The Organizational Rules on the Arbitration of Labor and Personnel Disputes were adopted at the 38th executive meeting of the Ministry of the Human Resources and Social Security on January 19, 2010 and approved by the State Commission Office of Public Sectors Reform, are hereby promulgated and shall be effective as of the date of promulgation.

 
《劳动人事争议仲裁组织规则》已于2010年1月19日经人力资源社会保障部第38次部务会议通过,并商中央机构编制委员会办公室同意,现予公布,自公布之日起施行。

Organizational Rules on the Arbitration of Labor and Personnel Disputes

 
劳动人事争议仲裁组织规则

 
Chapter I General Provisions 第一章 总则

 
Article 1 For purposes of timely resolving labor and personnel disputes, these Rules are formulated in accordance with the Labor Dispute Mediation and Arbitration Law of the People's Republic of China, the Civil Servant Law of the People's Republic of China (hereinafter referred to as the Civil Servant Law), the Regulation on the Civilian Staff of the People's Liberation Army of China and other relevant laws and regulations.   第一条 为公正及时处理劳动、人事争议,根据《中华人民共和国劳动争议调解仲裁法》以及《中华人民共和国公务员法》、《中国人民解放军文职人员条例》等有关法律法规,制定本规则。

 
Article 2 The labor and personnel dispute arbitration committees (hereinafter referred to as the arbitration committees) shall be established by the people's governments according to law for the special purpose of resolving labor and personnel disputes. The working funds for arbitration committees shall be guaranteed by the treasury.   第二条 劳动人事争议仲裁委员会(以下称仲裁委员会)由人民政府依法设立,专门处理劳动、人事争议(以下称争议)案件。仲裁委员会经费依法由财政予以保障。

 
Article 3 An arbitration committee form arbitral tribunals in resolving disputes.   第三条 仲裁委员会处理争议案件实行仲裁庭制度。

 
Article 4 An administrative department of human resources and social security shall be responsible for the mediation and arbitration work within its own administrative area, organize the coordination and handling of trans-regional disputes of widespread influence, and be responsible for the management and training of arbitrators.   第四条 人力资源社会保障行政部门负责指导本行政区域的争议调解仲裁工作,组织协调处理跨地区、有影响的重大争议,负责仲裁员的管理、培训等工作。

 
Chapter II Arbitration Committees and Their Executive Offices 第二章 仲裁委员会及其办事机构

 
Article 5 An arbitration committee shall be established according to the principle of overall planning, reasonable layout and adapting to the actual needs, subject to the decision of the people's government of the province, autonomous region or municipality directly under the Central Government according to law.   第五条 仲裁委员会按照统筹规划、合理布局和适应实际需要的原则设立,由省、自治区、直辖市人民政府依法决定。

 
Article 6 An arbitration committee shall be formed by representatives from the cadres administrative department, administrative department of human sources and social security and other relevant departments, representatives from the army and the administrative department of army civilians, representatives from the labor union, employers' representatives, etc.   第六条 仲裁委员会由干部主管部门代表,人力资源社会保障等相关行政部门代表,军队及聘用单位文职人员工作主管部门代表,工会代表,用人单位代表等组成。

The members of an arbitration committee shall be in odd number.
 
仲裁委员会组成人员应当是单数。

 
Article 7 An arbitration committee shall have a director and 2 or more deputy directors as well as committee members. The director of the arbitration committee shall be assumed by the representative of an administrative department.   第七条 仲裁委员会设主任一名,副主任和委员若干名。仲裁委员会主任由行政部门代表担任。

 
Article 8 An arbitration committee shall perform the following functions:   第八条 仲裁委员会依法履行下列职责:

 
1. To hire and dismiss full-time or part-time arbitrators; (一)聘任、解聘专职或者兼职仲裁员;

 
2. To accept cases of disputes; (二)受理争议案件;

 
3. To discuss major or complicated cases of disputes; and (三)讨论重大或者疑难的争议案件;

 
4. To supervise the arbitration activities. (四)对仲裁活动进行监督。

 
Article 9 An arbitration committee shall hold at least 2 plenary meetings each year to discuss its own performance of functions and the important work matters.   第九条 仲裁委员会应当每年至少召开两次全体会议,研究本委职责履行情况和重要工作事项。

The arbitration committee shall hold a meeting upon proposal of its director or 1/3 or more of its members.
 
仲裁委员会主任或者三分之一以上的仲裁委员会组成人员提议召开仲裁委员会会议的,应当召开。

The arbitration committee shall follow the majority rule when making decisions.
 
仲裁委员会的决定实行少数服从多数原则。

 
Article 10 An arbitration committee may set up a physical office, which undertakes the routine work on the mediation and arbitration of disputes. The naming of the office and the manning of arbitrators and other personnel shall be governed by the relevant provisions of the local people's government.   第十条 仲裁委员会可以下设实体化的办事机构,具体承担争议调解仲裁等日常工作。办事机构名称和仲裁员等工作人员按照地方人民政府规定进行规范和配备。

 
Article 11 The member entities of an arbitration committee may assign part-time arbitrators to work in the executive office and participate in the mediation and arbitration activities.   第十一条 仲裁委员会组成单位可以派兼职仲裁员常驻办事机构,参与争议调解仲裁活动。
