| Article 1 These Provisions are developed in accordance with the Decision of the CPC Central Committee on Deepening the Reform of the Party and State Institutions and the Plan for Deepening the Reform of the Party and State Institutions deliberated and adopted at the Third Plenary Session of the 19th CPC Central Committee, and the State Council Institutional Reform Proposal approved by the First Session of the Thirteenth National People's Congress. | | 第一条 根据党的十九届三中全会审议通过的《中共中央关于深化党和国家机构改革的决定》、《深化党和国家机构改革方案》和第十三届全国人民代表大会第一次会议批准的《国务院机构改革方案》,制定本规定。 |
| Article 2 The Ministry of Water Resources (“MWR”) is a component department of the State Council at the ministerial level. | | 第二条 水利部是国务院组成部门,为正部级。 |
| Article 3 The MWR shall implement the principles, policies, decisions and arrangements of the CPC Central Committee on water conservancy work, and adhere to and strengthen the centralized and unified leadership of the Party over water conservancy work in the course of performing the functions. Main duties are as follows: | | 第三条 水利部贯彻落实党中央关于水利工作的方针政策和决策部署,在履行职责过程中坚持和加强党对水利工作的集中统一领导。主要职责是: |
| (1) Being responsible for ensuring the rational development and utilization of water resources. Developing general strategic plans and policies for water conservancy, drafting the drafts of the relevant laws and regulations, developing departmental regulations, and organizing the development of national general strategic plans for water resources, comprehensive plans for important river and lake basins determined by the sate, plans for flood control and other plans for major water conservancy. | | (一)负责保障水资源的合理开发利用。拟订水利战略规划和政策,起草有关法律法规草案,制定部门规章,组织编制全国水资源战略规划、国家确定的重要江河湖泊流域综合规划、防洪规划等重大水利规划。 |
| (2) Being responsible for the overall planning and guarantee of living, production and business operation, and water use in ecological environment. Organizing the implementation of the most stringent water resources management system, implementing unified supervision and administration of water resources, developing plans for medium- and long-term supply and demand of water across the country and across regions and water volume allocation, and supervising the implementation thereof. Being responsible for water resource dispatch for important basins, regions and major water transfer projects. Organizing the implementation of the water obtainment licensing, water resource demonstration and flood control demonstration system, and directing the implementation of paid use of water resources. Directing water supply in the water conservancy industry and township water supply work. | | (二)负责生活、生产经营和生态环境用水的统筹和保障。组织实施最严格水资源管理制度,实施水资源的统一监督管理,拟订全国和跨区域水中长期供求规划、水量分配方案并监督实施。负责重要流域、区域以及重大调水工程的水资源调度。组织实施取水许可、水资源论证和防洪论证制度,指导开展水资源有偿使用工作。指导水利行业供水和乡镇供水工作。 |
| (3) Developing and organizing the implementation of the relevant rules on the water conservancy engineering construction according to the regulations, being responsible for offering suggestions for the scale and direction of and specific arrangements for the fixed asset investment of the central government in water conservancy and organizing and directing the implementation thereof, examining and approving the fixed asset investment projects in the national plans and within the scale of the annual plans according to the authority prescribed by the State Council, offering suggestions for the fund arrangements for water conservancy by the central government, and being responsible for the supervision and administration of the implementation of the projects. | | (三)按规定制定水利工程建设有关制度并组织实施,负责提出中央水利固定资产投资规模、方向、具体安排建议并组织指导实施,按国务院规定权限审批、核准国家规划内和年度计划规模内固定资产投资项目,提出中央水利资金安排建议并负责项目实施的监督管理。 |
| (4) Directing the protection of water resources. Organizing and implementing the plans for the protection of water resources. Directing the protection of drinking water sources, exploitation and utilization of groundwater, as well as management and protection of groundwater resources. Organizing and directing comprehensive treatment of groundwater over-exploitation areas. | | (四)指导水资源保护工作。组织编制并实施水资源保护规划。指导饮用水水源保护有关工作,指导地下水开发利用和地下水资源管理保护。组织指导地下水超采区综合治理。 |
| (5) Being responsible for water conservation. Developing water conservation policies, organizing the development and supervising the implementation of plans for water conservation, and organizing the development of the relevant standards. Organizing the implementation of the management rules on total water usage control, and directing and promoting the construction of a water conservation society. | | (五)负责节约用水工作。拟订节约用水政策,组织编制节约用水规划并监督实施,组织制定有关标准。组织实施用水总量控制等管理制度,指导和推动节水型社会建设工作。 |
