Opinions on Further Promoting Open Government and Enhancing Government Services

 
关于深化政务公开加强政务服务的意见

To thoroughly carry out the spirit of the Seventeenth National Congress of the CPC and the Third, Fourth and Fifth Plenary Sessions of the Seventeenth CPC Central Committee, promote the construction of a service-oriented government, a responsible government, a government ruled by law and a clean government, and raise the level of administration according to law and government services, we hereby put forward the following opinions on further promoting open government and enhancing government services:
 
为深入贯彻落实党的十七大和十七届三中、四中、五中全会精神,促进服务政府、责任政府、法治政府、廉洁政府建设,提高依法行政和政务服务水平,现就深化政务公开、加强政务服务提出如下意见。

 
I. Importance and general requirements of further promoting open government and enhancing government services   一、深化政务公开、加强政务服务的重要性和总体要求

 
1. Importance of further promoting open government and enhancing government services. Further promoting open government and enhancing government services are of great significance in boosting the administrative system reform, strengthening the oversight and restriction of administrative powers, preventing corruption at the source and providing efficient and convenient services for the people. Since the Sixteenth National Congress of the CPC, under the strong leadership of the CPC Central Committee and the State Council, open government has been consistently promoted on all fronts, including open government information, open and transparent operation of administrative powers and open business process of public enterprises and institutions, and the government (administrative) service centers have developed rapidly to greatly improve the government function of serving the people. However, there are still some unsolved issues. For example, in respect of open government, some governments give more weight to form than content, some open government information is not complete or is not provided under standard procedures, some governments fail to properly handle the relationship between open information and confidentiality, and the government information sharing mechanism still needs to be improved. In respect of government services, the service system is not consummate, there are no express rules for the operation of service centers, and the open administrative approval and service matters cannot meet the demands of the people. All regions and departments shall attach great importance to resolving these issues, protect the people's right to know and right of supervision, increase efforts in promoting open government, execute openness and transparency through all phases of government services, promote the enhancement of government services through openness, and create conditions to ensure that the people could better understand and oversee the work of government. 1.深化政务公开、加强政务服务的重要性。深化政务公开、加强政务服务,对于推进行政体制改革、加强对行政权力监督制约、从源头上防治腐败和提供高效便民服务,都具有重要意义。党的十六大以来,在党中央、国务院坚强领导下,政务公开不断深化,政府信息公开、行政权力公开透明运行、公共企事业单位办事公开全方位推进,政务(行政)服务中心(以下简称服务中心)发展迅速,服务群众功能不断完善。但是,工作中也还存在一些问题,主要是:政务公开方面,有的存在重形式轻内容现象,有的公开内容不全面、程序不规范,有的不能妥善处理信息公开与保守秘密的关系,政府信息共享机制不够健全;政务服务方面,服务体系建设不够完善,服务中心运行缺乏明确规范,公开办理的行政审批和服务事项不能满足群众需求等。各地区各部门要高度重视解决这些问题,坚持保障人民群众的知情权和监督权,加大推进政务公开力度,把公开透明的要求贯穿于政务服务各个环节,以公开促进政务服务水平的提高,创造条件保障人民群众更好地了解和监督政府工作。

 
2. General requirements of further promoting open government and enhancing government services. We shall follow the guidance of Deng Xiaoping Theory and the importance thought of “Three Represents”, thoroughly carry out the Scientific Outlook on Development, adhere to the people orientation and governance for the benefit of people, adhere to focusing on the central task and serving the bigger picture, and under the requirements of deepening the reform of administrative systems, transform government functions and promote the standardization of procedures and open and transparent operation of administrative powers. We shall, under the requirements of “regarding openness as general rule and confidentiality as exception,” timely, accurately and completely publish government information that the people are commonly concerned about or involves the vital interests of the people. We shall, under the requirements of bringing conveniences and benefits to the people, further improve government services, raise administrative efficiency, promote the construction of the government service system, and provide quality, convenient and efficient services for the people. 2.深化政务公开、加强政务服务的总体要求。要以邓小平理论和“三个代表”重要思想为指导,深入贯彻落实科学发展观,坚持以人为本、执政为民,坚持围绕中心、服务大局,按照深化行政体制改革的要求,转变政府职能,推进行政权力运行程序化和公开透明;按照公开为原则、不公开为例外的要求,及时、准确、全面公开群众普遍关心、涉及群众切身利益的政府信息;按照便民利民的要求,进一步改进政务服务,提高行政效能,推进政务服务体系建设,为人民群众提供优质便捷高效服务。

