| In a case of disclosure of government information, if defendant replies to plaintiff on the grounds that the government information does not exist, the people's court shall examine whether defendant has fulfilled the obligation of sufficient and reasonable search and retrieval. When plaintiff submits the prima facie evidence of the clue to that the government information is prepared or preserved by defendant, if defendant is unable to provide evidence to the contrary and produce evidence of sufficient and reasonable fulfillment of the obligation of search and retrieval, the people's court shall grant no support for the claim of defendant that the relevant government information does not exist. | | 在政府信息公开案件中，被告以政府信息不存在为由答复原告的，人民法院应审查被告是否已经尽到充分合理的查找、检索义务。原告提交了该政府信息系由被告制作或者保存的相关线索等初步证据后，若被告不能提供相反证据，并举证证明已尽到充分合理的查找、检索义务的，人民法院不予支持被告有关政府信息不存在的主张。 |

| | 原告罗元昌是兴运2号船的船主，在乌江流域从事航运、采砂等业务。2014年11月17日，罗元昌因诉重庆大唐国际彭水水电开发有限公司财产损害赔偿纠纷案需要，通过邮政特快专递向被告重庆市彭水苗族土家族自治县地方海事处（以下简称“彭水县地方海事处”）邮寄书面政府信息公开申请书，具体申请的内容为：1.公开彭水苗族土家族自治县港航管理处（以下简称“彭水县港航处”）、彭水县地方海事处的设立、主要职责、内设机构和人员编制的文件。2.公开下列事故的海事调查报告等所有事故材料：兴运2号在2008年5月18日、2008年9月30日的2起安全事故及鑫源306号、鑫源308号、高谷6号、荣华号等船舶在2008年至2010年发生的安全事故。 |
| | 彭水县地方海事处于2014年11月19日签收后，未在法定期限内对罗元昌进行答复，罗元昌向彭水苗族土家族自治县人民法院（以下简称“彭水县法院”）提起行政诉讼。2015年1月23日，彭水县地方海事处作出（2015）彭海处告字第006号《政府信息告知书》，载明：一是对申请公开的彭水县港航处、彭水县地方海事处的内设机构名称等信息告知罗元昌获取的方式和途径；二是对申请公开的海事调查报告等所有事故材料经查该政府信息不存在。彭水县法院于2015年3月31日对该案作出（2015）彭法行初字第00008号行政判决，确认彭水县地方海事处在收到罗元昌的政府信息公开申请后未在法定期限内进行答复的行为违法。 |
