| Article 1 These Provisions are formulated according to the Criminal Law, the Criminal Procedure Law and other relevant provisions for purposes of regulating the seizure and freeze of money and property involved in cases by the people's procuratorates, enhancing the law enforcement level and the case handling quality and protecting the legitimate rights and interests of citizens, legal persons and other organizations. | | 第一条 为了规范人民检察院扣押、冻结涉案款物工作，提高执法水平和办案质量，保护公民、法人和其他组织合法权益，根据刑法、刑事诉讼法及其他有关规定，制定本规定。 |

| Article 2 The “seized or frozen money and property involved in cases” as mentioned in these Provisions shall include illegal proceeds, money and property related to crimes, tools for criminal purpose and illegally held contrabands that are seized and frozen by the people's procuratorates in exercising their prosecutorial functions according to law. | | 第二条 本规定所称扣押、冻结的涉案款物，是指人民检察院在依法行使检察职权过程中扣押、冻结的违法所得、与犯罪有关的款物、作案工具和非法持有的违禁品等。 |
The property obtained by criminal suspects and defendants from their commission of violations and crimes and the fruits thereof shall constitute illegal proceeds. | |

| Article 3 All the property within the meaning of illegal proceeds shall be recovered or a compensation shall be made upon an order for such property. The lawful property of a victim shall be returned to the victim in a timely manner according to law. Contraband and the property for criminal purposes shall be seized or frozen and disposed according to law. | | 第三条 违法所得的一切财物，应当予以追缴或者责令退赔。对被害人的合法财产，应当依法及时返还。违禁品和供犯罪所用的财物，应当予以扣押、冻结，并依法处理。 |

| Article 4 The people's procuratorates must seize, freeze, keep and dispose the money and property involved in cases in strict accordance with law. Seizing or freezing money and property by docketing a false case or any other illegal means shall be strictly prohibited. A people's procuratorate shall not seize or freeze the irrelevant off-book funds which are covertly kept by an entity involved in a case, but may notify the relevant competent authority or the entity's superior to handle the funds. It shall be strictly prohibited to seize or freeze any lawful property irrelevant to a case. | | 第四条 人民检察院扣押、冻结、保管、处理涉案款物，必须严格依法进行。严禁以虚假立案或者其他非法方式扣押、冻结款物。对涉案单位私设账外资金但与案件无关的，不得扣押、冻结，可以通知有关主管机关或者其上级单位处理。严禁扣押、冻结与案件无关的合法财产。 |

| Article 5 It shall be strictly prohibited to seize or freeze money and property before a case is docketed. Where a people's procuratorate finds any money and property suspected of relating to a crime before a case is docketed, if the conditions for docketing a case are met, it shall timely docket the case and take seizure and freeze measures to preserve evidence and prevent the money and property involved in the case from being transferred. | | 第五条 严禁在立案之前扣押、冻结款物。立案之前发现涉嫌犯罪的款物，如果符合立案条件的，应当及时立案，并采取扣押、冻结措施，以保全证据和防止涉案款物转移。 |
Where, before a case is docketed, any individual or entity carries any money and property involved in the case to surrender himself or itself to the people's procuratorate, the people's procuratorate may accept the money and property in advance and issue a receipt to the aforesaid individual or entity, and shall decide whether to seize or freeze the money and property in light of case filing and investigation situations. | |
个人或者单位在立案之前向人民检察院自首时携带涉案款物的，人民检察院可以先行接收，并向自首人开具接收凭证，根据立案和侦查情况决定是否扣押、冻结。 |
A people's procuratorate shall, after seizing or freezing any money and property involved in a case, timely investigate the case, and shall not withdraw the case or stop investigating the case without any statutory reason. | |
人民检察院扣押、冻结涉案款物后，应当对案件及时进行侦查，不得在无法定理由情况下撤销案件或者停止对案件的侦查。 |

| Article 6 When a people's procuratorate seizes and freezes a criminal suspect's or defendant's money and property involved in a case, it shall leave necessary living expenses and articles for the criminal suspect or defendant and his dependents. | | 第六条 人民检察院扣押、冻结犯罪嫌疑人、被告人的涉案款物，应当为犯罪嫌疑人、被告人及其所扶养的家属保留必需的生活费用和物品。 |
The seizure and freeze of an entity's money and property involved in a case shall affect as less as possible the normal work, production, trading and other activities of the entity. | |
扣押、冻结单位的涉案款物，应当尽量不影响该单位正常的办公、生产、经营等活动。 |

| Article 7 The people's procuratorates shall apply the principle of separating the seizure and freeze of money and property from the keeping thereof, and the bookkeeping thereof must be consistent with the actual amount thereof. | | 第七条 人民检察院实行扣押、冻结款物与保管款物相分离的原则，账实必须相符。 |

