关于建立和完善执行联动机制若干问题的意见 |
To thoroughly carry out the spirit of the instructions of the CPC Central Committee on tackling difficulties in enforcement, form a new pattern of enforcement work which is led by the Party committees, overseen by the people's congresses and supported by the governments and relies on the coordination and cooperation of all walks of life, establish a sound long-term effect mechanism for solving enforcement difficulties, ensure the effective implementation of effective legal documents, tangibly protect the legitimate rights and interests of citizens, legal persons and other organizations, maintain the authority and solemnity of law, and promote the building of a social good faith system, we hereby put forward the following opinions on establishing a sound mechanism of joint efforts in enforcement, in accordance with the provisions of the relevant laws and policies. | |
为深入贯彻落实中央关于解决执行难问题的指示精神，形成党委领导、人大监督、政府支持、社会各界协作配合的执行工作新格局，建立健全解决执行难问题长效机制，确保生效法律文书得到有效执行，切实维护公民、法人和其他组织的合法权益，维护法律权威和尊严，推进社会诚信体系建设，依据有关法律、政策规定，现就建立和完善执行联动机制提出以下意见。 |

| Article 1 The disciplinary inspection or supervision organ shall organize a timely inspection on clues to a violation of law or discipline by any Party member or administrative supervisee which obstructs the enforcement work of a people's court or unlawfully intervenes in the enforcement work of a people's court as found during enforcement and transferred by the people's court; and when necessary, shall file a formal case for investigation. Where any Party member or administrative supervisee obstructs or unlawfully intervenes in the enforcement work of a people's court or refuses to fulfill any obligation determined in an effective legal document, he shall be subject to a disciplinary action taken by the Party or an administrative disciplinary action pursuant to law. | | 第一条 纪检监察机关对人民法院移送的在执行工作中发现的党员、行政监察对象妨碍人民法院执行工作和违反规定干预人民法院执行工作的违法违纪线索，应当及时组织核查；必要时，应当立案调查。对于党员、行政监察对象妨碍人民法院执行工作或者违反规定干预人民法院执行工作，以及拒不履行生效法律文书确定义务的，应当依法依纪追究党纪政纪责任。 |

| Article 2 The organization or personnel department shall timely know information on refusal to fulfill an effective legal document or unlawful intervention in or obstruction of enforcement by a Party member or civil servant in various ways such as exposure through complaints by letters and visits of the people and performance review or evaluation of officials. It shall urge such a Party member or civil servant to make timely correction, in the form of admonitory talk, inquiry by letter, etc. A Party member or civil servant who refuses to fulfill an effective legal document or unlawfully intervenes in or obstructs enforcement shall be dealt with in accordance with the Regulation of the Communist Party of China on Disciplinary Actions, the Regulation on the Disciplinary Actions against Civil Servants of Administrative Organs and other relevant provisions. | | 第二条 组织人事部门应当通过群众信访举报、干部考察考核等多种途径，及时了解和掌握党员、公务员拒不履行生效法律文书以及非法干预、妨害执行等情况，对有上述问题的党员、公务员，通过诫勉谈话、函询等形式，督促其及时改正。对拒不履行生效法律文书、非法干预或妨碍执行的党员、公务员，按照《中国共产党纪律处分条例》和《行政机关公务员处分条例》等有关规定处理。 |

| Article 3 The press or publicity department shall strengthen the publicity of the enforcement work of the people's courts, educate and guide all walks of life on the formation of a sense of good faith, and create a good atmosphere of voluntarily fulfilling the obligations determined in effective legal documents and legally assisting the people's courts in enforcement. It shall adhere to a correct public opinion orientation, and raise the risk awareness of the market participants. It shall cooperate with the people's courts in establishing a system to timely expose a list of the parties against whom enforcement is sought as authorized by a people's court and other acts of intervention in or obstruction of enforcement. | | 第三条 新闻宣传部门应当加强对人民法院执行工作的宣传，教育引导社会各界树立诚信意识，形成自觉履行生效法律文书确定的义务、依法协助人民法院执行的良好风尚；把握正确的舆论导向，增强市场主体的风险意识。配合人民法院建立被执行人公示制度，及时将人民法院委托公布的被执行人名单以及其他干扰、阻碍执行的行为予以曝光。 |

| Article 4 The comprehensive management department shall include the concerns and support given by the local Party committee, people's congress, government and CPPCC committee in respect of the enforcement work of the people's courts, the repayment of debts by the judgment debtors, especially those special debtors, the assistance legally provided by the relevant departments in enforcement, the application of the enforcement remedy fund, etc. in its scope of assessment of the goals and responsibilities for the comprehensive management of public security. It shall establish a sound grassroots enforcement assistance network, give full play to the role of grassroots organizations, and cooperate with the people's courts in doing a good job of enforcement. | | 第四条 综合治理部门应当将当地党委、人大、政府、政协重视和支持人民法院执行工作情况、被执行人特别是特殊主体履行债务情况、有关部门依法协助执行的情况、执行救助基金的落实情况等，纳入社会治安综合治理目标责任考核范围。建立健全基层协助执行网络，充分发挥基层组织的作用，配合人民法院做好执行工作。 |

| Article 5 The procuratorial organ shall, pursuant to law, timely and strictly prosecute anyone on charge of refusing to execute a court judgment or ruling or otherwise obstructing enforcement, and legally investigate and deal with cases of duty-related crimes such as malfeasance, infringement upon right or property, corruption, bribery, etc. | | 第五条 检察机关应当对拒不执行法院判决、裁定以及其他妨害执行构成犯罪的人员，及时依法从严进行追诉；依法查处执行工作中出现的渎职侵权、贪污受贿等职务犯罪案件。 |

Article 6 The public security organ shall severely crack down on illegal or criminal activities involving refusal to execute a court judgment or ruling or any other obstruction of enforcement, and for an obstruction of or defiance to enforcement by violence or threat, shall send over police officers immediately after notification by the people's court and deal with it pursuant to law. Where it assists a people's court in inquiring about the household registration information and whereabouts of the party against whom enforcement is sought and finds during its performance of duties the party who needs to be detained or summoned by force by the people's court, it shall timely notify the people's court of the relevant information; and shall timely take into custody a person against whom a detention decision has been made by the people's court in enforcement. It shall assist a people's court in restricting a person against whom enforcement is sought from leaving this country, assist a people's court in conducting the registration formalities for the seizure, detention and transfer of vehicles, and when finding the vehicles and other property of the party against whom enforcement is sought, timely notify the people's court in charge of enforcement of the relevant information.
