| As decided at the 41st Session of the Standing Committee of the Fourteenth People's Congress of Shanghai Municipality, 12 local regulations including the Regulation of Shanghai Municipality on Greening shall be amended as follows: | | 上海市第十四届人民代表大会常务委员会第四十一次会议决定，对《上海市绿化条例》等12件地方性法规作如下修改： |
| I. Amendments to the Regulation of Shanghai Municipality on Greening | | 一、对《上海市绿化条例》的修改 |
| 1. Article 18 is amended to read: “The design, construction and supervision of greening projects shall comply with the technical standards and specifications of the state and this Municipality for design, construction and supervision, and where there are requirements for qualifications in any laws or administrative regulations, the entities with corresponding qualifications shall undertake the design, construction and supervision of greening projects.” | | 1.将第十八条修改为：“绿化工程的设计、施工、监理，应当符合国家和本市有关设计、施工、监理的技术标准和规范，法律、行政法规有资质要求的，应当由具有相应资质的单位承担。” |
| 2. Article 22 is amended to read: “The entity that organizes the completion acceptance check of a public green space construction project or a construction project containing supporting greening or three-dimensional greening shall notify the municipal or district greening administrative department to participate in the acceptance check. A construction entity shall, within 15 working days from the date when the project passes the acceptance check, submit the completion drawings and the results of the acceptance check to the municipal or district greening administrative department.” | | 2.将第二十二条修改为：“公共绿地和含有配套绿化、立体绿化的建设项目，组织该建设项目竣工验收的单位，应当通知市或者区绿化管理部门参加验收。建设单位应当在验收合格之日起十五个工作日内将竣工图和验收结果报送市或者区绿化管理部门。” |
| 3. Paragraph 2 of Article 25 is amended to read: “Where the safety of pipelines, traffic facilities or other public facilities is affected by the growth of trees, the pipeline or traffic facility administrative entity may notify the need for pruning to the district greening administrative department. The district greening administrative department shall organize the pruning under the principle of ensuring both the safe use of facilities and the normal growth of trees.” | | 3.将第二十五条第二款修改为：“因树木生长影响管线、交通设施等公共设施安全的，管线或者交通设施管理单位可以将修剪需求告知区绿化管理部门。区绿化管理部门应当按照兼顾设施安全使用和树木正常生长的原则组织修剪。” |
| Paragraph 3 of Article 25 is amended to read: “Where pipeline safety is affected by the tilt of trees caused by force majeure or any other emergent accident, the entity owning the pipelines may erect or fell trees first, and, at the same time, report to the district greening administrative department and the green space administrative entity at the place where it is located.” | | 将第二十五条第三款修改为：“因不可抗力或者突发性事故导致树木倾斜影响管线安全的，管线权属单位可以先行扶正或者砍伐树木，并同时向所在地区绿化管理部门和绿地管理单位报告。” |
| 4. Paragraph 6 of Article 28 is amended to read: “A tree removal entity shall conduct the removal in the season suitable for tree growth according to the technical specifications for transplantation. Where the trees fail to survive within a year after being removed, the removal or maintaining entity shall replant corresponding trees. | | 4.将第二十八条第六款修改为：“树木迁移，施工单位应当在适宜树木生长的季节按照移植技术规程进行。树木迁移后一年内未成活的，建设、养护单位应当补植相应的树木。” |
| II. Amendments to the Regulation of Shanghai Municipality on the Administration of Parks | | 二、对《上海市公园管理条例》的修改 |
| 5. Article 11 is amended to read: “The project owner and the construction entity of | | 5.将第十一条修改为：“公园建设项目的建设单位和施工单位应当按备案的设计进行施工，不得任意改变。” |
| a park construction project shall conduct the construction according to the recorded design, and shall not change the design without approval.” | | |

| 6. Item (2) of Article 24 is amended to read: “(2) Failing to undertake the design tasks in light of the qualification grades.” | | |
| | 三、对《上海市古树名木和古树后续资源保护条例》的修改 |
| III. Amendments to the Regulation of Shanghai Municipality on the Protection of Ancient and Famous Trees and the Follow-up Resources of Ancient Trees | | |
| | 7.将第二十条第四款修改为：“古树、名木和古树后续资源的移植和移植后五年内的养护，应当由专业的绿化养护单位进行。古树、名木和古树后续资源的移植费用以及移植后五年内的养护费用，由建设单位承担。” |
| 7. Paragraph 4 of Article 20 is amended to read: “The transplanting of ancient and famous trees and the follow-up resources of ancient trees and the maintenance of such trees after being transplanted within five years shall be conducted by professional greening and maintenance entities. The costs of transplanting of ancient and famous trees and the follow-up resources of ancient trees and the costs of maintenance within five years after the transplanting shall be borne by the project owners.” | | |
| | 8.将第二十三条修改为：“古树、名木和古树后续资源养护责任人发现树木衰萎、濒危的，应当及时向市绿化行政管理部门或者区管理古树名木的部门报告。市绿化行政管理部门或者区管理古树名木的部门应当及时组织专业的绿化养护单位进行复壮和抢救。” |
| 8. Article 23 is amended to read: “Where an entity in charge of maintaining ancient and famous trees and the follow-up resources of ancient trees finds that any tree has decayed or is endangered, it shall report to the municipal administrative department of greening or the district administrative department of ancient and famous trees. The municipal administrative department of greening or the district administrative department of ancient and famous trees shall organize professional greening and maintenance entity to rejuvenate and rescue the tree in a timely manner.” | | |

| 9. Item (5) of Article 25 is deleted. | | |
| | 四、对《上海市计量监督管理条例》的修改 |
| IV. Amendments to the Regulation of Shanghai Municipality on Metrological Supervision and Administration | | |
| | 10.将第十七条第四款修改为：“国家法定计量检定机构的计量检定人员以及被授权单位执行检定任务的人员，必须经考核合格，并使用合格的计量标准器具，按照计量检定规程及其他有关规定，公正、客观、准确地进行计量器具强制检定，不得伪造检定数据。” |

Paragraph 4 of Article 17 is amended to read: “The metrological verification personnel of a statutory metrological verification institution of the state and personnel in an authorized entity who perform the verification tasks shall pass the assessment, and conduct the compulsory verification of measurement instruments in a fair, objective and accurate manner by using qualified standard measurement instruments according to the metrological verification procedures and other relevant provisions, and shall not forge verification data.” | | |
