The departments (bureaus) of human resources and social security, foreign affairs offices, public security departments (bureaus), and departments (bureaus) of culture of all provinces, autonomous regions and municipalities directly under the Central Government; and embassies, consulates and offices stationed overseas, and commissioner's offices in Hong Kong and Macao: 各省、自治区、直辖市人力资源社会保障厅(局)、外事办公室、公安厅(局)、文化厅(局),各驻外使馆、领馆、处、驻香港、澳门公署:
To effectively implement the Exit-Entry Administration Law of the People's Republic of China, Regulation on the Administration of the Entry and Exit of Foreign Nationals and other relevant laws and regulations, and further regulate foreign nationals' employment in China, the Ministry of Human Resources and Social Security, Ministry of Foreign Affairs, Ministry of Public Security, and Ministry of Culture have jointly developed the Relevant Handling Procedures for a Foreign National's Entry into China to Complete a Short-Term Work Assignment (for Trial Implementation) (hereinafter referred to as the “Handling Procedures”), which are hereby issued to you for your diligent implementation. 为做好《中华人民共和国出境入境管理法》和《外国人入境出境管理条例》等法律法规的贯彻实施工作,进一步规范外国人在中国就业行为,人力资源社会保障部、外交部、公安部、文化部联合制定了《外国人入境完成短期工作任务的相关办理程序(试行)》(以下简称《办理程序》)。现印发给你们,请认真执行。
The departments of human resources and social security, foreign affairs, public security and culture at all levels, among others, shall handle the relevant formalities for foreign nationals entering China to complete short-term work assignments in accordance with the Handling Procedures. Any foreign national who enters China without undergoing the relevant formalities in accordance with the Handling Procedures or fails to engage in short-term work in compliance with the items listed in the work approval shall be investigated and punished by a public security authority as illegal employment. All departments shall gradually improve the various administrative systems, strengthen their coordination and cooperation, and enhance information communication to provide conveniences for foreign nationals entering China to complete short-term work assignments. 各级人力资源社会保障、外事、公安、文化等部门应按照《办理程序》为入境完成短期工作任务的外国人办理相关手续。对于未按《办理程序》办理相关手续入境及不按工作证明所列事项从事短期工作的外国人,公安机关将按非法就业查处。各部门要逐步完善各项管理制度,加强协调配合,强化信息沟通,为入境完成短期工作任务的外国人提供便利。
The Handling Procedures shall come into force on January 1, 2015, and all departments shall lose no time in effectively handling the preparations prior to the implementation thereof. The electronic templates for the Approval for the Short-Term Work of a Foreign National in China (Chinese and English), the Information Sheet for the Short-Term Work of a Foreign National and the Information Sheet for the Performances of a Foreign National shall be issued separately. 《办理程序》自 2015年1月1日起执行。请各部门抓紧做好执行前的各项准备工作。外国人在中国短期工作证明(中英文)和外国人短期工作信息表、外国人演出信息表电子模板另行发放。

Relevant Handling Procedures for a Foreign National's Entry into China to Complete a Short-Term Work Assignment (for Trial Implementation) 外国人入境完成短期工作任务的相关办理程序(试行)
I. A foreign national's entry into China to complete a short-term work assignment refers to a foreign national's entering China on any of the following grounds and staying in China for not more than 90 days:   一、外国人入境完成短期工作任务,指因下列事由入境,且在境内停留不超过90日的:
1. Completion of certain technological work, scientific research, management or instruction at a partner entity in China; (一)到境内合作方完成某项技术、科研、管理、指导等工作;
2. Trial training at a sports institution in China (including as a coach or an athlete); (二)到境内体育机构进行试训(包括教练员、运动员);
3. Filming (including commercials and documentaries); (三)拍摄影片(包括广告片、纪录片);
4. Fashion shows (including a car show model, shooting of a print advertisement, etc.); (四)时装表演(包括车模、拍摄平面广告等);
5. Foreign-related commercial performances; or (五)从事涉外营业性演出;
6. Any other circumstance identified by a department of human resources and social security. (六)人力资源社会保障部门认定的其他情形。
II. None of the following circumstances shall be deemed to be completion of a short-term work assignment:   二、以下情形不视为完成短期工作任务:
1. Supporting repair, installation, commissioning, disassembly, instruction or training services with the purchase of machinery; (一)购买机器设备配套维修、安装、调试、拆卸、指导和培训的;
2. Instruction, supervision or inspection with respect to a bid-winning project in China; (二)对在境内中标项目进行指导、监督、检查的;
3. Assignment to short-term work at a branch office, subsidiary or representative office in China; (三)派往境内分公司、子公司、代表处完成短期工作的;
4. Participation in a sports competition (including as an athlete, coach, team physician, assistant or any other relevant personnel, except when the foreign national enters China to compete in a sports event with a registration card in accordance with the requirements of an international sports organization and upon approval by a competent Chinese authority); (四)参加体育赛事的(包括运动员、教练员、队医、助理等相关人员。但根据国际体育组织要求,经我国主管部门批准,持注册卡入境参赛等情况除外);
5. A volunteer or any other person who enters China to engage in unpaid work or is paid by an overseas institution; (五)入境从事无报酬工作或由境外机构提供报酬的义工和志愿者等;
6. The competent culture department does not indicate “foreign-related commercial performances” in its approval document. (六)文化主管部门在批准文书上未注明“涉外营业性演出”的。
A foreign national falling under the circumstance in item 1, 2, 3 or 4, and staying for not more than 90 days shall apply for an M visa. A foreign national falling under the circumstance in item 5 or 6, and staying for not more than 90 days shall apply for an F visa. 具有(一)(二)(三)(四)情形,且停留时间不超过90日的,应当申请办理M字签证;具有(五)(六)情形,且停留时间不超过90日的,应当申请办理F字签证。
III. Where a foreign national listed in Article 1 or item 1, 2, 3 or 5 of Article 2 above stays for over 90 days upon each entry into China, the relevant formalities shall be handled in accordance with the Provisions on the Administration of Foreign Nationals' Employment in China. A foreign national's entry into China for seasonal or short-term labor shall be handled in accordance with the relevant provisions.

   三、前述第一条、第二条第(一)、(二)、(三)、(五)项所列人员每次入境停留时间超过90日的,均应按照《外国人在中国就业管理规定》申请办理相关手续。入境从事季节性劳务、短期劳务按有关规定执行。