| (6) Directing the hydrologic work. Being responsible for the monitoring of the hydrologic water resources and the construction and management of the website of China Hydrology. Monitoring rivers, lakes, reservoirs and groundwater, and issuing hydrologic water resource information, intelligence forecast and national water resources bulletins. Organizing the investigation and evaluation of water resources and hydropower resources, and monitoring and early warning of water resources carrying capacity according to the regulations. | | (六)指导水文工作。负责水文水资源监测、国家水文站网建设和管理。对江河湖库和地下水实施监测,发布水文水资源信息、情报预报和国家水资源公报。按规定组织开展水资源、水能资源调查评价和水资源承载能力监测预警工作。 |
| (7) Directing the management, protection and comprehensive utilization of water conservancy facilities, water areas and their shorelines. Organizing and directing the construction of water conservancy infrastructure networks. Directing the treatment, development and protection of important rivers, lakes and estuaries. Directing the ecological protection and restoration of river and lake water, the management of ecological flow and water volume of rivers and lakes, and the connection of river and lake water systems. | | (七)指导水利设施、水域及其岸线的管理、保护与综合利用。组织指导水利基础设施网络建设。指导重要江河湖泊及河口的治理、开发和保护。指导河湖水生态保护与修复、河湖生态流量水量管理以及河湖水系连通工作。 |
| (8) Directing and supervising the construction and operation management of water conservancy projects. Organizing the implementation of the construction and operation management of controlled and cross-regional cross-basin important water conservancy projects. Organizing the issuance and coordinating the implementation of the relevant policies and measures for the operation of the Three Gorges Project, the operation of the South-to-North WaterDiversion Project, and follow-up project construction, directing and supervising the safe operation of the project, organizing the work related to the final inspection of the project, and supervising and directing the construction of local supporting projects. | | (八)指导监督水利工程建设与运行管理。组织实施具有控制性的和跨区域跨流域的重要水利工程建设与运行管理。组织提出并协调落实三峡工程运行、南水北调工程运行和后续工程建设的有关政策措施,指导监督工程安全运行,组织工程验收有关工作,督促指导地方配套工程建设。 |
| (9) Being responsible for the soil and water conservation. Developing and supervising the implementation of plans for water and soil conservation, organizing the implementation of comprehensive prevention, control, monitoring and forecasting of water and soil erosion, and issuing announcements on a regular basis. Being responsible for the supervision and administration of soil and water conservation in construction projects, and directing the implementation of national key soil and water conservation construction projects. | | (九)负责水土保持工作。拟订水土保持规划并监督实施,组织实施水土流失的综合防治、监测预报并定期公告。负责建设项目水土保持监督管理工作,指导国家重点水土保持建设项目的实施。 |
| (10) Directing the rural water conservancy work. Organizing and carrying out the construction and transformation of medium- and large-sized water irrigation and drainage projects. Directing the construction and management of rural drinking water safety projects and directing the work related to water conservation irrigation. Coordinating the water conservancy work in pasturing areas. Directing the reform of and innovation on rural water conservancy and the construction of the social service system. Directing the development of rural water energy resources, small hydropower transformation, and rural electrification of hydropower. | | (十)指导农村水利工作。组织开展大中型灌排工程建设与改造。指导农村饮水安全工程建设管理工作,指导节水灌溉有关工作。协调牧区水利工作。指导农村水利改革创新和社会化服务体系建设。指导农村水能资源开发、小水电改造和水电农村电气化工作。 |
(11) Directing the management of resettlement due to water conservancy projects. Developing and supervising the implementation of the relevant policies for resettlement due to water conservancy projects, and organizing and implementing the rules on final inspection, supervision and evaluation of resettlement of inhabitants for water conservancy projects. Directing and supervising the implementation of the policies for follow-up support for reservoir inhabitants, coordinating and supervising the follow-up support for inhabitants for the Three Gorges Project and the South-to-North Water Diversion Project, and coordinating and promoting the corresponding assistance and other work.
