Chapter 1: General Provisions 

第一章 总  则

Article 1 The Electoral Law of the National People's Congress and Local People's Congresses is formulated in accordance with the Constitution of the People's Republic of China.   第一条 根据中华人民共和国宪法,制定全国人民代表大会和地方各级人民代表大会选举法
Article 2 Deputies to the National People's Congress and to the people's congresses of provinces, autonomous regions, municipalities directly under the Central Government, cities divided into districts, and autonomous prefectures shall be elected by the people's congresses at the next lower level.   第二条 全国人民代表大会的代表,省、自治区、直辖市、设区的市、自治州的人民代表大会的代表,由下一级人民代表大会选出。
Deputies to the people's congresses of cities not divided into districts, municipal districts, counties, autonomous counties, townships, nationality townships and towns shall be elected directly by their constituencies. 不设区的市、市辖区、县、自治县、乡、民族乡、镇的人民代表大会的代表,由选民直接选出。
Article 3 All citizens of the People's Republic of China who have reached the age of 18 shall have the right to vote and stand for election, regardless of ethnic status, race, sex, occupation, family background, religious belief, education, property status and length of residence.   第三条 年满十八周岁的中华人民共和国公民,不分民族、种族、性别、职业、社会出身、宗教信仰、教育程度、财产状况和居住期限,都有选举权和被选举权。
Persons who have been deprived of political rights according to the law shall not have the right to vote and stand for election. 依照法律被剥夺政治权利的人没有选举权和被选举权。
Article 4 Each voter shall have the right to vote only once in an election.   第四条 每一选民在一次选举中只有一个投票权。
Article 5 Elections shall be conducted separately in the People's Liberation Army, and the procedures for such elections shall be formulated separately.   第五条 人民解放军单独进行选举,选举办法另订。
Article 6 The National People's Congress and the local people's congresses of the areas with a relatively large number of returned overseas Chinese shall have an appropriate number of deputies who are returned overseas Chinese.   第六条 全国人民代表大会和归侨人数较多地区的地方人民代表大会,应当有适当名额的归侨代表。
Article 7 The Standing Committee of the National People's Congress shall conduct the election of deputies to the National People's Congress. The standing committees of the people's congresses of provinces, autonomous regions, municipalities directly under the Central Government, cities divided into districts, and autonomous prefectures shall conduct the elections of deputies to the people's congresses at the corresponding levels. Prior to the establishment of the standing committees of the local people's congresses, such elections shall be conducted by the local administrative organs.   第七条 全国人民代表大会常务委员会主持全国人民代表大会代表的选举。省、自治区、直辖市、设区的市、自治州的人民代表大会常务委员会主持本级人民代表大会代表的选举。在地方人民代表大会常务委员会成立以前,由地方行政机关主持。
In cities divided into districts, municipal districts, counties, autonomous counties, townships, nationality townships and towns, election committees shall be established to conduct the election of deputies to the people's congresses at the corresponding levels. The election committees of cities not divided into districts, municipal districts, counties and autonomous counties shall be under the leadership of the standing committees of the people's congresses at the corresponding levels. The election committees of townships, nationality townships and towns shall be under the leadership of the management committees of the townships, nationality townships and the people's governments of towns. 不设区的市、市辖区、县、自治县、乡、民族乡、镇设立选举委员会,主持本级人民代表大会代表的选举。不设区的市、市辖区、县、自治县的选举委员会受本级人民代表大会常务委员会的领导。 乡、 民族乡、镇的选举委员会受乡、民族乡、镇的人民政府的领导。
Article 8 Election funds for the National People's Congress and the local people's congresses at various levels shall be disbursed by the State Treasury.   第八条 全国人民代表大会和地方各级人民代表大会的选举经费,由国库开支。
Chapter 2: Number of Deputies to the Local People's Congresses at Various Levels 

