The Decision of the State Council on Amending the Regulation on the Procedures for the Development of Rules is hereby issued and shall come into force on May 1, 2018. 现公布《国务院关于修改〈规章制定程序条例〉的决定》,自2018年5月1日起施行。

Decision of the State Council on Amending the Regulation on the Procedures for the Development of Rules 国务院关于修改《规章制定程序条例》的决定
The State Council has decided to amend the Regulation on the Procedures for the Development of Rules as follows: 国务院决定对《规章制定程序条例》作如下修改:
I. Article 3 is amended to read: “The rules shall be developed according to the routes, guidelines, policies, decisions and deployments of the Party, under the legislative principle determined in the Legislation Law, and in compliance with the provisions of the Constitution, laws, administrative regulations and other superordinate law.   一、将第三条修改为:“制定规章,应当贯彻落实党的路线方针政策和决策部署,遵循立法法确定的立法原则,符合宪法、法律、行政法规和其他上位法的规定。
“Without basis of law or administrative regulations, decisions and orders of the State Council, no specifications impairing the rights of citizens, legal persons and other organizations or increasing their obligations shall be set in the departmental rules, no rights of the department shall be increased, or no statutory functions of the department shall be decreased. Without basis of laws, administrative regulations and local regulations, no specifications impairing the rights of citizens, legal persons and other organizations or increasing their obligations shall be set in the local regulations.” “没有法律或者国务院的行政法规、决定、命令的依据,部门规章不得设定减损公民、法人和其他组织权利或者增加其义务的规范,不得增加本部门的权力或者减少本部门的法定职责。没有法律、行政法规、地方性法规的依据,地方政府规章不得设定减损公民、法人和其他组织权利或者增加其义务的规范。”
II. One article is added as Article 4: “The development of the supporting rules on political laws shall be reported to the CPC Central Committee or the Party committee (Party group) at the same level in a timely manner in accordance with the relevant provisions.   二、增加一条,作为第四条:“制定政治方面法律的配套规章,应当按照有关规定及时报告党中央或者同级党委(党组)。
“The development of major economic and social rules shall be reported to the Party committee (Party group) at the same level in a timely manner according to the relevant provisions.” “制定重大经济社会方面的规章,应当按照有关规定及时报告同级党委(党组)。”
III. Article 5 is renumbered as Article 6 and paragraph 1 is amended to read: “(2) The spirit of comprehensively deepening reform shall be reflected, the administrative acts shall be scientifically regulated, and the transformation of government functions to macro-control, market supervision, social management, public services, environmental protection and other aspects shall be promoted.”   三、将第五条改为第六条,第一款修改为:“制定规章,应当体现全面深化改革精神,科学规范行政行为,促进政府职能向宏观调控、市场监管、社会管理、公共服务、环境保护等方面转变。”
IV. Article 9 is renumbered as Article 10 and paragraph 2 is amended to read: “The departments affiliated to the people's governments of provinces, autonomous regions, municipalities directly under the Central Government, districted cities and autonomous prefectures or the people's governments at lower levels deeming that the rules of local governments need to be developed shall submit requests for project establishment to the people's governments of the provinces, autonomous regions, municipalities directly under the Central Government, districted cities and autonomous prefectures.”   四、将第九条改为第十条,第二款修改为:“省、自治区、直辖市和设区的市、自治州的人民政府所属工作部门或者下级人民政府认为需要制定地方政府规章的,应当向该省、自治区、直辖市或者设区的市、自治州的人民政府报请立项。”
One paragraph is added as paragraph 3: “The departments of the State Council, and the people's governments of the provinces, autonomous regions, municipalities directly under the Central Government, districted cities and autonomous prefectures may publicly collect proposals on the development of rules.” 增加一款,作为第三款:“国务院部门,省、自治区、直辖市和设区的市、自治州的人民政府,可以向社会公开征集规章制定项目建议。”
