For the purposes of safeguarding judicial impartiality and integrity and preventing conflicts between the private interests of leaders and trial and enforcement personnel of courts and the public interest, these Provisions are developed in accordance with the Civil Servant Law of the People's Republic of China, the Judges Law of the People's Republic of China | | 为了维护司法公正和司法廉洁，防止法院领导干部和审判执行人员私人利益与公共利益发生冲突，依照《中华人民共和国公务员法》《中华人民共和国法官法》等法律法规，结合人民法院实际，制定本规定。 |
| Article 1 Where the spouse, parent, child, sibling, spouse's parent, spouse's sibling, child's spouse, or parent of child's spouse of a staff member of a people's court is a lawyer, the staff member shall actively report to the organization (personnel) department of the people's court. | | 第一条 人民法院工作人员的配偶、父母、子女、兄弟姐妹、配偶的父母、配偶的兄弟姐妹、子女的配偶、子女配偶的父母具有律师身份的，该工作人员应当主动向所在人民法院组织（人事）部门报告。 |
| Article 2 A leader or a trial or enforcement person of a people's court whose spouse, parent or child falls under any of the following circumstances shall be subject to office disqualification. | | 第二条 人民法院领导干部和审判执行人员的配偶、父母、子女有下列情形之一的，法院领导干部和审判执行人员应当实行任职回避： |
| (1) He or she serves as a partner or founder of a law firm within the jurisdiction of the people's court where the leader or the trial or enforcement person holds a position. | | （一）担任该领导干部和审判执行人员所任职人民法院辖区内律师事务所的合伙人或者设立人的； |
| (2) He or she serves as the litigation representative or defender in the capacity of a lawyer within the jurisdiction of the people's court where the leader or the trial or enforcement person holds a position, or provides other paid legal services to parties to litigation cases. | | （二）在该领导干部和审判执行人员所任职人民法院辖区内以律师身份担任诉讼代理人、辩护人，或者为诉讼案件当事人提供其他有偿法律服务的。 |
Article 3 A people's court shall not select or determine a person who meets the office disqualification conditions as a candidate for a leader or a trial or enforcement person of the court.