第二章 地方各级人民代表大会代表名额

Article 9 The number of deputies to the local people's congresses at various levels shall be independently decided by the standing committees of the people's congresses of the provinces, autonomous regions, or municipalities directly under the Central Government, in accordance with the principle of facilitating the convening of meetings and discussion and solution of problems as well as ensuring appropriate representation of all nationalities, all localities and people of all circles; the number of deputies so decided shall be reported to the Standing Committee of the National People's Congress for the record.   第九条 地方各级人民代表大会代表的名额,由各省、自治区、直辖市的人民代表大会常务委员会,按照便于召开会议、讨论问题的解决问题,并且使各民族、各地区、各方面都能有适当数量的代表的原则自行决定,并报全国人民代表大会常务委员会备案。
Article 10 The number of deputies to the people's congresses of autonomous prefectures, counties and autonomous counties shall be allocated by the standing committees of the people's congresses at the corresponding levels, in accordance with the principle that the number of people represented by each rural deputy is four times the number of people represented by each town deputy. Townships, nationality townships and towns with exceptionally small populations shall also be represented.   第十条 自治州、县、自治县人民代表大会代表的名额,由本级人民代表大会常务委员会按照农村每一代表所代表的人口数四倍于镇每一代表所代表的人口数的原则分配。人口特少的乡、民族乡、镇,也应有代表参加。
In the administrative areas of counties or autonomous counties which have towns with exceptionally large populations or have enterprises and institutions not under the leadership of the people's governments at or below the county level whose workers and staff account for a relatively large portion of the county's total population, the ratio between the number of people represented by a rural deputy and the number of people represented by a town deputy or a deputy of an enterprise or institution may, upon a decision made by the standing committee of the people's congress of the province, autonomous region, or municipality directly under the Central Government, be smaller than four to one, even to the extent of one to one. 县、自治县行政区域内,镇的人口特多的,或者不属于县级以下人民政府领导的企业事业组织的职工人数在全县总人口中所占比例较大的,经省、自治区、直辖市的人民代表大会常务委员会决定,农村每一代表所代表的人口数同镇或者企业事业组织职工每一代表所代表的人口数之比可以小于四比一直至一比一。
Article 11 In municipalities directly under the Central Government, cities and municipal districts, the number of people represented by a rural deputy shall be greater than the number of people represented by an urban deputy.   第十一条 直辖市、市、市辖区的农村每一代表所代表的人口数,应多于市区每一代表所代表的人口数。
Article 12 The number of deputies to the people's congresses of provinces or autonomous regions shall be allocated by the standing committees of the people's congresses at the corresponding levels, in accordance with the principle that the number of people represented by each rural deputy is five times the number of people represented by each urban deputy.   第十二条 省、自治区人民代表大会代表的名额,由本级人民代表大会常务委员会按照农村每一代表所代表的人口数五倍于城市每一代表所代表的人口数的原则分配。
Chapter 3: Number of Deputies to the National People's Congress 

第三章 全国人民代表大会代表名额

Article 13 Deputies to the National People's Congress shall be elected by the people's congresses of the provinces, autonomous regions, and municipalities directly under the Central Government and by the People's Liberation Army.   第十三条 全国人民代表大会的代表,由省、自治区、直辖市人民代表大会和人民解放军选举产生。
The number of deputies to the National People's Congress shall not exceed 3,500. The allocation of the number of deputies shall be decided by the Standing Committee of the National People's Congress in accordance with existing conditions. 全国人民代表大会代表的名额不超过三千五百人。名额的分配由全国人民代表大会常务委员会根据情况决定。
Article 14 The number of deputies to the National People's Congress to be elected by the provinces, autonomous regions, and municipalities directly under the Central Government shall be allocated by the Standing Committee of the National People's Congress in accordance with the principle that the number of people represented by each rural deputy is eight times the number of people represented by each urban deputy.   第十四条 省、自治区、直辖市应选全国人民代表大会代表的名额,由全国人民代表大会常务委员会按照农村每一代表所代表的人口数八倍于城市每一代表所代表的人口数的原则分配。
Article 15 The number of deputies to the National People's Congress to be elected by minority nationalities shall be allocated by the Standing Committee of the National People's Congress, in the light of the population and distribution of each minority nationality, to the people's congresses of the various provinces, autonomous regions, and municipalities directly under the Central Government, which shall elect them accordingly. Nationalities with exceptionally small populations shall each have at least one deputy.   第十五条 全国少数民族应选全国人民代表大会代表,由全国人民代表大会常务委员会参照各少数民族的人口数和分布等情况,分配给各省、自治区、直辖市的人民代表大会选出。人口特少的民族,至少也应有代表一人。
Chapter 4: Elections among Minority Nationalities 