| Article 8 The seizure, freeze, keeping and disposal of money and property involved in cases by the people's procuratorates shall follow the principle of division of responsibilities and mutual check between the case handling department and the department keeping the money and property, and shall be subject to the supervision by the departments of investigation supervision, public prosecution, accusations and appeals, disciplinary inspection and supervision, etc. | | 第八条 人民检察院扣押、冻结、保管、处理涉案款物，实行办案部门和保管部门分工负责、相互制约的原则，并接受侦查监督、公诉、控告申诉、纪检监察等部门的监督。 |

| Article 9 When a people's procuratorate seizes, freezes, keeps or disposes money and property involved in a case, it shall notify in writing the party concerned or his close relative of his right to make a complaint according to the relevant provisions. | | 第九条 人民检察院扣押、冻结、保管、处理涉案款物，应当书面告知当事人或者其近亲属有权按照有关规定进行投诉。 |
Where a party concerned, any other party of direct interest or a close relative thereof considers that the seizure, freeze, keeping or disposal of money and property involved in a case by a people's procuratorate infringes upon his legitimate rights and interests or violates law, he may make a complaint to the people's procuratorate or directly make a complaint to the people's procuratorate at a higher level. The people's procuratorate receiving the complaint shall, according to the relevant provisions, timely examine and handle the complaint and give a reply. | |
当事人、其他直接利害关系人或者其近亲属认为人民检察院扣押、冻结、保管、处理涉案款物侵犯自身合法权益或者有违法情形的，可以向该人民检察院投诉，也可以直接向其上一级人民检察院投诉。接到投诉的人民检察院应当按照有关规定及时进行审查并作出处理和答复。 |
If, after the close of criminal procedures, any party concerned considers that the people's procuratorate has illegally seized or frozen any money and property involved in the case and applies for criminal compensation, the ongoing complaint procedures shall be terminated, and the department responsible for handling complaints shall transfer the relevant materials to the criminal compensation department. | |
刑事诉讼程序终结后，当事人认为人民检察院违法扣押、冻结涉案款物而申请刑事赔偿的，尚未办结的投诉程序应当终止，负责办理投诉的部门应当将相关材料移交刑事赔偿工作部门。 |

| Article 10 A people's procuratorate's seizure, freeze, keeping and disposal of money and property involved in cases shall be subject to the supervision by the people's supervisors according to the relevant provisions. | | 第十条 人民检察院扣押、冻结、保管、处理涉案款物，应当按照有关规定接受人民监督员的监督。 |

| Article 11 The people's procuratorates shall use the legal documents uniformly made by the Supreme People's Procuratorate when seizing, freezing and disposing money and property involved in cases, must fill out the documents in a standard and complete manner, and must keep complete stubs of documents. | | 第十一条 人民检察院扣押、冻结、处理涉案款物应当使用最高人民检察院统一制定的法律文书，填写必须规范、完备，文书存根必须完整。 |
The “Written Decision on Confiscation”, the “Written Decision on Fine” and other documents not conforming to the relevant provisions shall be prohibited from being used in the seizure, freeze and disposal of money and property involved in cases. | |
禁止使用“没收决定书”、“罚款决定书”等不符合规定的文书扣押、冻结、处理涉案款物。 |

| Article 12 The relevant confidentiality provisions shall be strictly observed in the seizure, freeze, keeping and disposal of money and property involving any state secret, business secret or personal privacy. | | 第十二条 扣押、冻结、保管、处理涉及国家秘密、商业秘密、个人隐私的款物，应当严格遵守有关保密规定。 |

| Chapter II Procedures for the Seizure and Freeze of Money and Property Involved in Cases | | 第二章 扣押、冻结涉案款物的程序 |

| Article 13 The seizure or freeze of money and property involved in a case shall be subject to the approval of the chief prosecutor, and be enforced by two or more procuratorial personnel. | | 第十三条 扣押、冻结涉案款物，应当报经检察长批准，由两名以上检察人员执行。 |
| |
|
| Article 14 Articles usable for proving the guilt or innocence of a criminal suspect, illegally held contraband and money that may be illegal proceeds as found during the course of investigation at the scene, search, detention or arrest shall be seized, whereas money and property irrelevant to the case shall not be seized. If the relevancy of any suspicious money and property to the case cannot be ascertained immediately, such money and property may be seized in advance and be examined and handled according to Article 21 of these Provisions. | | 第十四条 在现场勘查、搜查、拘留、逮捕过程中发现的可用以证明犯罪嫌疑人有罪或者无罪的各种物品，非法持有的违禁品，可能属于违法所得的款项，应当扣押；与案件无关的，不得扣押。不能立即查明是否与案件有关的可疑款物，可以先行扣押并按照本规定第二十一条审查处理。 |
If it is necessary to seize the articles carried by a criminal suspect under control, such articles shall be handled according to the provision of the preceding paragraph. The personal effects irrelevant to the case shall be itemized, and be transferred along with the criminal suspect or returned to his family member. | |
需要扣押犯罪嫌疑人到案时随身携带的物品的，按照前款规定办理。对于与案件无关的个人用品，逐件登记，随人移交或者退还其家属。 |

