| CHAPTER I GENERAL PROVISIONS | | 第一条 （目的和依据） |

为了加强对本市律师工作的管理，保障律师依法执业，发挥律师的作用，依据《中华人民共和国律师暂行条例》及有关法律、法规的规定，结合本市实际情况，制定本办法。 |
| Article 1 (Purpose and Basis) | |

凡在本市行政区域内登记、注册的律师和批准设立的律师事务所，均适用本办法。 |

上海市司法行政部门（以下简称市司法行政部门）是本市律师工作的主管部门，其职责是： |
| Article 2 (Scope of Application) | |
|
The present Procedures are applicable to the lawyer registered within | | （一）制定律师行业的发展规划； |
the administrative divisions of Shanghai and to the law office | |

|
| CHAPTER II ADMINISTRATION ORGANIZATION IN CHARGE OF LAWYERS | | （三）授予或者取消律师资格，颁发或者收回《律师工作执照》； |

| Article 3 (Responsible Department) | | （四）决定律师事务所及其分支机构的设立、变更、终止和撤销； |
Shanghai Municipal Judicial Administrative Department (hereinafter | |

referred to as "Municipal Judicial Administrative Department") is the | | （五）指导、监督上海市律师协会的工作。 |
department responsible for the supervision over lawyer's practice. Its | |

| | 第四条 （律师协会） |
| (1) To draw up the development plan for the lawyer's profession; | |
上海市律师协会（以下简称市律师协会）依法由本市律师组成，受市司法行政部门指导、监督，其职责是： |

| (2) To formulate rules and regulations for the supervision over lawyer's | | （一）负责律师的执业登记、注册和律师事务所开业登记、变更登记、注销登记； |
practice; | |
|
| | （二）负责对律师事务所的年度检验，并向有关部门报告年度检验情况； |
| (3) To grant or deprive a lawyer of his/her qualification certificate | |
|
and to issue or revoke "Lawyer's License"; | | （三）保障律师依法执业，维护律师合法权益； |

|
| (4) To decide on the establishment, change, termination and elimination | | （四）指导律师业务活动； |
of a law office and its branches; | |

| (5) To direct and supervise the work of the Shanghai Municipal Bar | |

The district or county judicial administrative departments are | |

responsible for the examination of the applicants applying for the | | （七）按照国家有关规定，组织与境外民间律师团体的交流活动； |
lawyer's qualification certificate within their jurisdiction, for the | |

examination of the establishment and elimination of law offices and | | （八）负责市司法行政部门委托办理的其他律师管理工作。 |
their branches located therein, for the investigation and penalization | |

按照国家有关规定，取得律师资格应当经过必要的考试或者考核。 |
| Article 4 (Bar Association) | |
申请律师资格考试的人员，应当参加全国律师资格考试。对考试合格的人员，其户籍所在地的区、县司法行政部门应当在接到考试合格通知书之日起三十日内提出审核意见后报市司法行政部门。市司法行政部门应当在接到审核意见之日起三十日内作出授予或者不授予律资格的决定。决定授予律师资格的，发给律师资格证书；决定不授予律师资格的，应当书面通知参加考试的人员。 |

| (2) To be responsible for the annual inspection of law offices and for | |

reporting the results of annual inspection to relevant departments; | | （四）其他依法不授予律师资格的情形。 |

| (3) To guarantee lawyer's lawful practice and to protect lawyer's | | 第四章 律师事务所 |
legitimate rights and interests; | |

| | 第七条 （性质） |
| (4) To guide lawyers in their professional activities; | |
律师事务所是律师的执业机构，接受司法行政部门和市律师协会的管理和监督。 |
| |
律师事务所的形式依照国家的有关规定确立。 |
| (5) To be responsible for lawyer's professional training; | |
|
| | 第八条 （设立条件） |
| (6) To be responsible for the education of lawyers in professional | |
设立律师事务所，应当向司法行政部门提出申请，并具备下列条件： |
ethics and law practice discipline, and for supervision and inspection | |

in these fields; | | （一）有律师事务所的名称； |
| |
|
| (7) To organize, in accordance with the relevant provisions of the | | （二）有固定的工作场所； |
State, exchanges with non-governmental lawyers' organizations located | |

outside mainland China; | | （三）有律师事务所的章程； |
| |
|
| (8) To be responsible for other administrative work concerning lawyers | | （四）有三名以上取得律师资格的专职人员； |

| CHAPTER III QUALIFICATION FOR LAWYERS | |
|
| | 第九条 （申请与审批） |
| Article 5 (Granting of Qualification Certificate) | |
申请设立律师事务所，应当向拟设立律师事务所所在地的区、县司法行政部门提出申请。区、县司法行政部门应当在接到申请之日起三十日内提出审核意见报市司法行政部门。市司法行政部门应当在接到审核意见之日起三十日内作出审批决定。批准设立的，由市司法行政部门颁发《律师事务所执业许可证》；不予批准设立的，应当书面通知申请人。 |