第四章 各少数民族的选举

Article 16 In areas where minority nationalities live in concentrated communities, each minority nationality shall have its deputy or deputies sit in the local people's congress.   第十六条 有少数民族聚居的地方,每一聚居的少数民族都应有代表参加当地的人民代表大会。
Where the total population of a minority nationality in such an area exceeds 15 percent of the total local population, the number of people represented by each deputy of that minority nationality shall be equal to the number of people represented by each of the other deputies to the local people's congress. 聚居境内同一少数民族的总人口数占境内总人口数百分之十五以上的,每一代表所代表的人口数应相当于当地人民代表大会每一代表所代表的人口数。
Where the total population of a minority nationality in such an area is less than 15 percent of the total local population, the number of people represented by each deputy of that minority nationality may be half the number of people represented by each of the other deputies to the local people's congress. In autonomous counties where the population of the minority nationality practicing regional autonomy is exceptionally small, the number of people represented by each deputy of this minority nationality may, upon a decision made by the standing committee of the people's congress of the province or autonomous region, be less than half the number of people represented by each of the other deputies. Other nationalities with exceptionally small populations shall each have at least one deputy. 聚居境内同一少数民族的总人口数不及境内总人口数百分之十五的,每一代表所代表的人口数可以比当地人民代表大会每一代表所代表的人口数少二分之一;实行区域自治的民族人口特少的自治县,经省、自治区的人民代表大会常务委员会决定,可以少于二分之一。人口特少的其他民族,至少应有代表一人。
Article 17 In autonomous regions, autonomous prefectures and autonomous counties, and in townships, nationality townships and towns where a certain minority nationality lives in a concentrated community, the provisions of Article 16 of this Law shall apply to the election to the local people's congresses of deputies of other minority nationalities and the Han nationality also living in concentrated communities in such areas.   第十七条 自治区、自治州、自治县和有少数民族聚居的乡、民族乡、镇的人民代表大会,对于聚居在境内的其他少数民族和汉族代表的选举,适用本法第十六条的规定。
Article 18 With respect to minority nationalities living in scattered groups, the number of people represented by each of their deputies to the local people's congresses may be less than the number of people represented by each of the other deputies to such congresses.   第十八条 散居的少数民族应选当地人民代表大会的代表,每一代表所代表的人口数可以少于当地人民代表大会每一代表所代表的人口数。
In autonomous regions, autonomous prefectures and autonomous counties, and in townships, nationality townships and towns where a certain minority nationality lives in a concentrated community, the provisions of the preceding paragraph shall apply to the election to the local people's congresses of deputies of other minority nationalities and the Han nationality living in scattered groups in such areas. 自治区、自治州、自治县和有少数民族聚居的乡、民族乡、镇的人民代表大会,对于散居在境内的其他少数民族和汉族代表的选举,适用前款的规定。
Article 19 In cities, municipal districts, counties, townships, nationality townships and towns where various minority nationalities live in concentrated communities, the minority nationality electorates may vote separately or jointly in the election of deputies to the local people's congress, depending on the relations between the nationalities, and their residential situation in the localities.   第十九条 有少数民族聚居在境内的市、市辖区、县、乡、民族乡、镇的人民代表大会代表的产生,按照当地的民族关系和居住状况,各少数民族选民可以单独选举或者联合选举。
In autonomous regions, autonomous prefectures and autonomous counties, and in townships, nationality townships and towns where a certain minority nationality lives in a concentrated community, the provisions of the preceding paragraph shall apply to the election to the respective people's congresses of deputies of other minority nationalities and the Han nationality living in such areas. 自治区、自治州、自治县和有少数民族聚居的乡、民族乡、镇的人民代表大会,对于居住在境内的其他少数民族和汉族代表的选举办法,适用前款的规定。
Article 20 The electoral documents, roll of voters, voter registration cards, list of candidates for deputies, deputies election certificates and election committee seals made or published by autonomous regions, autonomous prefectures and autonomous counties shall be in the written languages of the nationalities commonly used in the locality.   第二十条 自治区、自治州、自治县制定或者公布的选举文件、选民名单、选民证、代表候选人名单、代表当选证书和选举委员会的印章等,都应当同时使用当地通用的民族文字。
Article 21 Other matters concerning elections among minority nationalities shall be handled with reference to the provisions of the relevant articles of this Law.   第二十一条 少数民族选举的其他事项,参照本法有关各条的规定办理。
Chapter 5: Zoning of Electoral Districts 

第五章 选区划分

Article 22 The number of deputies to the people's congresses in cities not divided into districts, municipal districts, counties, autonomous counties, townships, nationality townships and towns shall be allocated to the electoral districts, and elections shall be held in the electoral districts. The zoning of electoral districts shall be decided on the basis of production units, institutions, work units, and the voters residence.   第二十二条 不设区的市、市辖区、县、自治县、乡、民族乡、镇的人民代表大会的代表名额分配到选区,按选区进行选举。选区应按生产单位、事业单位、工作单位和居住状况划分。
Chapter 6: Registration of Voters 

