Guiding Opinions of the General Office of the State Council on Effectively Bringing into Play the Role of Government-backed Financing Guarantee Funds and Effectually Supporting the Development of Micro and Small-sized Enterprises and "Agriculture, Rural Areas and Farmers"

The people's governments of all provinces, autonomous regions, and municipalities directly under the Central Government; all ministries and commissions of the State Council; and all institutions directly under the State Council: 各省、自治区、直辖市人民政府,国务院各部委、各直属机构:
Over recent years, all regions and authorities have conscientiously implemented the Opinions of the State Council on Promoting the Accelerated Development of the Financing Guarantee Industry (No. 43 [2015], State Council) and carried out positive exploration in accordance with the requirements made at the National Financial Work Conference for the establishment of national and local financing guarantee funds and the improvement on the government-backed financing guarantee and re-guarantee system, among others, which promoted the continual development and growth of government-backed financing guarantee funds (institutions). However, there exist problems in the financing guarantee industry such as insufficient business focus, weak guarantee capability, impeded cooperation between banks and guarantors, and room for improvement on the risk sharing and compensation mechanism. For the purposes of further bringing into play the role of government-backed financing guarantee funds and guiding more financial resources in supporting the development of micro and small-sized enterprises and "agriculture, rural areas and farmers," with the approval of the State Council, the following opinions are hereby offered: 近年来,各地区、各部门认真贯彻落实《国务院关于促进融资担保行业加快发展的意见》(国发〔2015〕43号),按照全国金融工作会议关于设立国家和地方融资担保基金、完善政府性融资担保和再担保体系等要求,进行了积极探索,推动政府性融资担保基金(机构)不断发展壮大。但融资担保行业还存在业务聚焦不够、担保能力不强、银担合作不畅、风险分担补偿机制有待健全等问题。为进一步发挥政府性融资担保基金作用,引导更多金融资源支持小微企业和“三农”发展,经国务院同意,现提出以下意见:
I. General requirements   一、总体要求
1. Guiding ideology. Xi Jinping Thought on Socialism with Chinese Characteristics in a New Era shall serve as the guidance, the spirit of the 19th CPC National Congress and the Second and Third Plenary Sessions of the 19th CPC Central Committee shall be fully implemented, the Party's overall leadership shall be adhered to and strengthened, the general working tone of steady progress shall be adhered to, the new development concept shall be adhered to, the change in the principal contradiction in Chinese society shall be brought into close focus, the requirements for high-quality development shall be followed, the holistic advancement of the overall layout for "economic, political, cultural, social, and ecological progress" and the coordinated advancement of the Four-Pronged Comprehensive Strategy shall be closely centered on, the use of the supply-side structural reform as the theme shall be adhered to, the operations of government-backed financing guarantee funds shall be regulated, and the quasi-public position of government-backed financing guarantee institutions shall be upheld, so as to compensate for shortcomings in the market, lower the threshold for guarantee services, strive to ease the financing difficulties and costs in micro and small-sized enterprises, "agriculture, rural areas and farmers" and other inclusive fields, support the development of strategic emerging industries, and promote entrepreneurship and innovation among all the people. (一)指导思想。以习近平新时代中国特色社会主义思想为指导,全面贯彻党的十九大和十九届二中、三中全会精神,坚持和加强党的全面领导,坚持稳中求进工作总基调,坚持新发展理念,紧扣我国社会主要矛盾变化,按照高质量发展要求,紧紧围绕统筹推进“五位一体”总体布局和协调推进“四个全面”战略布局,坚持以供给侧结构性改革为主线,规范政府性融资担保基金运作,坚守政府性融资担保机构的准公共定位,弥补市场不足,降低担保服务门槛,着力缓解小微企业、“三农”等普惠领域融资难、融资贵,支持发展战略性新兴产业,促进大众创业、万众创新。
2. Basic principles. (二)基本原则。
Focusing on principal business that supports micro and small-sized enterprises and "agriculture, rural areas and farmers": Government-backed financing guarantee and re-guarantee institutions shall strictly use financing guarantee business for micro and small-sized enterprises and "agriculture, rural areas and farmers" as their principal business, support qualified strategic emerging industry projects, continually raise the scale and proportion of guarantee business in support of micro and small-sized enterprises and "agriculture, rural areas and farmers," and serve entrepreneurship and innovation among all the people, and shall not deviate from their principal business to expand their scope of business blindly, provide guarantee for the issuance of government bonds, provide credit enhancement for the government's financing platforms to raise financing, or make equity investment in non-financing guarantee institutions. 聚焦支小支农主业。政府性融资担保、再担保机构要严格以小微企业和“三农”融资担保业务为主业,支持符合条件的战略性新兴产业项目,不断提高支小支农担保业务规模和占比,服务大众创业、万众创新,不得偏离主业盲目扩大业务范围,不得为政府债券发行提供担保,不得为政府融资平台融资提供增信,不得向非融资担保机构进行股权投资。
Adhering to operating at a principal-protected narrow margin: Government-backed financing guarantee and re-guarantee institutions are not for profit, and under the premise of sustainable operation, they shall hold a low fee rate to effectively reduce the comprehensive financing costs for micro and small-sized enterprises and "agriculture, rural areas and farmers." 坚持保本微利运行。政府性融资担保、再担保机构不以营利为目的,在可持续经营的前提下,保持较低费率水平,切实有效降低小微企业和“三农”综合融资成本。