V. Article 11 is renumbered as Article 12 and paragraph 1 is amended to read: “The legislative affairs offices of the departments under the State Council, and the legislative affairs offices of the people's governments of the provinces, autonomous regions, municipalities directly under the Central Government, districted cities and autonomous prefectures (hereinafter referred to as the “legislative affairs offices”) shall conduct evaluation and demonstration of the applications for project establishment of rules development and the proposals for the rules development projects publicly collected, develop the annual work plans of the departments and people's governments at the same levels for the development of rules, and disclose them to the public with the approval of the departments and people's governments at the same levels.”   五、将第十一条改为第十二条,第一款修改为:“国务院部门法制机构,省、自治区、直辖市和设区的市、自治州的人民政府法制机构(以下简称法制机构),应当对制定规章的立项申请和公开征集的规章制定项目建议进行评估论证,拟订本部门、本级人民政府年度规章制定工作计划,报本部门、本级人民政府批准后向社会公布。”
VI. Article 12 is renumbered as Article 13 and paragraph 1 is amended to read: “The departments of the State Council, and the people's governments of provinces, autonomous regions, municipalities directly under the Central Government, districted cities and autonomous prefectures shall strengthen the leadership of the implementation of the annual work plans for the development of rules. Entities assuming the work of drafting shall spare no effort to implement the projects included in the annual work plans for the development of rules and report them to the departments or the people's governments at the same levels for decision-making as required.”   六、将第十二条改为第十三条,第一款修改为:“国务院部门,省、自治区、直辖市和设区的市、自治州的人民政府,应当加强对执行年度规章制定工作计划的领导。对列入年度规章制定工作计划的项目,承担起草工作的单位应当抓紧工作,按照要求上报本部门或者本级人民政府决定。”
One paragraph is added as paragraph 2: “The legislative affairs office shall follow up and understand the implementation of the annual work plans of the department and the people's government at the same level for the development of rules, and strengthen the organization, coordination, supervision and guidance.” 增加一款,作为第二款:“法制机构应当及时跟踪了解本部门、本级人民政府年度规章制定工作计划执行情况,加强组织协调和督促指导。”
VII. Article 14 is renumbered as Article 15, and one paragraph is added as paragraph 2: “To draft rules, except those needs to be kept confidential, the drafting department shall disclose the draft of the rules and the explanation thereof to the public, for requesting comments. Generally, the time limit for disclosing it to the public and requesting comments shall not be less than 30 days.”   七、将第十四条改为第十五条,增加一款,作为第二款:“起草规章,除依法需要保密的外,应当将规章草案及其说明等向社会公布,征求意见。向社会公布征求意见的期限一般不少于30日。”
Paragraph 4 of Article 13 is renumbered as paragraph 3 of Article 15 and amended to read: “To draft highly professional rules, the drafting department may absorb experts in the relevant field to participate in drafting, or authorize relevant experts, teaching and scientific research entities and social organizations to conduct drafting.” 将第十三条第四款改为第十五条第三款,修改为:“起草专业性较强的规章,可以吸收相关领域的专家参与起草工作,或者委托有关专家、教学科研单位、社会组织起草。”
VIII. Article 15 is renumbered as Article 16 and amended to read: “Where the drafting of rules involves focal or difficult issue that attracts wide public attention or any prominent conflict encountered in economic and social development, impairs the rights of citizens, legal persons and other organizations or increases their obligations, causes significant impact on the public, and involves other major interest adjustment matters, the drafting entity shall conduct demonstration and consultation, and extensively request opinions of the relevant parties.   八、将第十五条改为第十六条,修改为:“起草规章,涉及社会公众普遍关注的热点难点问题和经济社会发展遇到的突出矛盾,减损公民、法人和其他组织权利或者增加其义务,对社会公众有重要影响等重大利益调整事项的,起草单位应当进行论证咨询,广泛听取有关方面的意见。