第六章 选民登记

Article 23 The registration of voters shall be conducted on the basis of electoral district.   第二十三条 选民登记按选区进行。
Citizens suffering from mental illness and incapable of exercising the right to vote and stand for election shall not be included in the roll of voters. 无法行使选举权和被选举权的精神病患者,不列入选民名单。
Article 24 The roll of voters shall be made public 30 days prior to the date of election, and voter registration cards shall be issued.   第二十四条 选民名单应在选举日前三十天公布,并发给选民证。
Article 25 Anyone who has an objection to the roll of voters may appeal to the election committee. The election committee shall make a decision on the appeal within three days. If the appellant is not satisfied with the decision, he may bring a suit in the people's court. The judgment of the people's court shall be final.   第二十五条 对于公布的选民名单有不同意见的,可以向选举委员会提出申诉。选举委员会对申诉意见,应在三日内作出处理决定。申诉人如果对处理决定不服,可以向人民法院起诉,人民法院的判决为最后决定。
Chapter 7: Nomination of Candidates for Deputies 

第七章 代表候选人的提出

Article 26 Candidates for deputies to the national and local people's congresses shall be nominated on the basis of electoral districts or electoral units.   第二十六条 全国和地方各级人民代表大会的代表候选人,按选区或者选举单位提名产生。
The Communist Party of China, the democratic parties and various people's organizations may either jointly or separately recommend candidates for deputies. Any voter or deputy may, with three or more people supporting his proposal, also recommend a candidate. When a candidate is recommended, the election committee shall be informed of the candidate's background. 中国共产党、各民主党派、各人民团体,可以联合或者单独推荐代表候选人。任何选民或者代表,有三人以上附议,也可以推荐代表候选人。推荐时,应向选举委员会介绍候选人的情况。
Article 27 The number of candidates for deputies to the national and local people's congresses shall be greater than the number of deputies to be elected.   第二十七条 全国和地方各级人民代表大会代表候选人的名额,应多于应选代表的名额。
The number of candidates for deputies to be directly elected by the voters shall be from 50 to 100 percent greater than the number of deputies to be elected; the number of candidates for deputies to be elected by various local people's congresses to the people's congresses at the next higher level shall be from 20 to 50 percent than the number of deputies to be elected. 由选民直接选举的代表候选人名额,应多于应选代表名额的二分之一至一倍;由地方各级人民代表大会选举上一级人民代表大会代表候选人的名额,应多于应选代表名额的五分之一至二分之一。
Article 28 Candidates for deputies to the people's congresses to be directly elected by the voters shall be nominated by the voters in the various electoral districts and units. The election committee shall collect and publish, 20 days prior to the date of election, the list of nominees for deputies by various quarters and the background data on these nominees for repeated discussion and democratic consultation by voter groups in the respective electoral districts. If the number of nominees is too large, a preliminary election may be held to decide upon a formal list of candidates in accordance with the opinion of the majority of voters. The formal list shall be made public five days prior to the date of election.   第二十八条 由选民直接选举的人民代表大会代表候选人,由各选区选民和各单位提名推荐。选举委员会汇总各方面推荐的代表候选人名单和各候选人情况,在选举日前二十天公布并由各该选区的选民小组反复讨论、民主协商,如果所提候选人名额过多,可以进行预选,根据较多数选民的意见,确定正式代表候选人名单,并在选举日前五天公布。
When a local people's congress at or above the county level is to elect deputies to a people's congress at the next higher level, the presidium of the lower people's congress shall collect a list of candidates nominated by its deputies, the Communist Party of China, the democratic parties and various people's organizations, and shall organize all the deputies to hold repeated discussions and democratic consultation on the list. If the number of nominees is too large, a preliminary election may be held to decide upon a formal list of candidates in accordance with the opinion of majority of deputies. 县级以上的地方各级人民代表大会在选举上一级人民代表大会代表时,由各该级人民代表大会主席团汇总大会代表和中国共产党、各民主党派、各人民团体提出的代表候选人名单,组织全体代表反复讨论、民主协商,如果所得候选人名额过多,可以进行预选,根据较多数代表的意见,确定正式代表候选人名单。
Article 29When a local people's congress at or above the county level is to elect deputies to the people's congress at the next higher level, the nominees for deputies shall not be limited to the current deputies to the lower people's congress.   第二十九条 县级以上的地方各级人民代表大会在选举上一级人民代表大会代表时,代表候选人不限于各该级人民代表大会的代表。
Article 30 The election committee shall brief voters on the candidates for deputies. Political parties, people's organizations and voters that have nominated candidates for deputies may brief voters on their candidates at group meetings of voters. However, such briefings must stop on the day of election.   第三十条 选举委员会应当向选民介绍代表候选人的情况。推荐代表候选人的党派、团体或者选民可以在选民小组会议上介绍所推荐的代表候选人的情况。但是在选举日必须停止对代表候选人的介绍。
Chapter 8: Election Procedure 

