall not cover two or more principal penalties, unless there are any circumstances for mitigated punishment. | | 第五条 除有减轻处罚情节外，量刑建议应当在法定量刑幅度内提出，不得兼跨两种以上主刑。 |
| |
|
| (1) The people's procuratorates shall be cautious when recommending death penalty or life imprisonment. | | （一）建议判处死刑、无期徒刑的，应当慎重。 |
| |
|
| (2) Where the people's procuratorate recommends fixed-term imprisonment, it shall generally propose a relatively definite sentencing range. If the range of the statutory penalty is not more than three years, the proposed range shall generally not be more than one year; if the range of the statutory penalty is more than three years but not more than five years, the proposed range shall generally not be more than two years; if the range of the statutory penalty is more than five years, the proposed range shall generally not be more than three years. The people's procuratorate may, if necessary, recommend a definite term of imprisonment according to the specific circumstances of a case. | | （二）建议判处有期徒刑的，一般应当提出一个相对明确的量刑幅度，法定刑的幅度小于3年（含3年）的，建议幅度一般不超过1年；法定刑的幅度大于3年小于 5年（含5年）的，建议幅度一般不超过2年；法定刑的幅度大于5年的，建议幅度一般不超过3年。根据案件具体情况，如确有必要，也可以提出确定刑期的建议。 |

| (3) If subjection to surveillance is proposed, the range shall generally not be more than three months. | | （三）建议判处管制的，幅度一般不超过3个月。 |
| |
|
| (4) If detention is recommended, the range shall generally not be more than one month. | | （四）建议判处拘役的，幅度一般不超过1个月。 |
| |
|
| (5) If a suspended sentence is recommended, it shall be clearly proposed. | | （五）建议适用缓刑的，应当明确提出。 |
| |
|
(6) If a supplementary penalty is recommended, a mere reference to the applicable type of penalty is allowed.
