| The intellectual property offices (administrative departments of intellectual property rights) of all provinces, autonomous regions, municipalities directly under the Central Government, and Xinjiang Production and Construction Corps: | | 各省、自治区、直辖市、新疆生产建设兵团知识产权局（知识产权管理部门）： |
| For the purposes of implementing the decisions and deployments of the CPC Central Committee and the State Council on strict protection of intellectual property rights, and fully maximizing the important role of the protection of well-known trademarks in accelerating the construction of a power of intellectual property rights and creating a favorable business environment, in accordance with the Trademark Law, the Regulation on the Implementation of the Trademark Law and the Provisions on the Recognition and Protection of Well-Known Trademarks, and according to the requirements for the duties after the institutional reform, you are hereby notified of further strengthening the work concerning the protection of well-known trademarks in the investigation into and handling of trademark violation cases as follows: | | 为贯彻落实党中央、国务院关于严格知识产权保护的决策部署，充分发挥驰名商标保护在加快知识产权强国建设、营造良好营商环境等方面的重要作用，依据《商标法》《商标法实施条例》《驰名商标认定和保护规定》，根据机构改革后的职责要求，现就进一步加强查处商标违法案件中驰名商标保护工作通知如下。 |
| I. Investigating and handling cases involving well-known trademarks in strict accordance with the statutory authority and within the prescribed time limit | | 一、严格按照法定权限和时限查办涉驰名商标案件 |
| 1. Case-filing subjects. Trademark violation cases involving the protection of well-known trademarks shall be under the jurisdiction of the administrative departments of intellectual property rights at or above the city (prefecture and autonomous prefecture) level (hereinafter referred to as “case-filing authorities”). The administrative departments of intellectual property rights of counties (cities or districts) directly under the provincial governments approved by the former State Administration for Industry and Commerce to obtain the case-filing authority and have economic and social administration authority in districted cities may continue to handle such cases. Where the counties (cities and districts) directly under the provincial government that are added or adjusted intend to obtain the case-filing authority for well-known trademarks, they shall report to the National Intellectual Property Administration (“CNIPA”) for approval in a timely manner. | | （一）立案主体。涉及驰名商标保护的商标违法案件，由市（地、州）级以上知识产权管理部门（以下简称立案机关）管辖。经原国家工商行政管理总局批准取得立案权限的具有设区市经济社会等管理权限的省直辖县（市、区）知识产权管理部门可继续办理该类案件。省直辖县（市、区）有新增或调整，拟取得驰名商标立案权限的，应及时报国家知识产权局批准。 |
2. Time limit for investigation and handling. According to the Interim Provisions on the Procedures for Administrative Punishments for Market Supervision and Administration, a case-filing authority investigating and handling the illegal acts involving the protection of well-known trademarks shall, within 15 working days of receipt of the written request materials submitted by the parties, decide whether to file the case, and under special circumstances, the said period may be extended for 15 working days with the approval of the person in charge of the entity. Where, upon preliminary inspection, the provisions are complied with, the request for the recognition of a well-known trademark and duplicates of the case materials shall be jointly submitted to the administrative department of intellectual property rights of the province (autonomous region or municipality directly under the Central Government) within 30 days of case-filing; and where the provisions are not complied with upon inspection, the parties shall be notified of the reasons and it shall be handled in a timely manner.
．．．．．． | | （二）查办时限。按照《市场监督管理行政处罚程序暂行规定》的规定，立案机关查处涉及驰名商标保护的违法行为，应于收到当事人书面请求材料之日起十五个工作日内决定是否立案，有特殊情况的，经单位负责人批准可以延长十五个工作日。初步核查符合规定的，应当自立案之日起三十日内将驰名商标认定请示、案件材料副本一并报送省（自治区、直辖市）知识产权管理部门；经审查不符合规定的，应告知当事人理由并及时处理。
