Basic Facts 基本案情
Plaintiffs Zhang Qingfu and Zhang Diankai alleged that: On January 9, 2017, defendant Zhu Zhenbiao drove an Audi-branded vehicle to chase Zhang Yonghuan riding a motorcycle. Later, Zhang Yonghuan abandoned his motorcycle and continued the flight, and defendant Zhu Zhenbiao also got off and continued the chase, eventually causing Zhang Yonghuan to be killed in a collision with a train in location 90 kilometers plus 495 meters (Luannan Section) on the Qiancao Line. In the process of the chase, Zhu Zhenbiao disseminated and transmitted the misinformation that Zhang Yonghuan ran into and killed a person. After Zhang Yonghuan said that he would commit suicide and attempted it, Zhu Zhenbiao proceeded with the chase nevertheless in excess of necessity. In the course of the chase, Zhu Zhenbiao carried a wooden stool and wooden stick in the hand, which posed a threat to the life of Zhang Yonghuan, and verbally abused him several times. Since Zhu Zhenbiao was subjectively intentional and manifestly at fault with respect to the death of Zhang Yonghuan, he should be liable to compensate for the latter's death. 原告张庆福、张殿凯诉称: 2017年1月9日,被告朱振彪驾驶奥迪小轿车追赶骑摩托车的张永焕。后张永焕弃车在前面跑,被告朱振彪也下车在后面继续追赶,最终导致张永焕在迁曹线90公里495米处(滦南路段)撞上火车身亡。朱振彪在追赶过程中散布和传递了张永焕撞死人的失实信息;在张永焕用语言表示自杀并撞车实施自杀行为后,朱振彪仍然追赶,超过了必要限度;追赶过程中,朱振彪手持木凳、木棍,对张永焕的生命造成了威胁,并数次漫骂张永焕,对张永焕的死亡存在主观故意和明显过错,对张永焕死亡应承担赔偿责任。
Defendant Zhu Zhenbiao contended that as his act of chasing Zhang Yonghuan, the hit-and-run motorcyclist, was that of doing boldly what is righteous, for which defendant was not at fault subjectively, illegal objectively, and there is no causation between this act and the death of Zhang Yonghuan, and thus defendant did not have tort liability for the accidental death of Zhang Yonghuan.
