Measures for the Occupational Annuities of State Organs and Public Institutions 机关事业单位职业年金办法
Article 1 For purposes of establishing a multi-tiered pension insurance system, guaranteeing the living standard of employees of state organs and public institutions after their retirement, and promoting the rational flow of human resources, these Measures are developed in accordance with the Decision of the State Council on the Reform of the Pension Insurance System for Employees of State Organs and Public Institutions (No. 2 [2015], State Council) and other relevant provisions.   第一条 为建立多层次养老保险体系,保障机关事业单位工作人员退休后的生活水平,促进人力资源合理流动,根据《国务院关于机关事业单位工作人员养老保险制度改革的决定》(国发〔2015〕2号)等相关规定,制定本办法。
Article 2 The term “occupational annuity” as mentioned in these Measures refers to the supplementary pension insurance system that is established for state organs and public institutions and the employees thereof on the basis of their participation in the basic pension insurance for state organs and public institutions.   第二条 本办法所称职业年金,是指机关事业单位及其工作人员在参加机关事业单位基本养老保险的基础上,建立的补充养老保险制度。
Article 3 The scope of entities and employees to whom these Measures apply is consistent with that of participants of the basic pension insurance for state organs and public institutions.   第三条 本办法适用的单位和工作人员范围与参加机关事业单位基本养老保险的范围一致。
Article 4 Expenses needed for occupational annuities shall be jointly assumed by entities and the employees thereof. The proportion of occupational annuity premiums paid by an entity shall be 8% of its total wages and the proportion of premiums paid by an individual shall be 4% of the individual's wage and such premiums shall be withheld by the entity on behalf of the individual. The bases for premiums paid by entities and individuals shall be consistent with those for the basic pension insurance for employees of state organs and public institutions.   第四条 职业年金所需费用由单位和工作人员个人共同承担。单位缴纳职业年金费用的比例为本单位工资总额的8%,个人缴费比例为本人缴费工资的4%,由单位代扣。单位和个人缴费基数与机关事业单位工作人员基本养老保险缴费基数一致。
The state shall, according to the economic and social development situations, adjust the proportions of occupational annuity premiums paid by entities and individuals at appropriate time. 根据经济社会发展状况,国家适时调整单位和个人职业年金缴费的比例。
Article 5 The occupational annuity funds shall consist of the following items:   第五条 职业年金基金由下列各项组成:
(1) premiums paid by entities; (一)单位缴费;
(2) premiums paid by individuals; (二)个人缴费;
(3) income arising from investment operations of occupational annuity funds; and (三)职业年金基金投资运营收益;
(4) other income as provided for by the state. (四)国家规定的其他收入。
Article 6 The occupational annuity funds shall be managed in the form of personal accounts. Premiums paid by individuals shall be accumulated in solid accounts. For an entity with full-amount contribution from the treasury, the premiums paid by it shall be in the form of bookkeeping according to information it provides and the interest shall be calculated on a yearly basis according to the bookkeeping interest rate as uniformly published by the state. Before an employee retires, the amount of accumulative deposits in the employee's account of occupational annuity shall be funded with funds appropriated by the treasury at the same level; and for an entity with non-full-amount contribution from the treasury, the premiums paid by it shall be accumulated in solid accounts. The occupational annuity funds that are accumulated in solid accounts shall be subject to market-oriented investment operations and the interest shall be calculated according to the actual income.

   第六条 职业年金基金采用个人账户方式管理。个人缴费实行实账积累。对财政全额供款的单位,单位缴费根据单位提供的信息采取记账方式,每年按照国家统一公布的记账利率计算利息,工作人员退休前,本人职业年金账户的累计储存额由同级财政拨付资金记实;对非财政全额供款的单位,单位缴费实行实账积累。实账积累形成的职业年金基金,实行市场化投资运营,按实际收益计息。
