| During the process of implementing the Law of the People's Republic of China on People's Assessors (hereinafter referred to as the “Law on People's Assessors”) and the supporting regulatory documents, some localities requested for instructions on some related issues. Upon deliberation, a reply is hereby given as follows: | | 在《中华人民共和国人民陪审员法》（以下简称《人民陪审员法》）及配套规范性文件实施过程中，部分地方就有关问题进行请示，经研究，现答复如下： |
| 1. How does a court of the Production and Construction Corps of Xinjiang Uygur Autonomous Region select people's assessors? | | 1.新疆维吾尔自治区生产建设兵团法院如何选任人民陪审员？ |
| The number of people's assessors of a grass-roots people's court of the Production and Construction Corps without a corresponding people's congress at the same level shall be determined by the Production and Construction Corps Branch of the Higher People's Court of Xinjiang Uygur Autonomous Region. The candidates of people's assessors who are decided after publicity shall be submitted by the chief judge of the grass-roots people's court to the Production and Construction Corps Branch of the Higher People's Court of Xinjiang Uygur Autonomous Region for appointment. In reclamation areas where no local justice bureaus are established, the justice bureaus at the division (municipality) level may, in conjunction with the people's courts and the public security organs at the level of the reclamation areas, carry out the selection of people's assessors. | | 答：没有对应同级人民代表大会的兵团基层人民法院人民陪审员的名额由兵团分院确定，经公示后确定的人民陪审员人选，由基层人民法院院长提请兵团分院任命。在未设立垦区司法局的垦区，可以由师（市）司法局会同垦区人民法院、公安机关组织开展人民陪审员选任工作。 |

| Except as otherwise prohibited by the law, a member of the presidium of a township people's congress who meets the requirements for serving as a people's assessor may serve as a people's assessor if he or she is not a member of the standing committee of the people's congress at a higher level. | | 答：符合担任人民陪审员条件的乡镇人民代表大会主席团成员，不是上级人民代表大会常务委员会组成人员的，可以担任人民陪审员，法律另有禁止性规定的除外。 |
| 4. Can a staff member of the standing committee of a people's congress serve as a people's assessor? | | 4.人民代表大会常务委员会的工作人员能否担任人民陪审员？ |
| Except as otherwise prohibited by the law, a staff member of the standing committee of a people's congress who meets the requirements for serving as a people's assessor may serve as a people's assessor. | | 答：人民代表大会常务委员会的工作人员，符合担任人民陪审员条件的，可以担任人民陪审员，法律另有禁止性规定的除外。 |
5. Can members of the standing committees of people's congresses, judges, procurators, other staff members of people's courts and people's procuratorates, and staff members of supervisory committees, public security organs, national security organs and administrative organs of justice serve as people's assessors after leaving their posts?
