| The Measures for the Supervision and Administration of Coal Operations, as deliberated and adopted at the Director's Executive Meeting of the National Development and Reform Commission (“NDRC”), are hereby issued and shall come into force on September 1, 2014. The Measures for the Supervision over Coal Operations (Order No. 25 of the National Development and Reform Commission) issued by the NDRC on December 27, 2004 shall be repealed concurrently. | | 《煤炭经营监管办法》已经国家发展和改革委员会主任办公会讨论通过，现予发布，自2014年9月1日起施行。国家发展和改革委员会2004年12月27日发布的《煤炭经营监管办法》（国家发展和改革委员会令第25号）同时废止。 |

| ChapterI General Provisions | | 第一章 总则 |
| Article 1 To strengthen the supervision and administration of coal operations, regulate and maintain the order of coal operations, guarantee stable coal supply, and promote the environmental protection, these Measures are developed in accordance with the Coal Industry Law of the People's Republic of China and the Law of the People's Republic of China on Prevention and Control of Atmospheric Pollution. | | 第一条 为加强煤炭经营监督管理，规范和维护煤炭经营秩序，保障煤炭稳定供应，促进环境保护，根据《中华人民共和国煤炭法》和《中华人民共和国大气污染防治法》，制定本办法。 |
| Article 2 These Measures shall apply to the undertaking of coal operations and supervision and administration activities within the territory of the People's Republic of China. | | 第二条 在中华人民共和国境内从事煤炭经营和监督管理活动，适用本办法。 |
| Article 3 For the purpose of these Measures, coal operations refers to enterprises' or individuals' activities such as the distribution of raw coal, blending, wash and selection of coal, and distribution of moulded coal processing products. | | 第三条 本办法所称煤炭经营，是指企业或个人从事原煤、配煤及洗选、型煤加工产品经销等活动。 |
| Article 4 The NDRC shall be responsible for guiding the supervision and administration of coal operations throughout the country and the coal operation administrations of local people's governments at or above the county level shall be responsible for the supervision and administration of coal operations within their respective administrative regions. | | 第四条 国家发展和改革委员会负责指导全国煤炭经营的监督管理，县级以上地方人民政府煤炭经营监督管理部门负责本行政区域内煤炭经营的监督管理。 |
| Article 5 The NDRC shall, jointly with the relevant departments of the State Council, strengthen policy guidance and support, establish a sound market system for coal trading, cultivate trading enterprises that play the role of supporting the coal supply guarantee, and encourage qualified trading enterprises to engage in the work of emergency reserve of coal. | | 第五条 国家发展和改革委员会会同国务院有关部门加强政策引导和支持，建立健全煤炭交易市场体系，培育对煤炭供应保障具有支撑作用的经营企业，鼓励具备条件的经营企业参与煤炭应急储备工作。 |
| Article 6 The relevant industry associations shall guide coal operators in strengthening self-discipline, cooperate with coal operation administrations to carry out the work, and maintain a sound market environment for fair competition. | | 第六条 有关行业协会引导煤炭经营主体加强自律，配合煤炭经营监督管理部门开展工作，维护公平竞争的市场环境。 |

| Article 7 Those engaged in coal operations shall observe the relevant laws, regulations, and rules, conform to the coal industry policies and industry standards, guarantee the coal quality, and promote the environmental protection. | | 第七条 从事煤炭经营活动应遵守有关法律、法规和规章，符合煤炭产业政策和行业标准，保证煤炭质量，促进环境保护。 |
| Article 8 After having handled registration at the administrative organ for industry and commerce, any coal operation enterprise shall, within 30 workdays, conduct informative recordation with the local coal operation administration at the same level. In particular, any enterprise that is registered at the State Administration for Industry and Commerce shall conduct informative recordation with the local coal operation administration at the provincial level. | | 第八条 煤炭经营企业在工商行政管理机关办理登记注册后，应于三十个工作日内向所在地的同级煤炭经营监督管理部门进行告知性备案。其中，在国家工商行政管理总局登记注册的企业，向其住所所在地的省级煤炭经营监督管理部门进行告知性备案。 |
| The recordation of a coal operation enterprise includes the name, legal representative, domicile, and coal storage place and facilities of the enterprise as well as information on the social credit rating agency where its credit records are established. Where any recordation content is changed, the enterprise shall, within 30 workdays from the date of the change, notify the local coal operation administration of the change. | | 煤炭经营企业备案内容包括企业名称、法定代表人、住所、储煤场地及设施、建立信用记录的社会征信机构情况。备案内容发生变化的，企业应在变更之日起三十个工作日内告知所在地煤炭经营监督管理部门。 |
Article 9 The coal operations administration at the provincial level shall announce the list of coal operations enterprises that are put on records within its administrative region through any publication or website and accept social supervision.
