| | 2018年9月2日，刘某在天猫网站上某酒类专营店（以下简称专营店）购买一款促销产品--XXX高粱酒，促销价为1257元/瓶。刘某共购买了5瓶，合计支付货款6285元。专营店在该酒详情页中“是否为有机食品”一栏标注为“是”。刘某于9月5日收到货物后，对该款酒到底是否为有机食品产生怀疑，要求专营店提供证明该款酒为有机食品的认证文件，专营店表示无法提供。刘某认为专营店存在虚假宣传，构成欺诈，故起诉至法院，要求专营店按照消费者权益保护法“退一赔三”的规定，退还其货款6285元并赔偿18855元，合计25140元。法院审理认为，商品是否为“有机”食品，必须经过有关认证机构予以认定。刘某在购买案涉高粱酒时，该酒类专营店在商品详页中“是否为有机食品”一栏标注为“是”，可以认定在交易发生时，专营店的错误标注误导了消费者的购买行为，存在欺诈情形，故依据《消费者权益保护法》相关规定，对刘某的诉讼请求予以支持。 |