 
II. Further promoting open government through reform and innovation   二、以改革创新精神深化政务公开工作

 
3. Innovating in the ways and means of open government. We shall insist on the principle of “providing convenient information for the people and facilitating oversight by the people,” broaden the areas of work, provide more open information, enrich the ways of disclosure, and promote the government's own development and administrative innovations. We shall differentiate circumstances to offer classified guidance, and improve the relevance and efficacy of open government. We shall innovate in carriers, improve rules, and realize the standardization of open government. We shall hear public opinions in administration, learn the demands of the people, ask for suggestions from the people, rely on the active support and wide participation from the people, ensure smooth channels for interaction between the government and people, and effectively improve the social effects of open government. 3.创新政务公开方式方法。坚持方便群众知情、便于群众监督的原则,拓宽工作领域,深化公开内容,丰富公开形式,促进政府自身建设和管理创新。坚持区别情况、分类指导,提高政务公开的针对性和有效性。坚持创新载体、完善制度,实现政务公开的规范化、标准化。坚持问政于民、问需于民、问计于民,依靠群众积极支持和广泛参与,畅通政府和群众互动渠道,切实提高政务公开的社会效益。

 
4. Promoting open administrative decision-making. We shall make scientific and democratic decisions according to law, establish and improve a decision-making mechanism which reflects the requirements of people orientation and governance for the benefits of the people, gradually expand the field and scope of open administrative decision-making, and promote the open process and result of administrative decision-making. For important reform plans, major policies and measures and key projects which involve the vital interests of the people, public opinions shall be extensively solicited before decisions are made, and feedback shall be given in an appropriate manner or a public announcement shall be made on the adopted opinions. We shall improve the procedures and rules for major administrative decision-making, standardize the public participation, expert demonstration, risk assessment, legality review and collective discussion and decision as necessary procedures, and increase the transparency of and public participation in the making of public policies. 4.推行行政决策公开。坚持依法科学民主决策,建立健全体现以人为本、执政为民要求的决策机制,逐步扩大行政决策公开的领域和范围,推进行政决策过程和结果公开。凡涉及群众切身利益的重要改革方案、重大政策措施、重点工程项目,在决策前要广泛征求群众意见,并以适当方式反馈或者公布意见采纳情况。完善重大行政决策程序规则,把公众参与、专家论证、风险评估、合法性审查和集体讨论决定作为必经程序加以规范,增强公共政策制定透明度和公众参与度。

 
5. Promoting the open and transparent operation of administrative powers. We shall insist on exercising powers according to law, actively promote the standardization of procedures and open and transparent operation of administrative powers, and ensure that administrative organs and civil servants perform their duties diligently in strict accordance with the functions prescribed by law. We shall, according to the requirements of “statutory authority and legal procedures,” review and organize administrative functions according to law, prepare a directory of administrative functions to clarify the holder of, the basis for, the operational procedures of, the supervisory measures for, etc. of administrative powers, and make it available to the public. We shall strictly regulate the exercise of administrative discretion, detail and quantify the basic criteria for discretion, and publish the scope, types and extent of discretion. We shall focus on publishing information on the performance of duties by administrative organs in such law enforcement activities as administrative licensing, administrative punishment, administrative charges and administrative expropriation, and actively explore the rules on publishing law enforcement complaints and results. 5.推进行政权力公开透明运行。坚持依法行使权力,积极推进行政权力运行程序化和公开透明,确保行政机关和公务员严格依照法律规定的权限履职尽责。按照职权法定、程序合法的要求,依法梳理审核行政职权,编制行政职权目录,明确行使权力的主体、依据、运行程序和监督措施等,并向社会公布。严格规范行政裁量权行使,细化、量化裁量基准,公开裁量范围、种类和幅度。重点公开行政机关在实施行政许可、行政处罚、行政收费、行政征收等执法活动中履行职责情况,积极探索执法投诉和执法结果公开制度。

 
6. Increasing efforts in open administrative examination and approval. A region or department shall disclose its catalogue of administrative examination and approval items which do not involve state secrets, business secrets and personal privacy, and continue to review, adjust and reduce administrative examination and approval items. Without any basis in laws and regulations, no administrative organ may set up directly or indirectly any administrative licensing item or any examination and approval item other than administrative licensing. We shall further reduce examination and approval items, optimize the workflow, publish the handling procedures, strengthen the process monitoring, and establish a dynamic management system for administrative examination and approval items. We shall gradually centralize the examination and approval function and the examination and approval items to the service centers for open processing, and establish and improve an operating mechanism of “mutual coordination and restriction of decision-making, execution and supervision.”

 6.加大行政审批公开力度。公布本地区本部门不涉及国家秘密、商业秘密和个人隐私的行政审批项目目录,继续清理、调整和减少行政审批事项。没有法律法规依据,行政机关不得设置或变相设置行政许可事项和非行政许可审批事项。进一步减少审批事项,优化工作流程,公开办理程序,强化过程监控,建立行政审批事项的动态管理制度。逐步依法将审批职能和审批事项集中到服务中心公开办理,建立健全决策、执行、监督相互协调又相互制约的运行机制。
