| | 原告长城公司诉称：2013年9月18日，其与南京仟泰物业管理有限公司签订《社区宽带互联接入合作运营协议》。后其依照协议在南方花园小区布线施工。2014年 9月27日，其工作人员发现前述小区内其铺设的多处光缆被剪断(5653米4芯光缆以及 1056米48芯光缆)，1309米双绞线被剪断抽出带走，其工作人员向110报警。经南京市公安局江宁分局岔路派出所查实系被告铁通南京分公司工作人员剪断光缆以及双绞线。后经派出所调解未果，故其请求法院判令铁通南京分公司将剪断的光缆以及双绞线恢复原状并承担本案案件受理费。 |
| | 被告铁通南京分公司辩称：2014年9月，其工作人员在例行巡检中发现有所有权不明的废旧缆线，于是进行了清除，现无证据证实原告长城公司系缆线的所有权人。即便长城公司是缆线的所有权人，根据中国铁通集团有限公司江苏分公司(以下简称铁通江苏分公司)与江苏经纬房地产有限公司2001年10月25日签订的《经纬房产南方花园C组电话协议书》，其公司对南方花园小区C组团内户外管道以及楼内户线通道享有专有使用权，长城公司无权在其专属通信管道内铺设光缆。综上，请求驳回长城公司对其的诉讼请求。 |

| | 2013年9月18日，原告长城公司(甲方)与南京仟泰物业管理有限公司(乙方，以下简称仟泰公司)签订《社区宽带互联接入业务合作运营协议》1份，约定：甲乙双方在南方花园小区共同建设社区宽带网络；甲方承担信息化社区的网络工程建设的投资、设计、施工、维护以及技术改造，为该小区提供互联网宽带接入服务；甲方有权使用社区内现有的网络线路、设备。后长城公司在南方花园小区的户外通信管道以及楼内户线通道内进行了缆线的铺设。2014年9月，被告铁通南京分公司工作人员将长城公司在南方花园小区C组团铺设的合计总长5653米4芯光缆、1056米48芯光缆以及1309米双绞线剪断并将其中的双绞线抽出带走。长城公司工作人员发现缆线被剪断以及丢失后于2014年9月27日报警，南京市公安局江宁分局岔路派出所处警。 |
