| I. Basic Facts | | （一）基本案情 |
| The business scope of defendant entity Guizhou Hongtai Chemical Co., Ltd. (hereinafter referred to as “Hongtai Company”) included mining of barytes and production and sales of barium sulfate, barium carbonate, and barium nitrate. Since 2014, defendant Zhang Zhengwen has been the vice-general manager and director of the executive office of Hongtai Company and assisted the general manager in dealing with the routine work of the Company. Since 2014, defendant Zhao Qiang has been special person in charge of environmental protection of Hongtai Company and he took charge of work related to environmental protection and fire control. | | 被告单位贵州宏泰化工有限责任公司（以下简称“宏泰公司”），经营范围为重晶石开采和硫酸钡、碳酸钡、硝酸钡生产销售等。被告人张正文自2014年起任宏泰公司副总经理兼办公室主任，协助总经理处理全厂日常工作。被告人赵强自2014年起任宏泰公司环保专员，主管环保、消防等工作。 |
| ．．．．．． | | 宏泰公司主要业务之一为生产化工原料碳酸钡，生产产生的废渣有氮渣和钡渣。氮渣属一般废弃物，钡渣属危险废物。宏泰公司在贵州省紫云自治县猫营镇大河村租赁土地堆放一般废弃物氮渣，将危险废物钡渣销往有危险废物经营许可证资质的企业进行处置。2014年底，因有资质企业经营不景气，加之新的环境保护法即将实施，对危险废物管理更加严格，各企业不再向宏泰公司购买钡渣，导致该公司厂区内大量钡渣留存，无法处置。被告人张正文、赵强在明知钡渣不能随意处置的情况下，通过在车箱底部垫钡渣等方式在氮渣内掺入钡渣倾倒在氮渣堆场，并且借安顺市某环保砖厂名义签署工业废渣综合利用协议，填写虚假的危险废物转移联单，应付环保行政主管部门检查。2015年10月19日至23日，环保部西南督查中心联合贵州省环保厅开展危险废物污染防治专项督查过程中，查获宏泰公司的违法行为。经测绘，宏泰公司废渣堆场堆渣量为72194立方米，废渣平均密度为1250千克/立方米，堆渣量达90242.5吨。经对堆场废渣随机抽取的50个样本进行检测，均检出钡离子，其中两个样本检测值超过100mg/L。 |
