| Chapter I General Provisions | | |
| | 第一条 为了规范海关对进出境运输工具的监管，保障进出境运输工具负责人和进出境运输工具服务企业的合法权益，根据《中华人民共和国海关法》，制定本办法。 |
| Article 1 For purposes of regulating the customs supervision of transportation means entering or leaving China and protecting the lawful rights and interests of the persons in charge of and the service enterprises of transportation means entering or leaving China, these Measures are formulated in accordance with the Customs Law of the People's Republic of China. | | |
| | 第二条 本办法所称进出境运输工具是指用于载运人员、货物、物品进出境的各种船舶、航空器、铁路列车、公路车辆和驮畜。 |
| Article 2 The term “transportation means entering or leaving China” as used in these Measures refers to various vessels, aircrafts, trains, road vehicles and pack animals that are used to carry passengers, cargos and articles into or out of China. | | |
| | 第三条 海关对经营性进出境运输工具的监管适用本办法，对非经营性进出境运输工具的监管比照本办法管理。 |
| Article 3 The customs supervision of commercial transportation means entering or leaving China shall be governed by these Measures and the customs supervision of non-commercial transportation means entering or leaving China shall be governed by these Measures by analogy. | | |
| | 第四条 除经国务院或者国务院授权的机关批准外，进出境运输工具应当通过设立海关的地点进境或者出境，在海关监管场所停靠、装卸货物、物品和上下人员。 |
| Article 4 Except when it is approved by the State Council or the department authorized by the State Council, the transportation means shall enter or leave China through places with customs houses and stop, load and unload cargos and articles and embark and debark persons at places under customs supervision. | | 由于不可抗力原因，进出境运输工具被迫在未设立海关的地点或者在非海关监管场所停靠、降落或者抛掷、起卸货物、物品以及上下人员的，进出境运输工具负责人应当立即报告附近海关。附近海关应当对运输工具及其所载的货物、物品实施监管。 |
| Where any transportation means entering or leaving China has to stop or land, or throw away or unload cargos and articles and embark and debark persons at a place without a customs house or at a place which is not under customs supervision due to any force majeure, the person in charge of the transportation means shall promptly report to the nearby customs house. The nearby customs house shall supervise the said transportation means and the cargos and articles carried by it. | | |
| | 第五条 进境运输工具在进境以后向海关申报以前，出境运输工具在办结海关手续以后出境以前，应当按照交通运输主管机关规定的路线行进；交通运输主管机关没有规定的，由海关指定。 |
| Article 5 A transportation means entering China shall follow the route as prescribed by the transport administrative department during the period after it enters into China and before a customs declaration is made, and a transportation means leaving China shall follow the route as prescribed by the transport administrative department during the period after the customs formalities are finished and before it leaves China. If the transport administrative department does not prescribe any route, the customs house shall designate a route. | | 进境运输工具在进境申报以后出境以前，应当按照海关认可的路线行进。 |
| A transportation means entering China shall follow the route acknowledged by the customs house during the period after an entry declaration is made and before it leaves China. | | |
| | 第六条 进出境运输工具到达或者驶离设立海关的地点时，进出境运输工具负责人应当采用申报单形式向海关申报。 |
| Article 6 When a transportation means entering or leaving China arrives at or leaves a place with a customs house, the person in charge of the transportation means shall make a declaration to the customs house. | | |
| | 第七条 进境的境外运输工具和出境的境内运输工具，未向海关办理手续并缴纳关税，不得转让或者移作他用。 |
| Article 7 No overseas transportation means entering China or no domestic transportation means leaving China shall be transferred to others or be used for other purposes if the party concerned fails to go through customs formalities and pay the customs duties. | | 运输工具作为货物以租赁或其他贸易方式进出口的，除按照本办法办理进出境运输工具进境或者出境手续外，还应当按照有关规定办理进出境运输工具进出口报关手续。 |
| In the case of import or export of transportation means as cargos through lease or any other type of trade, the party concerned shall not only go through the formalities for the transportation means to enter or leave China under these Measures, but also undergo the customs declaration formalities for the import or export of transportation means entering or leaving China under relevant provisions. | | 第二章 备案管理 |
| Chapter II Archival-filing Administration | | 第八条 进出境运输工具、进出境运输工具负责人和进出境运输工具服务企业应当在经营业务所在地的直属海关或者经直属海关授权的隶属海关备案。 |
| | 海关对进出境运输工具、进出境运输工具负责人以及进出境运输工具服务企业的备案实行全国海关联网管理。 |
| Article 8 The transportation means entering or leaving China, persons in charge of transportation means entering or leaving China and service enterprises of transportation means entering or leaving China shall be archived at the customs house directly under the General Administration of Customs at the business operation place or at the customs house authorized by the customs house directly under the General Administration of Customs. | | |
| The archiving of the transportation means entering or leaving China, persons in charge of transportation means entering or leaving China and service enterprises of transportation means entering or leaving China shall be subject to the network management by customs houses throughout the country. | | 第九条 进出境运输工具、进出境运输工具负责人和进出境运输工具服务企业在海关办理备案的，应当按不同运输方式分别提交《进出境国际航行船舶备案表》《进出境航空器备案表》《进出境铁路列车备案表》《进出境公路车辆备案表》《运输工具负责人备案表》《运输工具服务企业备案表》，并同时提交上述备案表随附单证栏中列明的材料。 |