“Where the drafted rules involve major interest adjustments or major differences of opinions, have a significant impact on the rights and obligations of citizens, legal persons or other organizations, and attract wide public attention, and a hearing needs to be held, the drafting entity shall hold a hearing to request comments. A hearing shall be organized according to the following procedures: “起草的规章涉及重大利益调整或者存在重大意见分歧,对公民、法人或者其他组织的权利义务有较大影响,人民群众普遍关注,需要进行听证的,起草单位应当举行听证会听取意见。听证会依照下列程序组织:
“(1) To hold a hearing publicly, the drafting entity shall, 30 days prior to the holding of the hearing, announce the time, place and contents of the hearing. “(一)听证会公开举行,起草单位应当在举行听证会的30日前公布听证会的时间、地点和内容;
“(2) The relevant authorities, organizations and citizens attending the hearing shall have the right to raise questions and express comments on the drafted rule. “(二)参加听证会的有关机关、组织和公民对起草的规章,有权提问和发表意见;
“(3) Transcripts shall be developed for the hearing, to faithfully record the main opinions and grounds of the speakers. “(三)听证会应当制作笔录,如实记录发言人的主要观点和理由;
“(4) The drafting entity shall diligently study all kinds of comments reflected at the hearing, and the drafted rules shall, when being submitted for review, specify the handling of the opinions at the hearing and the grounds.” “(四)起草单位应当认真研究听证会反映的各种意见,起草的规章在报送审查时,应当说明对听证会意见的处理情况及其理由。”
IX. Article 17 is renumbered as Article 18 and paragraph 3 is amended to read: “The explanations of a draft of rules for review shall explain the necessity for developing the rules, the major measures prescribed, the opinions of the relevant parties and the coordination and handling thereof, among others.”   九、将第十七条改为第十八条,第三款修改为:“规章送审稿的说明应当对制定规章的必要性、规定的主要措施、有关方面的意见及其协调处理情况等作出说明。”
Paragraph 4 is amended to read: “The relevant materials mainly include the actual circumstances of the fields regulated and relevant data, major problems existing in practice, comments summarized, transcript of the hearing, investigation and research reports, relevant domestic and foreign legislative materials, among others.” 第四款修改为:“有关材料主要包括所规范领域的实际情况和相关数据、实践中存在的主要问题、汇总的意见、听证会笔录、调研报告、国内外有关立法资料等。”
X. Article 18 is renumbered as Article 19 and amended to read: “The legislative affairs office shall be responsible for the unified examination of the drafts of rules for review.” The legislative affairs office shall examine the drafts for review mainly from the following respects:   十、将第十八条改为第十九条,修改为:“规章送审稿由法制机构负责统一审查。法制机构主要从以下方面对送审稿进行审查:
“(1) Whether the provisions of Articles 3, 4, 5 and 6 of this Regulation are complied with. “(一)是否符合本条例第三条、第四条、第五条、第六条的规定;
“(2) Whether the requirements for the core socialist values are satisfied. “(二)是否符合社会主义核心价值观的要求;
“(3) Whether they are coordinated and connected with the relevant rules. “(三)是否与有关规章协调、衔接;
“(4) Whether the comments of the relevant authorities, organizations and citizens on the major issues of the drafts of rules for review are correctly handled. “(四)是否正确处理有关机关、组织和公民对规章送审稿主要问题的意见;
“(5) Whether the technical requirements for legislation are satisfied. “(五)是否符合立法技术要求;
“(6) Other contents that needs to be reviewed.” “(六)需要审查的其他内容。”
XI. Article 19 is renumbered as Article 20 and amended to read: “Where a draft of rules for review falls under one of the following circumstances, the legislative affairs office may suspend the review or return it to the drafting entity:   十一、将第十九条改为第二十条,修改为:“规章送审稿有下列情形之一的,法制机构可以缓办或者退回起草单位:
“(1) The basic conditions for the development of the rules are not mature or have significant change. “(一)制定规章的基本条件尚不成熟或者发生重大变化的;
“(2) The relevant institution or department has relatively serious dispute over the main system as prescribed in the draft of rules for review, and the drafting entity has not conducted sufficient consultation with the relevant institution or department. “(二)有关机构或者部门对规章送审稿规定的主要制度存在较大争议,起草单位未与有关机构或者部门充分协商的;
“(3) Comments are not publicly requested according to the relevant provisions of this Regulation. “(三)未按照本条例有关规定公开征求意见的;
“(4) The draft for review submitted does not comply with the provisions of Articles 18 of this Regulation.” “(四)上报送审稿不符合本条例第十八条规定的。”
