| Article 1 For purposes of protecting the aviation rights and interests of the state and promoting the safe, sound and orderly development of the international air transport, these Provisions are developed according to the provisions of the Civil Aviation Law of the People's Republic of China and other relevant laws and administrative regulations of the state. | | 第一条 为了维护国家的航空权益，促进国际航空运输安全、健康、有秩序地发展，根据《中华人民共和国民用航空法》和国家其他有关法律、行政法规的规定，制定本规定。 |
| Article 2 These Provisions shall be applicable to the regular international air transport of passengers, baggage, cargoes and mails (hereinafter referred to as “international flights”) operated by the public air transport enterprises (hereinafter referred to as “air transport enterprises”) established within the territory of the People's Republic of China. | | 第二条 本规定适用于在中华人民共和国境内设立的公共航空运输企业（以下简称空运企业）经营定期旅客、行李、货物、邮件的国际航空运输（以下称国际航班）。 |
| Article 3 An air transport enterprise applying for a business permit for international routes shall meet the following conditions: | | 第三条 申请国际航线经营许可的空运企业，应当具备以下条件： |
| (1) It has applied for increasing the business scope of international flights under the Provisions on the Business Permits for Public Air Transport Enterprises. | | （一）已按照《公共航空运输企业经营许可规定》申请增加了国际航班经营范围； |
| (2) It has the civil aircrafts, personnel and insurance appropriate to the business operation of the international routes. | | （二）具备与经营该国际航线相适应的民用航空器、人员和保险； |
| (3) Its flight schedules and frequency of use of fair freedom right comply with the provisions. | | （三）航班计划和航权使用率符合规定； |
| (4) Its annual average rate of transport aviation accidents caused by the reasons attributable to the company in the recent two years does not exceed the industry level of the corresponding period consecutively. | | （四）近两年公司责任原因运输航空事故征候率年平均值未连续超过同期行业水平； |
| (5) It has no record of serious violation of law in the law abidance and credit information records. | | （五）守法信用信息记录中没有严重违法行为记录； |
| (6) It complies with the relevant provisions on regular flight schedule and service quality management. | | （六）符合航班正常、服务质量管理的有关规定； |
| (7) It meets other conditions as prescribed in the laws, administrative regulations and rules. | | （七）符合法律、行政法规和规章规定的其他条件。 |
| An enterprise applying for a business permit for international routes for the first time shall also have the professional technicians and primary management personnel appropriate to the business operation of international flights, and the corresponding management system for the business operation of international flights. | | 初次申请国际航线经营许可的，还应具有与经营国际航班相适应的专业技术人员和主要管理人员、相应的经营国际航班的管理制度。 |
| Article 4 An air transport enterprise applying for a business permit for international routes (hereinafter referred to as “applicant”) shall submit a written application and the following materials to the Civil Aviation Administration of China (“CAAC”): | | 第四条 申请国际航线经营许可的空运企业（以下简称申请人），应当向民航局提交书面申请以及下列材料： |
| (1) the business license for a public air transport enterprise; | | （一）公共航空运输企业经营许可证； |
| (2) the information and the proof materials on the air transport business operation within the most recent year; | | （二）最近一年内的航空运输业务经营情况及证明材料； |
| (3) the information on the civil aircrafts appropriate to the business operation of the international routes; | | （三）与经营该国际航线相适应的民用航空器的情况； |
| (4) the insurance documents on the aircraft hull insurance, hull war risk and legal liability insurance purchased; | | （四）投保飞机机身险、机身战争险和法定责任险的保险证明文件； |
| (5) the feasibility study report; | | （五）可行性研究报告； |
| (6) the flight plans, proposed flight routes, flight schedules, transport capacity arrangements, and the materials on the international airports and the alternate international airports at the starting points, stopovers and destinations; | | （六）经营该国际航线的航班计划、拟飞行航路、班期、运力安排，以及始发站、经停站、目的站国际机场和备降国际机场的资料； |
| (7) the certification materials proving that the international airports used by the applicant meet the conditions appropriate to the models of aircrafts used for its flights and have the security measures with international standards; | | （七）申请人所使用的国际机场具备其通航所用机型相适应的条件和具备国际标准的安保措施等证明材料； |
| (8) the description ensuring the effective implementation of the air freedom right and the information on the frequency of use of fair freedom right in the past two years; | | （八）确保航权能够有效执行的说明及近两年航权使用率情况； |
| (9) the description about code-sharing flight plans that comply with the air transport agreements signed between the Chinese government and the foreign governments; and | | （九）符合我国与外国政府签订的航空运输协定的代码共享航班计划的说明； |
| (10) other necessary materials. | | （十）其他必要的资料。 |
| An enterprise applying for a business permit for international routes for the first time shall also provide the certification materials on the professional technicians and primary management personnel appropriate to the business operation of international flights, and the corresponding management system, among others. | | 初次申请国际航线经营许可的，还应当提供与经营国际航班相适应的专业技术人员和主要管理人员情况、有关管理制度等证明材料。 |
| Article 5 For an application filed by an applicant, the CAAC shall, besides conducting the examination as prescribed in Article 3 of these Provisions, consider the following factors: | | 第五条 民航局对申请人的申请，除按本规定第三条规定审核外，还应当考虑以下因素： |
| (1) It complies with the air transport agreements signed by and between the Chinese government and the foreign governments. | | （一）符合我国与外国政府签订的航空运输协定； |
| (2) It is in line with the overall plans of the state for national development strategy and international routes. | | （二）符合我国国家发展战略和国际航线总体规划； |
(3) For the countries or routes with liberation in air freedom right, the CAAC shall, under subparagraphs (1) and (2) of this article, develop a catalogue and the designated carriers, routes to be operated, flights to be operated, and transport capacity arrangement for the flights in the catalogue shall not be restricted. Other routes shall comply with the relevant measures of the CAAC for international air freedom right and flight administration.