| Article 9 A Form for Archival-filing of International Navigation Vessels Entering or Leaving China, Form for Archival-filing of Aircrafts Entering or Leaving China, Form for Archival-filing of Trains Entering or Leaving China, Form for Archival-filing of Road Vehicles Entering or Leaving China, Form for Archival-filing of Persons in Charge of Transportation Means, Form for Archival-filing of Service Enterprises of Transportation Means shall, together with the materials as indicated in the column of “Accompanying Documents” of the aforesaid Forms, be submitted to the customs house for the archiving of the transportation means entering or leaving China, persons in charge of transportation means entering or leaving China and service enterprises of transportation means entering or leaving China on the basis of the type of transportation means, respectively. | | |
| The relevant administrative measures for service enterprises of transportation means shall be separately formulated by the General Administration of Customs. | | 第十条 《运输工具备案表》《运输工具负责人备案表》和《运输工具服务企业备案表》的内容发生变更的，进出境运输工具负责人、进出境运输工具服务企业应当在海关规定的时限内凭《备案变更表》和有关文件向备案海关办理备案变更手续。 |
| | 进出境运输工具负责人、进出境运输工具服务企业可以主动申请撤销备案，海关也可以依法撤销备案。 |
| Article 10 If the contents of a Form for Archival-filing of Transportation Means, Form for Archival-filing of Persons in Charge of Transportation Means or Form for Archival-filing of Service Enterprises of Transportation Means changes, the person in charge of transportation means entering or leaving China or the service enterprise of transportation means entering or leaving China shall undergo the recordation modification formalities upon the strength of the Recordation Modification Form and relevant documents with the customs office that conducts the recordation. | | |
| A person in charge of transportation means entering or leaving China or a service enterprise of transportation means entering or leaving China may voluntarily apply for cancelling the archival-filing and the customs house may also cancel the archival-filing according to law. | | 第十一条 海关对在海关备案的进出境运输工具服务企业和进出境运输工具所有企业、经营企业实施分类管理，具体办法由海关总署另行制定。 |

| Article 11 The customs house shall exercise categorized administration of service enterprises of transportation means entering or leaving China, enterprises as owners of transportation means entering or leaving China as well as operation enterprises of transportation means entering or leaving China. The concrete measures shall be separately formulated by the General Administration of Customs. | | 第一节 进境监管 |
| Chapter III Administration of Transportation Means | | 第十二条 进境运输工具负责人应当在规定时限将运输工具预计抵达境内目的港和预计抵达时间以电子数据形式通知海关。 |
| | 因客观条件限制，经海关批准，公路车辆负责人可以采用电话、传真等方式通知海关。 |
| Section 1 Supervision of Transportation Means Entering China | | 进境运输工具抵达设立海关的地点以前，运输工具负责人应当将进境时间、抵达目的港的时间和停靠位置通知海关。 |
| Article 12 The person in charge of a transportation means entering China shall, within the prescribed time limit, notify the customs house about the expected destination port within China and the expected arrival time of the transportation means in the form of electronic data. | | 第十三条 进境运输工具抵达设立海关的地点时，运输工具负责人应当按不同运输方式向海关申报，分别提交《中华人民共和国海关船舶进境（港）申报单》《中华人民共和国海关航空器进境（港）申报单》《中华人民共和国海关铁路列车进境申报单》《中华人民共和国海关公路车辆进境（港）申报单》，以及上述申报单中列明应当交验的其他单证。 |
| The person in charge of a road vehicle may send a notification to the customs house by telephone call, fax or otherwise due to objective limitations and upon approval of the customs house. | | 进境运输工具负责人也可以在运输工具进境前提前向海关办理申报手续。 |
| Before a transportation means entering China arrives at a place with a customs house, the person in charge of the transportation means shall notify the customs house about the time of entering China, time of arriving at the destination port, and location of stop. | | |

| Article 13 When a transportation means arrives at a place with a customs house, the person in charge of the transportation means shall declare to the customs house on the basis of the type of transportation means, submitting a Form of the Customs of the People's Republic of China for Declaration of Vessels Entering China (Ports), Form of the Customs of the People's Republic of China for Declaration of Aircrafts Entering China (Airports), Form of the Customs of the People's Republic of China for Declaration of Trains Entering China or Form of the Customs of the People's Republic of China for Declaration of Road Vehicles Entering China (Ports) and other documents which are indicated in the aforesaid Forms and are required for verification. | | |
| The person in charge of a transportation means may also make a declaration to the customs house earlier before the transportation means enters China. | | 第十五条 海关接受进境运输工具申报时，应当审核申报单证。 |

Article 14 When a transportation means entering China arrives at a place under customs supervision, the operator of the place under customs supervision shall notify the customs house.
