| Article 1 These Provisions are developed in accordance with the Decision of the CPC Central Committee on Deepening the Institutional Reform of the Party and State and the Plan for Deepening the Institutional Reform of the Party and State deliberated and adopted at the Third Plenary Session of the 19th CPC Central Committee, and the State Council Institutional Reform Proposal approved at the First Session of the Thirteenth National People's Congress. | | 第一条 根据党的十九届三中全会审议通过的《中共中央关于深化党和国家机构改革的决定》、《深化党和国家机构改革方案》和第十三届全国人民代表大会第一次会议批准的《国务院机构改革方案》，制定本规定。 |
| Article 2 The National Healthcare Security Administration is an institution directly under the State Council at the deputy ministerial level. | | 第二条 国家医疗保障局是国务院直属机构，为副部级。 |
| Article 3 The National Healthcare Security Administration shall implement the guidelines, policies, decisions and arrangements of the CPC Central Committee on healthcare security, and adhere to and strengthen the Party's centralized and unified leadership over healthcare security in the process of performing its functions. Main functions are as follows: | | 第三条 国家医疗保障局贯彻落实党中央关于医疗保障工作的方针政策和决策部署，在履行职责过程中坚持和加强党对医疗保障工作的集中统一领导。主要职责是： |
| (1) Drawing up draft laws and regulations, policies, plans and standards for medical insurance, maternity insurance, medical assistance and other healthcare security systems, developing departmental rules and organizing the implementation thereof. | | （一）拟订医疗保险、生育保险、医疗救助等医疗保障制度的法律法规草案、政策、规划和标准，制定部门规章并组织实施。 |
| (2) Organizing the development and implementation of the measures for the supervision and administration of healthcare security funds, establishing and improving the security prevention and control mechanisms for healthcare security funds, and promoting the reform of the methods for healthcare security fund payment. | | （二）组织制定并实施医疗保障基金监督管理办法，建立健全医疗保障基金安全防控机制，推进医疗保障基金支付方式改革。 |
(3) Organizing the development of healthcare security financing and treatment policies, improving the dynamic adjustment and regional adjustment and balance mechanisms, making overall planning for urban and rural healthcare security treatment standards, and establishing and improving the treatment adjustment mechanism commensurate with the level of financing; and organizing the drafting and implementation of the plan for the reform of the long-term care insurance system.