XII. Article 20 is renumbered as Article 21 and one paragraph is added as paragraph 2: “The legislative affairs office may disclose a draft of rules for review or revised draft and the explanations thereof to the public for requesting comments. Generally, the time limit for disclosing it to the public and requesting comments shall not be less than 30 days.”   十二、将第二十条改为第二十一条,增加一款,作为第二款:“法制机构可以将规章送审稿或者修改稿及其说明等向社会公布,征求意见。向社会公布征求意见的期限一般不少于30日。”
XIII. Articles 22 and 23 are combined as Article 23 and amended to read: “Where a draft of rules for review involve adjustments to major interests, the legislative affairs office shall conduct demonstration and consultation, and extensively request comments of the relevant parties. Argumentation consulting may be conducted by holding forums, demonstration meetings and hearings, conducting entrusted research, and adopting other various forms.   十三、将第二十二条、第二十三条合并,作为第二十三条,修改为:“规章送审稿涉及重大利益调整的,法制机构应当进行论证咨询,广泛听取有关方面的意见。论证咨询可以采取座谈会、论证会、听证会、委托研究等多种形式。
“Where a draft of rules for review involves major interest adjustments or major differences of opinions, has a significant impact on the rights and obligations of citizens, legal persons or other organizations, and attracts wide public attention, and the drafting entity does not hold a hearing during the process of drafting, the legislative affairs office may, upon approval of the department or the people's government at the same level, hold a hearing. A hearing to be held shall be organized in accordance with the procedures as prescribed in Article 16 of this Regulation.” “规章送审稿涉及重大利益调整或者存在重大意见分歧,对公民、法人或者其他组织的权利义务有较大影响,人民群众普遍关注,起草单位在起草过程中未举行听证会的,法制机构经本部门或者本级人民政府批准,可以举行听证会。举行听证会的,应当依照本条例第十六条规定的程序组织。”
XIV. Article 24 is amended to read: “Where a relevant institution or department has different opinions on the major measures, management systems and division of functions and other issues involved in the draft of rules for review, the legislative affairs office shall conduct coordination and strive to reach consensus. For major legislation matters with relatively large dispute, the legislative affairs office may entrust relevant experts, teaching and scientific research entities and social organizations to conduct evaluation.   十四、将第二十四条修改为:“有关机构或者部门对规章送审稿涉及的主要措施、管理体制、权限分工等问题有不同意见的,法制机构应当进行协调,力求达成一致意见。对有较大争议的重要立法事项,法制机构可以委托有关专家、教学科研单位、社会组织进行评估。
“Where consensus is unable to be reached through sufficient coordination, the legislative affairs office shall report the main issues, opinions of the relevant institutions, departments and legislative affairs offices to the leaders of the respective departments or leaders of the people's governments at the same level for coordination in a timely manner or report them to the respective departments or the people's governments at the same level for decision-making.” “经过充分协调不能达成一致意见的,法制机构应当将主要问题、有关机构或者部门的意见和法制机构的意见及时报本部门或者本级人民政府领导协调,或者报本部门或者本级人民政府决定。”
XV. Article 29 is amended to read: “The legislative affairs office shall amend the draft of rules according to the deliberation opinions of the relevant meeting, form a revised draft, and submit it to the governor of a province or autonomous region or the mayor of a city or autonomous prefecture for issuance by an order signed thereby.”   十五、将第二十九条修改为:“法制机构应当根据有关会议审议意见对规章草案进行修改,形成草案修改稿,报请本部门首长或者省长、自治区主席、市长、自治州州长签署命令予以公布。”
XVI. Article 31 is amended to read: “State Council departmental rules shall, after issuance upon signature, be published in a timely manner in the State Council Gazette or gazettes of the departments, on the website of the Legislative Affairs Office of the State Council, and in newspapers distributed nationwide.   十六、将第三十一条修改为:“部门规章签署公布后,及时在国务院公报或者部门公报和中国政府法制信息网以及在全国范围内发行的报纸上刊载。
