| (Adopted at the 1315th meeting of the Adjudicative Committee of the Supreme People's Court on May 18, 2004. | In order to correctly hear the cases of confirming tortious delinquencies of the people's court in trials and enforcement, the present Provisions are formulated in accordance with the State Compensation Law of the People's Republic of China and other relevant laws. | | 为正确审理人民法院在审判和执行中违法侵权的确认案件，根据《中华人民共和国国家赔偿法》及有关法律制定本规定。 |
| Article 1 Where a citizen, legal person or any other organization believes that the work-related conduct of the people's court or its functionaries has infringed upon his (its) legitimate rights and interests, before it claims for state compensation, he (it) shall apply for confirmation in accordance with the law with the exceptions as listed in Article 5 of the present Measures. | | 第一条 公民、法人或者其他组织认为人民法院及其工作人员的职务行为侵犯其合法权益提起国家赔偿请求的，除本规定第五条规定的情形外，应当依法先行申请确认。 |
| Article 2 Where a citizen, legal person or any other organization applies for state compensation because he (it) alleges that the people's court or any of its functionaries violates the law in exercising their duties, he (it) shall be the applicant for confirmation. | | 第二条 公民、法人或者其他组织认为人民法院及其工作人员违法行使职权申请确认的是确认申请人。 |
| A confirmation application shall be accepted by the people's court that makes a judicial act, but an application for confirming the judicial act of a grassroots people's court as illegal shall be accepted by the intermediate people's court. | | 申请确认由作出司法行为的人民法院受理，但申请确认基层人民法院司法行为违法的案件，由中级人民法院受理。 |
| Article 3 A confirmation application that meets the following conditions shall be accepted: | | 第三条 具备下列条件的，应予立案： |
| (1) The confirmation applicant shall meet the qualifications for a claimant of state compensation as stipulated in Article 18 of the State Compensation Law of the People's Republic of China; | | （一）确认申请人应当具有《中华人民共和国国家赔偿法》第十八条规定的国家赔偿请求人资格； |
| (2) Having specific confirmation pleadings and infringement facts and reasons; | | （二）有具体的确认请求和损害事实、理由； |
| (3) The confirmation applicant shall apply for confirmation within 2 years from the day when the judicial act is committed or when he (it) is or should be aware of the judicial act; | | （三）确认申请人申请确认应当在司法行为发生或者知道、应当知道司法行为发生之日起两年内提出； |
| (4) It is under the jurisdiction of the people's court that accepts the confirmation application. | | （四）属于受理确认申请的人民法院管辖。 |
| Article 4 A confirmation application shall not be accepted if: | | 第四条 具有下列情形之一的确认申请，不予受理： |
| 1. in accordance with the law, the applicant shall lodge an appeal or applies for retrial through the adjudicative supervision procedures; | | （一）依法应当通过审判监督程序提出申诉或者申请再审的； |
| 2. the pleadings in the application have been accepted and are being investigated by the judicial organ; | | （二）申请事项属于司法机关已经立案正在查处的； |
| 3. it is the personal conduct of a functionary of the people's court which has nothing to do with his exercise of power; | | （三）人民法院工作人员的行为与行使职权无关的； |
| 4. it is under any of the circumstances as stipulated in Article 210 of the Civil Procedure Law of the People's Republic of China; or | | （四）属于《中华人民共和国民事诉讼法》第二百一十条规定情形的； |
| 5. it is under any other circumstance that is beyond the confirmation scope according to law. | | （五）依法不属于确认范围的其他情形。 |
| Article 5 A judgment, ruling or decision made by the people's court under any of the following circumstances belongs to lawful confirmation. A party concerned may apply for state compensation on the basis of this judgment, ruling or decision: | | 第五条 人民法院作出的下列情形之一的判决、裁定、决定，属于依法确认，当事人可以根据该判决、裁定、决定提出国家赔偿申请： |
(1)The decision of arrest has been revoked according to law with the exception as stipulated in Article 15 of the Criminal Procedural Law of the People's Republic of China;