第八章 选举程序

Article 31 Where the deputies to a people's congress are to be elected directed by the voters, the election shall be conducted at polling centers in the various electoral districts or at election meetings. The polling centers or election meetings shall be presided over by the election committee.   第三十一条 在选民直接选举人民代表大会的代表时,各选区应设立投票站或者召开选举大会进行。投票站或者选举大会由选举委员会主持。
Article 32 Where a local people's congress at or above the county level is to elect deputies to the people's congress at the next higher level, the election shall be presided over by the presidium of the lower people's congress.   第三十二条 县级以上的地方各级人民代表大会在选举上一级人民代表大会代表时,由各该级人民代表大会主席团主持。
Article 33 The election of deputies to the national and local people's congresses shall be by secret ballot.   第三十三条 全国和地方各级人民代表大会代表的选举,一律采用无记名投票的方法。
If a voter is illiterate or handicapped and is therefore unable to write his ballot, he may entrust another person to write it for him. 选民如果是文盲或者因残疾不能写选票的,可以委托他信任的人代写。
Article 34 A voter may vote for or against a candidate for deputy and may vote instead for any other voter or abstain.   第三十四条 选举人对于代表候选人可以投赞成票,可以投反对票,可以另选其他任何选民,也可以弃权。
Article 35 A voter who is absent from his electoral district during the time of an election may, by written authorization, entrust another voter with a proxy vote, but he must first obtain approval from the election committee.   第三十五条 选民如果在选举期间外出的,可以书面委托其他选民代为投票,但事先须经选举委员会认可。
Article 36 When balloting has been concluded, scrutineers and vote-counters elected by the voters, and members of the election committee shall check the number of people who voted against the number of votes cast and make a record of it; the record shall be signed by the scrutineers.   第三十六条 投票结束后,由选民推选的监票、计票人员和选举委员会的人员将投票人数和票数加以核对,作出记录,并由监票人签字。
Article 37 An election shall be null and void if the number of votes cast is greater than the number of people who voted, and it shall be valid if the number of votes cast is less than the number of people who voted.   第三十七条 每次选举所投的票数,多于投票人数的无效,少于投票人数的有效。
A ballot shall be null and void if more candidates are voted for than the number of deputies to be elected, and it shall be valid if fewer candidates are voted for than the number of deputies to be elected. 每一选票所选的人数 , 多于规定应选代表人数的作废,少于规定应选代表人数的有效。
Article 38Candidates for deputies to the people's congresses at all levels shall be elected only if they have obtained more than half of the votes cast by all the voters in the electoral districts or by the representatives of the electoral units.   第三十八条 各级人民代表大会的代表候选人,获得选区全体选民或者选举单位的代表过半数的选票时,始得当选。
When the number of candidates for deputies who have obtained more than half of the votes exceeds the number of deputies to be elected, those who have obtained the most votes shall be elected. If the number of votes for some candidates is tied, making it impossible to determine who is elected, another balloting shall be conducted between those candidates to resolve the tie. 获得过半数选票的代表候选人名额超过应选代表名额时,以得票多的当选。如遇票数相等不能确定当选人时,应当就票数相等的候选人重新投票。
The third paragraph of Article 38 shall be amended as: "If the number of elected deputies who have obtained more than half of the votes is less than the number of deputies to be elected, another election shall be held among the candidates for deputies who failed to be elected, to make up the difference. Those who obtain the most votes shall be elected; however, to be elected they must obtain no less than one third of the votes cast. 获得过半数选票的当选代表的名额少于应选代表的名额时,不足的名额应当在没有当选的代表候选人中另行选举,以得票多的当选,但是得票数不得少于选票的三分之一。
Article 39 The election committee or the presidium of the people's congress shall determine, in accordance with this Law, whether or not the result of an election is valid and shall announce it accordingly.   第三十九条 选举结果由选举委员会或者人民代表大会主席团根据本法确定是否有效,并予以宣布。
Chapter 9: Supervision, Recall and By-elections Held to Fill Vacancies 