“The rules of a local government shall, after issuance upon signature, be published in a timely manner in the gazette of the local people's government, on the website of the Legislative Affairs Office of the State Council, and in newspapers distributed within its administrative region. “地方政府规章签署公布后,及时在本级人民政府公报和中国政府法制信息网以及在本行政区域范围内发行的报纸上刊载。
“The text of rules published in the gazette of the State Council or gazettes of the departments and gazette of the local people's government shall be the standard text.” “在国务院公报或者部门公报和地方人民政府公报上刊登的规章文本为标准文本。”
XVII. Article 35 is amended to read: “The state organs, social organizations, enterprises, public institutions and citizens believing that the rules conflict with the laws or administrative regulations may offer written suggestions for examination to the State Council, and the legislative affairs office of the State Council shall conduct research and offer handling opinions and handle it according to the prescribed procedures.   十七、将第三十五条修改为:“国家机关、社会团体、企业事业组织、公民认为规章同法律、行政法规相抵触的,可以向国务院书面提出审查的建议,由国务院法制机构研究并提出处理意见,按照规定程序处理。
“The state organs, social organizations, enterprises, public institutions and citizens believing that the rules of the people's governments of the districted cities and autonomous prefectures conflict with the laws or administrative regulations or violate the provisions of other superordinate laws may also offer written suggestions for examination to the people's governments of the provinces and autonomous regions, and the legislative affairs offices of the people's governments of the provinces and autonomous regions shall conduct research and offer handling opinions, and handle it according to the prescribed procedures.” “国家机关、社会团体、企业事业组织、公民认为设区的市、自治州的人民政府规章同法律、行政法规相抵触或者违反其他上位法的规定的,也可以向本省、自治区人民政府书面提出审查的建议,由省、自治区人民政府法制机构研究并提出处理意见,按照规定程序处理。”
XVIII. Article 37 is amended to read: “The departments under the State Council and the people's governments of the provinces, autonomous regions, municipalities directly under the Central Government, districted cities and autonomous prefectures shall, according to the needs of comprehensive deepening of reform, the economic and social development needs and the provisions of the superordinate law, organize and conduct review of rules in a timely manner. The rules that do not meet the needs of comprehensive deepening of reform and the economic and social development needs and that do not comply with the provisions of the superordinate law shall be amended or repealed in a timely manner.”   十八、将第三十七条修改为:“国务院部门,省、自治区、直辖市和设区的市、自治州的人民政府,应当根据全面深化改革、经济社会发展需要以及上位法规定,及时组织开展规章清理工作。对不适应全面深化改革和经济社会发展要求、不符合上位法规定的规章,应当及时修改或者废止。”
XIX. One article is added as Article 38: “The departments under the State Council and the people's governments of the provinces, autonomous regions, municipalities directly under the Central Government, districted cities and autonomous prefectures may organize post-legislation evaluation of the relevant rules or the relevant provisions of the rules and regard the evaluation results as an important reference for amending or repealing the relevant rules.”   十九、增加一条,作为第三十八条:“国务院部门,省、自治区、直辖市和设区的市、自治州的人民政府,可以组织对有关规章或者规章中的有关规定进行立法后评估,并把评估结果作为修改、废止有关规章的重要参考。”
XX. Paragraph 2 of Article 35 is renumbered as paragraph 1 of Article 39 and amended to read: “The procedures for the amendment to and repeal of the rules shall be governed by this Regulation.”   二十、将第三十七条第二款改为第三十九条第一款,修改为:“规章的修改、废止程序适用本条例的有关规定。”
One paragraph is added as paragraph 2: “After being amended or repealed, the rules shall be issued in a timely manner.” 增加一款,作为第二款:“规章修改、废止后,应当及时公布。”
In addition, the sequence of articles and some words shall be adjusted and amended accordingly. 此外,对条文顺序和个别文字作相应调整和修改。
This Decision shall come into force on May 1, 2018. 本决定自2018年5月1日起施行。
The Regulation on the Procedures for the Development of Rules shall, as accordingly amended according to this Decision, be reissued. 规章制定程序条例》根据本决定作相应修改,重新公布。