Implementing risk sharing and compensation: A bank-guarantor cooperation mechanism in which government-backed financing guarantee institutions and banking financial institutions participate and reasonably divide risk shall be established. The government-supported and positive-incentive fund replenishment and risk compensation mechanism shall be optimized. 落实风险分担补偿。构建政府性融资担保机构和银行业金融机构共同参与、合理分险的银担合作机制。优化政府支持、正向激励的资金补充和风险补偿机制。
Joining the efforts of guarantee institutions: Business cooperation and resource sharing between government-backed financing guarantee and re-guarantee institutions at all levels shall be strengthened, capital strength and business development capabilities shall continue to be heightened, and efforts shall be concentrated on directing financial institutions to continually increase the extension of loans in support of micro and small-sized enterprises and "agriculture, rural areas and farmers." 凝聚担保机构合力。加强各级政府性融资担保、再担保机构业务合作和资源共享,不断增强资本实力和业务拓展能力,聚力引导金融机构不断加大支小支农贷款投放。
II. Adhering to focusing on financing guarantee business in support of micro and small-sized enterprises and "agriculture, rural areas and farmers."   二、坚持聚焦支小支农融资担保业务
3. Specifying the scope of support. Government-backed financing guarantee and re-guarantee institutions at all levels shall reasonably delineate the scope of customers and focus on micro and small-sized enterprises, individual industrial and commercial households, rural households, new types of agricultural businesses and other micro and small-sized enterprises and entities related to "agriculture, rural areas and farmers" as well as qualified enterprises in strategic emerging industries. Micro and small-sized enterprises shall be determined in accordance with the relevant provisions of the criteria for determining the types of small and medium-sized enterprises, and rural households shall be determined in accordance with the relevant provisions of the tax policy in support of financing by micro and small-sized enterprises. (三)明确支持范围。各级政府性融资担保、再担保机构要合理界定服务对象范围,聚焦小微企业、个体工商户、农户、新型农业经营主体等小微企业和“三农”主体,以及符合条件的战略性新兴产业企业。其中,小微企业认定标准按照中小企业划型标准有关规定执行,农户认定标准按照支持小微企业融资税收政策有关规定执行。
4. Focusing on key customers. Government-backed financing guarantee and re-guarantee institutions at all levels shall focus on supporting micro and small-sized enterprises and entities related to "agriculture, rural areas and farmers" each of which has an amount of guarantee of 5 million yuan or less and giving priority to provide guarantee as credit enhancement for the financing by micro and small-sized enterprises and entities related to "agriculture, rural areas and farmers" whose credit records and effective collateral are insufficient, of which the product is marketable, the project is promising, or technology is competitive. (四)聚焦重点对象。各级政府性融资担保、再担保机构要重点支持单户担保金额500万元及以下的小微企业和“三农”主体,优先为贷款信用记录和有效抵质押品不足但产品有市场、项目有前景、技术有竞争力的小微企业和“三农”主体融资提供担保增信。
5. Resuming principal guarantee business. Government-backed financing guarantee and re-guarantee institutions at all levels shall adhere to the principal financing guarantee business in support of micro and small-sized enterprises and "agriculture, rural areas and farmers," actively divest financing guarantee business for government bond issuance and government financing platforms, strictly control the operational scale and risk of capital not in use, abstain from equity investment in non-financing guarantee institutions, and gradually reduce the scale of guarantee business for medium and large-sized enterprises, so as to ensure that the guarantee business in support of micro and small-sized enterprises and "agriculture, rural areas and farmers" accounts for 80% or more. (五)回归担保主业。各级政府性融资担保、再担保机构要坚守支小支农融资担保主业,主动剥离政府债券发行和政府融资平台融资担保业务,严格控制闲置资金运作规模和风险,不得向非融资担保机构进行股权投资,逐步压缩大中型企业担保业务规模,确保支小支农担保业务占比达到80%以上。
6. Strengthening business guidance. The National Financing Guarantee Fund and provincial guarantee and re-guarantee funds (institutions) shall reasonably set the access conditions for cooperating institutions and drive cooperating institutions to gradually increase the scale and proportion of the guarantee business in support of micro and small-sized enterprises and "agriculture, rural areas and farmers." For a cooperating institution, the proportion of the amount of guarantee in support of micro and small-sized enterprises and "agriculture, rural areas and farmers" to its total amount of guarantee shall not be less than 80%, and the proportion of the amount of guarantee for entities each of which has an amount of guarantee of 5 million yuan or less shall not be less than 50%. (六)加强业务引导。国家融资担保基金和省级担保、再担保基金(机构)要合理设置合作机构准入条件,带动合作机构逐步提高支小支农担保业务规模和占比。合作机构支小支农担保金额占全部担保金额的比例不得低于80%,其中单户担保金额500万元及以下的占比不得低于50%。
7. Fulfilling the function of re-guarantee. The National Financing Guarantee Fund and provincial guarantee and re-guarantee funds (institutions) shall actively provide re-guarantee for eligible financing guarantee business, inject capital into eligible guarantee and re-guarantee institutions, and maximize the role of credit enhancement and risk division. The National Financing Guarantee Fund and provincial guarantee and re-guarantee funds (institutions) shall neither lower standards or conditions for cooperation in order to prevent the non-use of funds nor deviate from their principal business in pursuit of stable returns. (七)发挥再担保功能。国家融资担保基金和省级担保、再担保基金(机构)要积极为符合条件的融资担保业务提供再担保,向符合条件的担保、再担保机构注资,充分发挥增信分险作用。不得为防止资金闲置而降低合作条件标准,不得为追求稳定回报而偏离主业。