第九章 对代表的监督、罢免和补选

Article 40 All deputies to the national and local people's congresses shall be subject to the supervision of the voters and the electoral units which elect them. Both the voters and the electoral units shall have the right to recall the deputies they elect.   第四十条 全国和地方各级人民代表大会的代表,受选民和原选举单位的监督。选民或者选举单位都有权罢免自己选出的代表。
The recall of a deputy directly elected by the voters shall be approved by a majority vote of all the voters in the electoral district from which the deputy was elected; the recall of a deputy elected by a people's congress shall be approved by a majority vote of all the deputies of that people's congress or by a majority vote of all its standing committee members when the people's congress is not in session. A deputy to be recalled may attend the above-mentioned meetings to state his views or submit a written statement of his views. The resolution of a recall shall be reported to the standing committee of the people's congress at the next higher level for the record. 罢免代表,由选民直接选出的,须经原选区过半数的选民通过;由各级人民代表大会选出的,须经各该级人民代表大会过半数的代表通过,在代表大会闭会期间,须经常务委员会过半数的委员通过。 被罢免的代表可以出席上述会议或者书面申诉意见。 罢免的决议,须报送上一级人民代表大会常务委员会备案。
Article 41 Any citizen or unit may demand the recall of a deputy who breaks the law and violates discipline or is found to be seriously negligent of duty.   第四十一条 任何公民或者单位对违法乱纪或者严重失职的代表,都可以提出罢免的要求。
A demand for the recall of a deputy by citizens or units may be submitted to the standing committee of the relevant people's congress. The organ which accepts and hears the case must organize a timely investigation and listen to the accused deputy's statement in his own defense. 公民或者单位要求罢免代表时,可以向各级人民代表大会常务委员会提出。受理机关必须及时组织调查,并应听取被指控代表的申辩。
If the charges against a deputy are substantiated through investigation, his case for recall shall be turned over to the electoral district or electoral unit which elected him. 对代表的指控经查证属实后,提交原选区或者原选举单位罢免。
Article 42 If a deputy's post becomes vacant for some reason during his term of office, the electoral district or electoral unit which elected him shall hold a by-election to fill the vacancy.   第四十二条 代表在任期内,因故出缺,由原选区或者原选举单位补选。
If a deputy to a local people's congress at any level is transferred or moves out of his administrative area during his term of office, he is automatically disqualified as deputy and a by-election shall be held to fill the vacancy. 地方各级人民代表大会代表在任期内调离或者迁出本行政区域的,其代表资格自行终止,缺额另行补选。
When the local people's congresses at or above the county level are not in session, their standing committees may conduct by-elections to fill vacancies left by deputies to the people's congresses at the next higher level. 县级以上的地方各级人民代表大会闭会期间,可以由本级人民代表大会常务委员会补选上一级人民代表大会代表。

第十章 对破坏选举的制裁

Article 43 In order to ensure that the voters freely exercise their right to vote and stand for election, administrative or criminal sanctions shall, in accordance with the law, be taken against persons who commit any of the following illegal acts:   第四十三条 为保障选民自由行使选举权和被选举权,对有下列违法行为的,应当依法给予行政处分或者刑事处分:
(1) use of violence, threat, deception, bribery or other illegal means to disrupt an election or interfere with a voter in the free exercise of his right to vote and stand for election; (一)用暴力、威胁、欺骗、贿赂等非法手段破坏选举或者妨害选民自由行使选举权和被选举权的;
(2) forgery of electoral documents, falsification of vote tallies or other illegal acts; and (二)伪造选举文件、虚报选举票数或者有其他违法行为的;
(3) suppression of or retaliation against anyone who incriminates or informs against a person committing illegal acts in an election or who demands the recall of a deputy. (三)对于控告、检举选举中违法行为的人,或者对于提出要求罢免代表的人进行压制、报复的。

Article 44 The standing committees of the people's congresses of the provinces, autonomous regions, and municipalities directly under the Central Government may formulate rules for the implementation of elections in accordance with this Law and submit them to the Standing Committee of the National People's Congress for the record.   第四十四条 省、自治区、直辖市的人民代表大会常务委员会根据本法可以制定选举实施细则,报全国人民代表大会常务委员会备案。