| Article 15 Where it is necessary to seize or freeze any money and property involved in a case but such money and property are not located within the jurisdiction of the people's procuratorate handling the case, the people's procuratorate handling the case shall, according to the relevant law and these Provisions and upon the strength of the relevant legal documents, case brief and other materials, request the people's procuratorate at the place where such money and property are located to assist the enforcement, and the requested people's procuratorate shall assist the enforcement. | | 第十五条 |
The requested people's procuratorate may raise any objection in respect of the assistance to the people's procuratorate handling the case. If the two sides fail to reach a consensus, they shall, level by level, report it to the people's procuratorates at higher levels for consultation. Where necessary, they shall report it to the common people's procuratorate at a higher level for decision. | |
被请求协助的人民检察院有异议的，可以向办理案件的人民检察院提出。双方达不成一致意见的，应当逐级报请上级人民检察院进行协商；必要时，报请共同的上级人民检察院决定。 |

| Article 16 The procuratorial personnel shall, together with the witness(es) on the spot and the holder of the money and property to be seized, check correctly the money and property to be seized, seize the money and property after they are photographed or videotaped, and issue a list of the seized money and property in quadruplicate on the spot, stating the names, models, specifications, quantity, quality, color, degree of depreciation, package and other main characteristics of the seized articles, to which the procuratorial personnel, the witness(es) and the holder shall affix their signatures or seals. If the holder refuses to affix his signature or seal or is not present, it shall be noted on the list. | | 第十六条 对于扣押的款物，检察人员应当会同在场见证人和被扣押款物持有人查点清楚，经拍照或者录像后予以扣押，并当场开列扣押清单一式四份，注明扣押物品的名称、型号、规格、数量、质量、颜色、新旧程度、包装等主要特征，由检察人员、见证人和持有人签名或者盖章。持有人拒绝签名、盖章或者不在场的，应当在清单上注明。 |
With respect to the seizure or freeze of stocks, bonds, funds, warrants, futures, warehouse receipts, gold, etc. whose market prices fluctuate greatly, the party concerned or his close relative shall be notified in writing of his right to apply for a sale according to paragraph 2 of Article 32 of these Provisions. | |
扣押、冻结市场价格波动较大的股票、债券、基金、权证、期货、仓单、黄金等，应当书面告知当事人或者其近亲属有权按照本规定第三十二条第二款的规定申请出售。 |

| Article 17 With respect to real estate, manufacturing equipment or any other property that shall be seized but cannot be easily taken or need not be taken, the people's procuratorate shall seize the right certificate thereof, seal them up for keeping at the original place after they are photographed or videotaped, or give them to the holder or his close relative for keeping, and issue a list of seizure (sealing up at the original place) in quadruplicate, stating the detailed addresses and the relevant characteristics of the relevant articles and the facts that photographing or videotaping has been made and the right certificates thereof have been seized, to which the procuratorial personnel, the witness(es) and the holder shall affix their signatures or seals. Witness(es) or the holder shall be present at the time of unsealing, and affix his/their signature(s) or seal(s). If the holder refuses to affix his signature or seal or is not present, it shall be noted on the list. | | 第十七条 对于应当扣押但不便提取或者不必提取的不动产、生产设备或者其他财物，应当扣押其权利证书，经拍照或者录像后原地封存，或者交持有人或者其近亲属保管，并开列扣押（原地封存）清单一式四份，注明相关物品的详细地址和相关特征，同时注明已经拍照或者录像以及其权利证书已被扣押，由检察人员、见证人和持有人签名或者盖章。启封时应当有见证人、持有人在场并签名或者盖章。持有人拒绝签名、盖章或者不在场的，应当在清单上注明。 |
If the seized property is given to the holder or his close relative for keeping, the procuratorial personnel shall notify the keeper in writing that the seized property must be properly kept and shall not be transferred, sold, damaged, leased out, mortgaged, donated, etc. | |
被扣押的财物交持有人或者其近亲属保管的，检察人员应当书面告知保管人对被扣押的财物必须妥善保管，不得转移、变卖、毁损、出租、抵押、赠予等。 |

| Article 18 The following money and property seized or frozen by a case handling department shall be handled respectively as follows: | | 第十八条 办案部门扣押、冻结下列款物，应当进行相应的处理： |

(1) With respect to the seizure of foreign currencies, gold, silver, jewelries, cultural relics, works of calligraphy and painting and other valuable articles, the authenticity of which is hard to identify, a list stating the characteristics of the said articles shall be issued, the articles shall be sealed up on the spot after being photographed or videotaped, and the procuratorial personnel, the witness(es) and the holder of the seized articles shall affix their signatures or seals to the sealing-up materials. A qualified department shall be timely authorized to issue an identification report, as necessary for handling the case. The witness(es) or the holder shall be present at the time of unsealing, and affix his/their signature(s) or seal(s);
