Recently, the regulatory authorities have received reports that some individuals or social groups have issued information on “surrender of insurance policies in full” on online platforms or by SMS and other means for the purpose of making profits, induce or instigate consumers to entrust them to “surrender insurance policies in full” on a commissioned basis, and collect expensive commission fees from consumers, mainly involving traditional life insurance, health insurance and other personal insurance products. Such actions not only disrupt the normal business operation order of the insurance market, but also ultimately damage the lawful rights and interests of insurance consumers. The Financial Rights Protection Bureau of the China Banking and Insurance Regulatory Commission (“CBIRC”) reminds consumers that they should be alert to the hidden risks and potential hazards of “commissioned surrender of insurance policies,” prudently handle surrender of insurance policies according to their own needs, and rationally protect their legal rights and interests from infringement according to the law. 近期,监管部门收到反映,一些个人或社会团体以牟利为目的,通过网络平台、短信等方式发布“可办理全额退保”信息,以怂恿、诱导等手段让消费者委托其代理“全额退保”事宜,并以此收取消费者高额手续费,主要涉及传统寿险、健康险等人身保险产品。此类行为不仅扰乱保险市场正常经营秩序,而且最终损害保险消费者的合法权益。中国银保监会消费者权益保护局提醒消费者:要警惕“代理退保”的风险隐患,根据自身需求谨慎办理退保,依法理性维护自身合法权益不受侵害。
The following three risks are hidden in “commissioned surrender of insurance policies” at a minimum. “代理退保”行为隐藏至少以下三种风险。
The first risk is loss of normal insurance coverage. For the purposes of seeking benefits, some individuals or groups providing “commissioned surrender of insurance policies” pretend to be staff members of the regulatory departments or insurance companies to conduct false publicity, saying that the insurance products purchased by consumers “are fraudulent and have been complained by multiple consumers” or “continuous holding of insurance policies will result in economic losses,” and induce and instigate consumers who do not know the truth to terminate normal insurance contracts, making consumers lose insurance coverage. When purchasing insurance anew in the future, consumers may be confronted with such risks as recalculation of waiting period, rising insurance premiums, and even rejection due to changes in age and health status.

 一是失去正常保险保障风险。为牟取利益,一些从事“代理退保”的个人或团体冒充监管部门或保险公司工作人员进行虚假宣传,称消费者所购保险产品“存在欺诈行为,已有多名消费者投诉”或“继续持有保单将蒙受经济损失”等,挑唆、怂恿不明真相的消费者终止正常的保险合同,使消费者丧失风险保障。消费者未来再次投保时,由于年龄、健康状况的变化,可能将面临重新计算等待期、保费上涨甚至被拒保的风险。
